WHEREAS, the Metropolitan Sewer Board is installing the so-called Forest Lake interceptor through Minneapolis=st. Paul Service Area Plumber 1; and WHEREAS, statements of amounts due were rendered by the MetrD-Politan Sewer Board to the Township of Oneka and the Village of Hugo, in the calendar year 1971 for payments due in 1972, respectively; and WHEREAS, the Township of Oneka has not made payment-, either in whole or in part, on the statement rendered to it, and has appealed the charges imposed as set forth in the letter to the Metropolitan Sewer Board dated December 2, 1971, and signed by Donald Lease, Chairman of the Township Board of Supervisors; and WHEREAS, the Village of Hugo, as it existed in 1971, erroneously paid in full the charges rendered on its statement from general funds; and WHEREAS, the Township of Oneka and the Village of Hugo were consolidated by Order of the Minnesota Municipal Commission during calendar year 1971 into a new single Village of Hugo, encompassing the total areas of the former Township of Oneka and Village of Hugo, said consolidation becoming effective upon election and qualification of its new village officers pursuant to Order dated 13th day of September, 1971, said qualifications being in January of 1972 and VflflsREAS, in the calendar year 1970, the stated policy for determining the charges to be bille(I communities for 1971 included a limitation that there had to be sewer service available, and discharae or an imminent likelihood of discharge into the system before charges could be levied against a community; and WHEREAS, in 1970 the Township of Oneka had no sewer service available, had 110 discharge or irLL7, ,tanent discharge; and, in fact, had no qualified PIan for the construction Of a - sewer system within its area; this situation continuing to the joresent and WHEREAS, the Township of Oneka relied on stated Policy and did not levy any tax for payment of the charges billed at its meeting in March of 1971, thereby resulting in no tax annual for this account; and collection in 1972 WHEREAS, the statement rendered the Township of Oneka is believed to be based on erroneous population and assessed valuation figures resulting in a is excessive; and T/qfEREAS, the consolidated village of Hugo does not have the funds to pay the bill rendered to the Township of One and WHEREAS, the consolidated Villaae of Hugo does n the economic ability to pay not have the bill renderedto the Township of Oneka payable in 1972, and W UREAS, tile Townsh-D OfOneka and the no longer exist as pOlitic'11 entities, and , former Village of Hugo W REAS, tj-,e C,,c):,�szo,,3atee ME A Vi Mage; Of Hugo is under the duty to administer obligations of the TownsIlip of On and, the former Village Of Hugo, as they existed at the time of consolidation.
