Mr. Paul Haik, representing the City in litigation over JD2, informed the Council that he
had met with legal representatives from the RCWD and the DNR to set up a mediation
process to potentially resolve the issues in this case. He informed the Council that the
RCWD had not yet provided a list of issue they wish to discuss during mediation; they are
unwilling to commit any funds to pay for mediation. Representatives from the principal
parties involved in litigation will be meeting again in the near future to review possible
candidates to serve as mediator in this dispute.
Due to the late hour, Mr. Haik recommended that the Council meet with him in the near
future for approximately an hour to discuss the implications of pending legislation on the
lawsuit.
Leroux made motion, Haas seconded, to adjourn the closed session and return to open
session at 11:17 pm.
