PRESENT: Granger, Haas, Petryk, Puleo, Miron City Administrator, Michael Ericson City Attorney, Dave Snyder JD2 Attorney, Paul Haik Property owners also named in JD2 litigation Mayor Miron turned the gavel over to Acting Mayor Chuck Haas then sat in the audience UPDATE ON JD2 LITIGATION AND FEBRUARY 12TH DEADLINE FOR SUBMITTAL OF BRIEFS Paul Haik informed the Council that he had submitted the City's brief to Judge Stephen Muehlberg by 5:00 pm, February 12, 2001. Judge Muehlberg has 90 days (May 12, 2001) to make his ruling. He sends his ruling in the mail; he doesn't call or fax with the results. He said plaintiffs should be "patient and quiet". IMPACT & ISSUES RELATED TO JD2 LITIGATION Phase 2 of the trial is scheduled for May 7 —11, 2001. The number of plaintiffs is down to 29, with 8 — 9 dismissed due to their failure to submit tax return information. A number of plaintiffs made public comments about the trial to the City Council. EXECUTIVE SESSION Granger made motion, Puleo seconded, to adjourn the regular meeting at 8:00 pm and go into executive session to discuss JD2 litigation. All aye. Motion Carried. RECESS Petryk made motion, Haas seconded, to recess tonight's meeting at 9:59 pm, until February 15, 2001, at 6:30 pm, Hugo Fire Hall, for the Everton Avenue Neighborhood Study. All aye. Motion Carried. (Mayor Miron had returned to dais). Michael A. Ericson City Administrator
