The meeting of July 21, 1999 was reconvened by Mayor Stoltzman at 7:00 pm.

COMPREHENSIVE LAND USE REGULATIONS
The Council received by separate correspondence a revised draft to the City's comprehensive land -use
regulations, as well as an ordinance to implement the regulations. Ed Waller approached the Council
regarding regulations in the long-term agriculture district, hoping to retain privileges allowed in the old
zoning ordinance, and not add further limitations. After fiuther discussion of the proposed regulations:
Barnes made motion to adopt ORDINANCE 1999-333 AN ORDINANCE ADOPTING REVISED
LAND USE REGULATIONS.
Motion failed for lack of second.
Council member Petryk requested to amend the zoning map to remove Oakshore Park and Lake Air
Estates from the urban district to rural residential. The Council considered this "spot" zoning.
Barnes made motion, Haas seconded, to adopt ORDINANCE 1999-333, AN ORDINANCE
REPEALING THE EXISTING CHAPTER 82 (DRIVEWAYS), 98 (FENCES), 219 (PARKING AND
LOADING AREAS, 240 (PLANNING), 266 (SIGNS), 290 (SUBDIVISION), AND 320 (ZONING,
SHORELAND MANAGEMENT, AND FLOODPLAINS) IN THEIR ENTIRETY AND ADOPTING
A REVISED CHAPTER 320 (COMPREHENSIVE LAND USE REGULATIONS).
VOTING AYE: Barnes, Haas, Leroux, Stoltzman
VOTING NAY: Petryk
Motion Carried.
GREENE AVENUE IMPROVEMENTS
The Council considered a letter prepared by the City Engineer providing options for the improvement
of Greene Avenue. Discussion continued on location of the proposed road, should be a urban or rural
section, and whether to continue with the Chapter 429 process.

Leroux made motion, Stoltzman seconded, that the City proceed with Chapter 429 requirements for
making improvements to Greene Avenue.
VOTING AYE: Leroux, Stoltzman
VOTING NAY: Barnes, Haas, Petryk
Motion Failed.
Because residents along Greene Avenue were unsure of particulars relative to this project:
Haas made motion, Petryk seconded, to table this matter to allow the City Engineer to meet with
Greene Avenue*residents to explain the proposed project.
All aye. Motion Carried.
RAILROAD CROSSING EASEMENT
The Burlington Northern/Santa Fe Railroad requested that the City obtain formal easements for the
130th Street and 140th Street crossings of their tracks. They have requested that the City pay $10,000
for these easements that staff feels is excessive. Staff recommended a counter offer of between $3,000
and $4,000 for the easements.
Stoltzman made motion, Haas seconded, directing the City Engineer negotiate a lower cost with the
Burlington Northern/Santa Fe Railroad to obtain formal easements for the 130th Street and 140th
Street crossings of their tracks.
All aye. Motion Carried.
WATER SYSTEM REPORT
The Council received a report from the City Engineer on needed improvements to the City's water
system. Because of the time needed to discuss this matter, the Council opted for a workshop on June
30, 1999, at 7:00 pm.
RECOMMENDATION FOR FULL-TII" MAINTENANCE SUPERVISOR
Stoltzman made motion, Petryk seconded, to accept the recommendation of the Interview Committee
and offer the full-time maintenance supervisor position to Christopher Petree at a pay of $17.25/hr.
All aye. Motion Carried.
RECOMMENDATION FOR PART-TIME MAINTENANCE EMPLOYEES
Leroux made motion, Stoltzman seconded, to accept the recommendation of the City Administrator
and hire Sandra Mahoney and Valerie Maddock as part-time maintenance employees at $9.00/hr.

LETTERS FROM CITY ENGINEER
The City received letters from the City Engineer regarding Oneka Lake View, Oneka Lake View East,
and Creekview Preserve, Phase 2, recommending that Building Permits and Certificates of Occupancy
be issues as public improvements have been inspected and found to be substantially complete.
Stoltzman made motion, Leroux seconded, to,accept the recommendation from the City Engineer to
allow issuance of building permits and certificates of occupancy for Oneka Lake View East.
All aye. Motion Carried.
Stoltzman made motion, Barnes seconded, to accept the recommendation from the City Engineer to
allow issuance of building permits and certificates of occupancy for Oneka Lake View.
All aye. Motion Carried.
Leroux made motion, Stoltzman seconded, to accept the recommendation from the City Engineer to
allow issuance of building permits and certificates of occupancy for Creekview Preserve, Phase 2.
All aye. Motion Carried.
Leroux made motion, Barnes seconded, to accept the recommendation of the City Engineer and reduce
the letter of credit for Sweet Grass Meadows to $111,000.
All aye. Motion Carried.
MEDICAL COVERAGE FOR CITY EMPLOYEES
Because of a change in the City's health coverage with the LMCIT, the City received a
recommendation from the City's Finance Director that the City accept the proposal from Blue
CrosslBlue Shield of Minnesota for their Aware Gold Limited Small Employer Plan.
Stoltzman made motion, Petryk seconded, to accept the recommendation from the City's Finance
Director and accept the proposal from Blue Cross/Blue Shield of Minnesota for their Aware Gold Plan,
and enter into a Joint Powers Agreement with the Southwest and West Central Service Cooperative.
All aye. Motion Carried.
BLACK PANTHER/COUGAR
Council member Barnes discussed the "panther" issue and the lack of communication within the
community. It was her feelings that the City should make some effort to have the animal apprehended
prior to a possible tragedy. She stated she will be in contact with the DNR regarding this matter.

BCWD LETTER
Leroux made motion, Stoltzman seconded, to approve submittal of a letter to the Brown's Creek
Watershed District objecting to a proposed project to relieve flooding in the Plaisted/Goggins Lake
basin, as the project would not fully resolve the flooding experienced by City residents in this area.
All aye. Motion Carried.
Stoltzman made motion, Leroux seconded, to recess tonight's meeting at 11:00 pm until June 30, 1999,
at 7:00 pm.
