HomeMy WebLinkAbout1998.01.20 CC MinutesMINUTES FOR THE HUGO CITY COUNCIL MEETING OF JANUARY 20,1998 The meeting was called to order by Mayor Fran Miron at 7: IOPM. PRESENT: Arcand, Barnes, Goiffon, Leroux, Miron City Administrator, Robert Museus City Attorney Representative, Dave Snyder City Engineer, Tom Angus City Clerk, Mary Ann Creager Leroux made motion, Barnes seconded, to approve the following Consent Agenda: Minutes for the City Council meeting of January 5, 1998 General Claims for January 20, 1998 Firefighter Dismissal All aye. Motion Carried. FIREFIGHTER DISMISSAL Chief Wisner reported that firefighter, Ralph Schoeller, had not participated in the training drills or the emergency calls the Fire Department requires for membership in the Department. Chief Wisner recommended that Mr. Schoeller be dismissed from the Department. Adoption of the Consent Agenda terminated Mr. Schoeller's employment and membership with the Hugo Volunteer Fire Department, effective January 20, 1998. DRAINAGE ISSUE (16355 ELMCREST AVENUE) Joe Canine, 16355 Elmcrest Avenue, appeared before the Council to discuss drainage problems on his property. Mr. Canine has been experiencing water in his basement, which he alleges due to the first floor elevation of the home being constructed too low. He thought the City had some responsibility in helping correct the situation since they approved the building permit for the property. The City Administrator stated that first floor elevations in the community are set by regulation to be two foot above the 100 -year flood elevation or four foot above the ordinary high ground water elevation, whichever is higher. The builder, upon applying for a building permit, certifies to the City the elevation meeting the standard, and then the elevation of the first floor as constructed. Councilman Leroux stated that he felt the City had a responsibility to check first floor elevations in more detail to avoid problems such as Mr. Canine is experiencing. There was substantial discussion among the Council on the issue. Mr. Canine then verbally petitioned the City to clean the drainage ditch adjacent to his property as a means of helping to alleviate his problem. Miron made motion, Leroux seconded, directing City staff to prepare a cost estimate of cleaning the ditch adjacent to the Canine property. If it can be determined, the individual/s causing the obstruction should be responsible for cleaning expenses. All aye. Motion Carried. City Council meeting of January 20, 1998 Page 2 Miron made motion, Leroux seconded, directing City staff to begin process of justifying raising the City's minimum standard for first floor elevation and report to the Council. WASHINGTON COUNTY SHERIFF'S CONTRACT The Council's received a letter from the Washington County Sheriffs Department regarding the use of Hugo's contract deputies to respond to calls in Forest Lake Township. In addition, the City Administrator prepared a report regarding the Council's options to provide police services for the community. Leroux made motion, Arcand seconded, to table discussion of this matter until the budget meeting of January 21, 1998. All aye. Motion Carried. FENWAY BOULEVARD REPORT The Council considered the City Engineer's initial report for the feasibility of constructing Fenway Boulevard, from 130th Street to 140th Street, and Fenway Avenue, from 140th Street to 142nd Street. Barnes made motion, Goiffon seconded, to adopt RESOLUTION 1998-1, A RESOLUTION RECEIVING A REPORT AND CALLING FOR A HEARING ON IMPROVEMENTS OF FENWAY BOULEVARD AND CONSIDER MAKING OF ASSESSMENTS FOR SAID IMPROVEMENTS. VOTING AYE: Arcand, Barnes, Goiffon, Leroux, Miron Motion Carried. Barnes made motion, Goiffon seconded, directing that appraisals be done on the properties benefiting from the project to determine the potential for making assessments. All aye. Motion Carried. SEWAGE TREATMENT ORDINANCE The Council considered an ordinance adopting the recently -revised County Individual Sewage Treatment Ordinance. The City had previously adopted a prior County ordinance on the same subject. The new ordinance adjusts administrative procedures between townships and the County, which do not impact the City, and updates the sewage City Council meeting of January 20, 1998 Page 3 treatment standards to current state requirements. The ordinance adopting the County's Individual Sewage Treatment standards, also implements triennial inspections of septic systems, as required by Met Council. In may be that Washington County will assume this responsibility on behalf of townships and cities. This matter will be clarified by the time of hearing for adoption of the ordinance on March 2, 1998. Leroux made motion, Miron seconded, to schedule a public hearing for March 2, 1998, at 7:05PK to consider adoption of an ordinance adopting the recently -revised County Individual Sewage Treatment Ordinance. All aye. Motion Carried. LOCK-OUT/TAG-OUT POLICY The Council considered an amendments to the City's Workplace Safety Policy regarding lock-out/tag-out procedures. This amendment is required by OSHA, and staff recommended Council approval. Miron made motion, Goiffon seconded, to approve the amendments to the City's Workplace Safety Policy regarding lock -out -tag -out procedures, as submitted. All aye. Motion Carried. DEPUTY CLERK POSITION The City's deputy clerk resigned her position with the City, effective January 16, 1998. Staff sought Council approval to publish the enclosed advertisement for the position vacancy with no change to the recently -revised job description. Leroux made motion, Goiffon seconded, authorizing staff to advertise for the Deputy Clerk position. All aye. Motion Carried. COMMUTER RAIL REPORT The Council was updated by the City Administrator on discussion at the state and regional level regarding the operation of commuter -rail service in the metropolitan area, including a line between Forest Lake and St. Paul, running through the City of Hugo. The City Administrator's report on the current status of commuter -rail in the area, as well as his recommendation for reacting to the state and regional initiatives was *provided to the Council.
