PRESENT: Barnes, Haas, Leroux, Petryk, Stoltzman City Administrator, Michael Ericson Community Development Director, John Rask City Engineer Representative, Tom Tabler City Attorney, Dave Snyder City Clerk, Mary Ann Creager CITY COUNCIL MINUTES FROM OCTOBER 30.2000 Leroux made motion, Petryk seconded, to approve the minutes for the Council meeting of October 30, 2000, including an additional comment made by Councilman Haas. All aye. Motion Carried. CITY COUNCIL MINUTES FROM NOVEMBER 6.2000 Barnes made motion, Petryk seconded, to approve the minutes for the Council meeting of November 6, 2000, with correction to stop sign removal request. All aye. Motion Carried. MINUTES FOR THE BOARD OF CANVASS HELD ON NOVEMBER 8. 2000 Stoltzman made motion, Petryk seconded, to approve the minutes for Board of Canvass held on November 8, 2000, as presented. All aye. Motion Carried. City Council meeting of November 20, 2000 Page 2 APPROVAL OF CLAIMS Adoption of the Consent Agenda approved the claims for November 20, 2000 as presented. CREEKVIEW PRESERVE SETBACK DETERMINATION In review of a recent building permit application, staff found a discrepancy between the zoning regulations and the approved preliminary and final plat. The building permit in question identified a 50' setback from JD3. In review of the City's shoreland regulations, staff found that JD3 is also classified as a tributary stream, which requires a 100' setback. In discussing this matter with the developer's engineer, he indicated that the Council approved a 50' setback from the stream/ditch. Since the City approved the preliminary and final plat with a 50' setback from the ditch, City staff recommended the City continue issuing building permits, provided the homes are setback at least 50' from the centerline of the ditch. Adoption of the Consent Agenda authorized the building official to issue building permits, provided the homes are setback at least 50' from the centerline of the ditch. RICO'S PARKING At the request of a resident, Council member Deb Barnes had placed this issue on a previous Council agenda for discussion. Staff was directed to research and review the issue, and provide a determination as to what could be done to increase the safety for patrons who park in the Ricci's parking lot, immediately adjacent to Oneka Lake Blvd. (COUNCIL MEMBER PETRYK LEFT THE MEETING AT 7.25 PM). Barnes made motion, Stoltzman seconded, to accept the recommendation of the Community Development Director, John Rask, that signs should be installed on the property that caution customers when backing out of the stalls onto 147x' Street. Staff is also directed to research traffic accidents at this location and report back to the Council All aye. Motion Carried. APPEAL DANGEROUS DOG DETERMINATION BY CITY On July 25, 2000, Mayme Vail, 92 years old, was walking on the sidewalk in front 5546 14P Street, when a dog, "Harley", bit Mrs. Vail on the leg. After a report was filed with the Washington County Sheriffs Department, the City Attorney followed up with a letter to a Gerald Kenneth Eide, and notified him that the dog, "Harley", was declared to be a "potentially dangerous dog" within the definition in Hugo City Code. The dog's owner, Heather Anderson, who submitted a letter appealing the decision of the City Attorney, contacted City staff. Staff reviewed Hugo City Code, Chapter 30, regulating dogs, and believes that the dog clearly qualifies under two of the three sections in the City's definition for potentially dangerous dog. To date, the dog has not been licensed, as required by City ordinance; however, Ms. Anderson would like to appeal the determination of a "potentially dangerous dog" to the Council to allow her to keep the dog in the City. Ms. Anderson did not attend tonight's meeting to defend her case. Leroux made motion, Barnes seconded, to accept the recommendation of the City Attorney, and City Council meeting of November 20, 2000 Page 3 designate "Harley" as a potentially dangerous dog within the definition of Chapter 30 in the Hugo City Code. All aye. Motion Carried. REQUEST FOR ADDITIONAL SPEED LIMIT SIGNS ON ONEKA LAKE BLVD. Jim Compton, 5878 Oneka Lake Boulevard, contacted City staff regarding additional speed limit signs he felt were necessary on Oneka Lake Blvd. The City Engineer, Dave Mitchell, and Public Works Director, Chris Petree, reviewed the request, and recommended that no additional 30 mph signs be installed between Sweet Grass Meadows and TH61, on either side of the road. Captain Don McGlothlin addressed the Council outlining different measures that are used to control traffic speed. Barnes made motion, Leroux seconded, to accept the recommendation of the City Engineer that no additional speed limit signs were necessary on Oneka Lake Blvd., and an