RULES PARTS 7010.0100 - 7010.0700, STATE NOISE STANDARDS TO: MINNESOTA POLLUTION CONTROL AGENCY MR THOMAS J KALITOWSKI EXECUTIVE DIRECTOR BE IT RESOLVED, BY the City Council of the City of Hugo, Minnesota, the following: WHEREAS, The City of Hugo is responding to the above mentioned rule changes as found in the Minnesota State Register (9 S.R. 2058, March 18 1985). Titled draft rule amendments. WHEREAS, The City of Hugo is responding in particular to page 2060. Item 7010.0040 NOISE STANDARDS. Subpart 1. "Scope" Where -in it is stated; " NOISE STANDARDS IN SUBPART 2 APPLY TO ALL SOURCES" AND Item 7010.0050 NOISE AREA CLASSIFICATION. Subpart 2. NOISE AREA CLASSIFICATIONS. under; NOISE AREA CLASSIFICATION LAND USE ACTIVITIES 2 Commercial, entertainment, and RECREATIONAL; includes office buildings, retail stores and services, transient lodging, medical facilities not providing nighttime care, and athletic fields. WHEREAS, The City of Hugo has with -in its Jurisdiction, skeet, trap and/or shooting snorts clubs which produce impulsive noise. WHEREAS, The Citizens of Hugo have on two occasions, been involved in legal actions regarding impulsive noise. The above two actions culminated in decisions being handed down by the Minnesota Supreme Court. WHEREAS, The City of Hugo is itself presently involved in legal action regarding impulsive noise. WHEREAS, The City of Hugo obiects to any proposed rule changes affecting Impulsive noise standards•. WHEREAS, In summary the City of Hugo obiects to any rule changes which may come into conflict with; Minnesota Statute 116.07 Subdivision 2a -2- RESOLUTION 1985-22 EXEMPTIONS FROM STANDARDS. No standards adopted by any state aqency for limitinq levels of noise in terms of sound pressure which may occur in the outdoor atmosphere shall apply to skeet, trap or shootinq sports clubs. Nothinq herein shall prohibit a local unit of government from revulatinq the location and operation of skeet trap or shooting sports clubs. ADOPTED AND PASSED THIS DAY 1985. J.
