PRESENT: Haas, Petryk, Stoltzman City Administrator, Robert Museus City Attorney, Greg Galler City Engineer, Tom Angus City Clerk, Mary Ann Creager ABSENT: Debra Barnes and Tim Leroux ADDITIONS TO AGENDA Greene Avenue/Sweet Grass Meadows 2nd Addition Budget Workshops Letter from Father Friberg (Panther) ARK (Status) CONSENT AGENDA Stoltzman made motion, Petryk seconded, to adopt the following Consent Agenda: City Council minutes for August 2, 1999 Claims for August 16, 1999 South Water Tower Cleaning 1999 Crack Sealing All aye. Motion Carried. COUNCIL MINUTES (8/9/99) Stoltzman made motion, Haas seconded, to approve the minutes for the City Council meeting of August 9, 1999, as amended. All aye. Motion Carried. SOUTH WATER TOWER CLEANING The Council considered the recommendation of Public Works Supervisor, Chris Petree, to have Kangas Tank and Maintenance clean the south water cost at a cost of $4,000. Adoption of the Consent Agenda accepted the recommendation of Chris Petree as presented. 1999 CRACK SEALING The Council considered the recommendation of Public Works Supervisor, Chris Petree, to contract with City Council meeting of August 16, 1999 Page 2 Bergman Companies for the City's 1999 crack sealing project at a cost of $5,940. Adoption of the Consent Agenda accepted the recommendation of Chris Petree as presented. FINDINGS OF FACT (EAGLE VIEW MEADOWS) The Council considered revised Findings of Fact for preliminary plat approval of Eagle View Meadows. The Council discussed "screening" the project from the Harley Johnson property, the requirement of a landscape plan (Item 13k), clarification of percentage of open space, and definition of "walkways". Stotlzman made motion, Haas seconded, to approve the Findings and Recommendations for the Eagle View Meadows subdivision as amended. VOTING AYE: Haas and Stoltzman VOTING NAY: Petryk Motion Carried. STORMWATER UTILITY ORDINANCE (PUBLIC HEARING) A public hearing was held to consider the adoption of a proposed ordinance creating a stormwater utility fee system. Tom Jackson questioned how the proposed ordinance would affect his industrially -zoned property. Frank Puleo questioned the need for another government "fee". There were no further oral or written comments. The Council questioned what areas of the City would be included in the fee area, and what collected fees would pay for. Because two Council members were absent: Stoltzman made motion, Haas seconded, to table further discussion until the regular Council meeting of September 7, 1999. All aye. Motion Carried. HARDWOOD CREEK TRAIL PAREING (JIM LUGER) Mr. Jim Luger, Washington County Park Planner, was present to discuss the establishment of parking to serve the Hardwood Creek Trail being constructed along the west side of TH61. Mr. Luger had attended the Parks Commission meeting of August 11, 1999, and considered their recommendations. Mr. Luger stated that the southern parking area would be closed for access/egress to CR8. The Park Commission urged the shoulder between the northern parking area and the trail be blacktopped this year. Mr. Luger stated he would inform the Washington County Board of Hugo's concerns. Haas made motion, Stoltzman seconded, to that City enter into a Joint Powers Agreement with Washington County for Hardwood Creek Trail parking area located within the City. All aye. Motion Carried. City Council meeting of August 16, 1999 Page 3 TOWNHOMES OF BALD EAGLE At the request of the developer, the City Council tabled action of the proposed preliminary plat for Townhomes of Bald Eagle until this evening's meeting. Council member Petryk stated objection to the development having private roads, thereby bypassing the City's front yard setback requirements. She was also concerned with the fact that no landscape plan or traffic analysis had been submitted. Mike Black, representing Royal Oaks Development, stated that they would be willing to pay a "fair share" for installation of signals at a determined intersection and whatever storm water fees were determined. Petryk made motion to table discussion of this matter until the following matters were addressed: 1) traffic analysis provided; 2) landscape plan provided; and 3) submitted of a phasing program. Motion failed for lack of second. Haas made motion, Stoltzman seconded, to approve the Findings and Recommendations as recommended by the Planning Commission on July 28, 1999, with the following changes to RECOMMENDATIONS: 1. Add Item 11: The City shall require a 30' front yard setback along Europa Trail. 2. Add Item 12: A detailed traffic analysis be provided to determine the appropriate cost sharing for transportation infrastructure. Haas made motion, Stotlzman seconded, to amend the previous motion to include: Item 8 shall read: The loop roads identified abutting Europa Trail and 132nd Street, and the cul-de- sac from Europa Trail, shall be public streets. VOTE ON AMENDMENT: All aye. Motion Carried. VOTE ON ORIGINAL MOTION: All aye. Motion Carried. WENZEL FARMS PUD PERMIT FINDINGS OF FACT (WENZEL FARMS PHASE 1) Stoltzman made motion, Petryk seconded, to table these matters until the Council meeting of 9/7/99. All aye. Motion Carried. GREENE AVENUE P"ROVEMENTS Develop Rocky Goertz presented the Council a revised estimate for improvements road that was $24,000 higher than his previous estimate. The Administrator stated that the Council had only three options to resolve this issue: 1) Proceed with road construction at $60,000 with the City picking up $40,000 of the cost; 2) proceed with the assessment process (Chapter 429); or 3) instruct the developer to install an urban on the west side and a rural section on the east side of Greene Avenue. City Council meeting of August 16, 1999 Page 4 Stoltzman made motion, Petryk seconded, that Greene Avenue be improved by urban section on the west and rural section on the east. All aye. Motion Carried. SWEET GRASS MEADOWS 2ND ADDITION Stoltzman made motion, Haas seconded, to approve the Development Agreement between KG Development and the City of Hugo for Sweet Grass Meadow 2nd Addition. All aye. Motion Carried. Stotlzman made motion, Petryk seconded, to approve the final plat for SWEET GRASS MEADOWS 2ND ADDITION. All aye. Motion Carried.