attempt be made to determine the speed limit in that area. All aye. Motion Carried. ZIP CODE BOUNDARY REVIEW PROCESS For many years, City staff has had difficulty with mail delivery to Hugo residents and businesses located in the southwest portion of the City, currently served by the White Bear Lake Post Office. There have been dozens of circumstances in which the delivery of mail to residents has been delayed because the City of Hugo is served by, according the central Minneapolis Post Office, a rural route delivery system, as compared to the WBL Post Office, which delivers on a City route system. Staff met with the Hugo Postmaster and the manager for address management systems for the USPS in Minneapolis. The USPS, as a general policy, assigns ZIP codes on closely linked factors such as mail volume, delivery area size, geographic location, and topography, but not necessarily to municipal or perceived community boundaries. However, delivery growth and changing demographics can necessitate adjustments to ZIP code boundaries in order to achieve postal service objectives. A simple majority of survey respondents is adequate for approval, according to Hal Otto, manager for the address management systems for the USPS in Minneapolis. Mayor Stoltzman suggested that a City Letter accompany the survey outlining reasons why changing Post Office would be advantageous for residents. Barnes made motion, Leroux seconded, that a letter be sent to the USPS in Minneapolis requesting a customer support survey for the residents and businesses in the 55110 area to determine whether they would support central mail delivery service from the Hugo Post Office. If possible, a City letter would be included with the survey explaining benefits of the change to Hugo citizens. All a ye. Motion Carried. VICTORGARDENS CONCEPT PLAN Pratt-Arnt-Oakwood, LLC., requested approval of a PUD (Planned Unit Development) concept plan City Council meeting of November 20, 2000 Page 4 that includes 670 housing units, and 185,000 sq R of commercial/institutional buildings on 220 -acre site. The requested PUD would replace the former Wenzel Farms PUD approved for this site. At its November 8, 2000 meeting, the Planning Commission approved the PUD concept plan, and recommended its approval to the Council. City staff recommended approval of the PUD concept plan only, subject to conditions outlined in the proposed resolution. If the Council approved the concept plan, the applicant would submit a preliminary plat application. Site plan review would be required for the townhomes, commercial and institutional buildings, and the apartment buildings. Community Development Director, John Rask, presented a detailed explanation of the application. Planning Commissioner, Pat Rooney, presented the "minority" view of the Commission's opinion for approval. Mayor Stoltzman expressed concern with traffic in the development, with a continued discussion of road widths. Haas made motion, Barnes seconded, to adopt RESOLUTION 2000-47, A RESOLUTION APPROVING PUD CONCEPT PLAN FOR PRATT ARNT-OAKWOOD, LLC, FOR VICTOR GARDENS ON PROPERTY LOCATED NORTH AND SOUTH OF CSAH 8 AND EAST OF EXISTING ELMCREST AVENUE NORTH. VOTING AYE: Barnes, Haas, Leroux VOTING NAY: Stoltzman Motion Carried. CITY HALT. SITE SELECTION Haas made motion, Leroux seconded, directing staff to expand the City's site plan options and inquire about the acquisition of the Marier property on Fitzgerald Avenue as a potential site for the new City Hall. All aye. Motion Carried. COUNCIL -ELECT ORIENTATION The City Administrator will be meeting with the Mayor -elect and Councils -elect, and will inform the Council the dates when the orientation can take place. STAFF EVALUATION FORMS The Council will be provided forms for evaluation of the job performance of the following: City Administrator, Mike Ericson; City Attorney, Dave Snyder, City Engineer, Dave Mitchell; and Water Resource Engineer, Pete Willenbring. CHRISTMAS PARTY Councilman Haas will organize the Council/staff Christmas Party. City Council meeting of November 20, 2000 Page 5 RENEW MOBILE HOME PERMIT (SCHUMANN) Barnes made motion, Leroux seconded, to extend the mobile home permit for Dave Schumann for a six-month period subject to the following: 1. Property owner shall install septic system as issued by Washington County on October 5, 2000, Permit #070020022. 2. The septic system shall be installed prior to occupancy of the mobile home. 3. The mobile home shall be removed by June 30, 2001. All aye. Motion Carried. RESOLUTION APPROVING GRANT APPLICATION TO MET COUNCIL Stoltzman made motion, Leroux seconded, to adopt RESOLUTION 2000-48, A RESOLUTION APPROVING AN APPLICATION FOR A LOCAL PLANNING ASSISTANCE GRANT AND DIRECTING ITS SUBMISSION TO THE METROPOLITAN COUNCIL.
