HomeMy WebLinkAbout2005.09.20 CC MinutesMINUTES FOR THE RECESSED MEETING OF SEPTEMBER 19, 2005 Acting Mayor Becky Petryk reconvened the September 19, 2005 meeting at 8:00 am. PRESENT: Granger, Petryk, Puleo, Miron (Mayor Miron arrived at 8:25 am) City Administrator Mike Ericson, CD Director Bryan Bear, City Attorney Dave Snyder, and City Clerk Mary Ann Creager ABSENT: Chuck Haas REVIEW OF ED KIEGER'S CUP AT 165' STREET AND TH61 In May, 2003, the City Council approved an amendment to the CUP for property owned by Kieger Enterprises located at 5885 165' Street North. As a condition of approval, the CUP is to be reviewed after an initial two-year period with a four- year review period thereafter. Staff inspected the property on September 14, 2005 and found it to be in compliance with the CUP. Council questioned whether what, if any, business was being conducted at the site. Staff had recommended Council renew the CUP for 5885 165d' Street North for four years. Granger made motion, Puleo seconded, to table this matter until October 3, 2005. All aye. Motion Carried. City Council meeting of September 19, 2005 Page 7 DISCUSSION OF WILDERNESS VIEW 2"D CONCEPT PLAN Redstone Homes is requesting a PUD sketch plan review of "Wilderness View Second Addition" consisting of 67 single family homes on property located west of Goodview Avenue and south of 130th Street. The Planning Commission reviewed the sketch plan at their September 8th meeting and provided comments to the applicant. Staff recommended Council review and discuss the sketch plan and provide the applicant with informal comments. CD Director Bryan Bear provided a PowerPoint presentation with an overview of the proposed project. (MAYOR MIRON ARRIVED AT 8:25 PM). Council reviewed the sketch plan and expressed the following concerns: 1) setback of buildings from existing cell tower; 2) location of pipeline on site; 3) bay homes too close together; and 4) why the need for a PUD, nothing offered in return. Sam Ashkar from Redstone Homes thanked Council for their time and stated that he will continue to work with staff on this matter. No formal Council action was taken. SCHEDULE WORKSHOP FOR DISCUSSION OF MULTI -FAMILY DESIGN GUIDELINES At its September 6, 2005 meeting, Council accepted the Proposal for Professional Services from Landform for development of design guidelines for multi -family housing. Miron made motion, Granger seconded, to schedule a joint Council/Planning Commission workshop for Monday, October 24, 2005, at 7:00 pm, to discuss development of the design guidelines for multi -family housing. Recessed Council meeting of September 19, 2005 Page 2 GLAMOS/ATKINSON PRETRIAL MEETING REGARDING PELOOUIN INDUSTRIAL PARK On September 2, 2005, the City was present at the pretrial meeting the Glamos and Atkinson families regarding the assessment appeal for the Peloquin Industrial Park public improvement project. City Attorney Dave Snyder provided Council with an update on the pretrial meeting. No formal Council action was taken. LAWSUIT AGAINST THE RICE CREEK WATERSHED DISTRICT As an affected landowner, Mayor Fran Miron handed the gavel to acting Mayor Becky Petryk to remove perceived conflict of interest. Council member Frank Puleo stated that the RCWD has been named in litigation with the State of Minnesota (DNR) and the Minnesota Center for Environmental Advocacy and wanted these discussed with the City Attorney to determine any involvement of the City of Hugo. RCWD Administrator Steve Hobbs addressed Council stating that the RCWD has chosen not to contest any orders. Steve answered many questions from the council and inquired as to what else the City would require to receive a permit. City Attorney Dave Snyder presented Council with three options as to actions that could be taken by the City. Petryk made motion, Puleo seconded, that the City of Hugo takes the position to determine whether to issue a permit to the RCWD, based on a meeting with Council members Frank Puleo and Mike Granger and the Blue Ribbon Task Force, and Council will respect the results of the meeting based on their recommendation whether or not to issue RCWD permit. Council discussion continued and Petryk and Puleo withdrew their motion. Puleo made motion, Granger seconded, authorizing the City Attorney to represent the City of Hugo in any manner needed in respect to the injunction hearing on proposed MnDNR action. All aye. Motion Carried. Mayor Miron then rejoined the Council at the dais and requested a motion for adjournment. ADJOURN Petryk made motion, Granger seconded, to adjourn at 9:45 am. All aye. Motion Carried.
