MIIYUTES FOR THE HUGO CITY COUNCEL MEETING OF SEPTEMBER 22, 1998
The meeting was called to order by Mayor Fran Moon at 7:35 p.m.

After introductory remarks and a welcome by Mayor Fran Miron, Eric Thompson, RCWD
engineer, presented the findings and conclusions of a report prepare by his firm for the as built
profile of Judicial Ditch #2 (Hardwood Creek). Based on the 1908 plans for the project, boring
samples, surveys, and analysis of file lines there is between three and four feet of siltation along the
length of the channel through Hugo and Forest Lake Township. Kate Drewry explained possible
funding sources for cleaning of the ditch, including assessments to benefited property owners and
use of the Watershed District's general tax levy.
Discussion was then held among those present regarding the potential benefit of the ditch cleaning,
the impact of the culverts located at the Harrow Avenue and CR4 are having on the ditch, whether
the siltation was an obstruction or maintenance issue, and the impact of ditch cleaning on adjacent
wetlands.
The Mayor concluded the discussion by stating that the City of Hugo would be preparing a petition
for presentation to the RCWD requesting the District declare the culverts located at 170th Street
and Harrow Avenue as obstructions to the stream -channel, and stated that the petition will be
provided to the Forest Lake Town Board and Washington County Commissioners with a request
that they would participate in the petition along with the City.
General discussion was held regarding joint issues between Forest Lake Township, Washington
County, and Hugo for potential upgrade of TH61 corridor, the proposed Hardwood Creek bike
trail, commuter trail, and complaints Hugo has received regarding the condition of Ingersoll
Avenue.
Don Wisniewski presented the City a draft Road Crossing Easement Agreement prepared by Mr.
Paul Fahning, representing Dennis Backes, the developer for Creekview Preserve subdivision. It
was generally agreed that changes will be made to the document regarding the future removal of the
City Council meeting of September 22, 1998

road access to the site, the City sharing in future cost for signaling of the intersection of 159th
Street and TH61, and the requirement that deed covenants be placed on the properties within the
subdivision notifying lot owners of the potential removal of the road access in the firture. The City
attorney, the County attorney, and the attorney for the developer are to work out the proposed
language for presentation to the City Council at their meeting of October 5, 1998, following City
approval of the draft agreement is provided to the County Commissioners, as the County Rail
Authority for their approval.
