The meeting was called to order by Mayor Fran Miron at 7:15PM.

Mum made motion, Goiffon seconded, to approve the following Consent Agenda:
City Council minutes for January 6, 1997
General claims for January 21, 1997 in the amount of $331,357.45

PUBLIC HEARING (128TH STREET VACATION)
A public hearing was held to consider the request of Wilson Tool International to vacate
an 80 ft easement known as 128th Street from the west side of T.H. 61 to the east line of
Falcon Avenue. The street has not been constructed. on the easement, and a large portion
of the easement crosses wetlands. If constructed, it would not be a through road, and
Wilson Tool desires the return of the easement in order to facilitate their business
expansion plan. Comments from the DNR were provided to the Council. NSP maintains
electrical lines in a portion of the easement to serve Wilson Tool. Tom Emery, Vice
President of Human Resources, addressed the Council regarding the request stating that
NSP will make whatever changes are necessary to facilitate their proposed 42,000 sq ft
expansion to the south of their present facility. Joyce Domer, resident living behind
Wilson Tool's second parking lot, stated that there is a water problems on her property, and
assumes the proper permits will be obtained for the proposed expansion.
Miron made motion, Barnes seconded, to adopt RESOLUTION 1997-4, A
RESOLUTION VACATING A ROADWAY EASEMENT AS PER PETITION OF
WILSON TOOL INTERNATIONAL.
VOTING AYE: Barnes, Goiffon, Johnson, Leroux, Miron
Motion Carried.
HEARING (ANTENNA ORDINANCE)
The public hearing to consider an ordinance establishing, regulations for the construction of
antennas within the community was continued. The draft ordinance has gone through a
City Council meeting of January 21, 1997

number of revisions. The current ordinance establishes preferred land -use area for
antennas, sets maximum heights permitted, and allows for those antennas specifically
permitted by State or Federal law, such as home TV antennas, dishes, and amateur radio
antennas. Richard Donlon and Trevor Bladm addressed the Council stating their hopes
that the draft ordinance would be adopted.
Leroux made motion. Goiffon seconded, to adopt ORDINANCE 1997-315, AN
ORDINANCE ESTABLISHING CHAPTER 35 OF THE HUGO CITY CODE BY
ESTABLISHING ANTENNA REGULATIONS WTTIHN THE CITY OF HUGO.
VOTING AYE: Barnes, Goiffon, Johnson, Leroux, Miron
Motion Carried.
Barnes made motion. Goiffon seconded, authorizing publication of a summary of the
adopted antennaordinance.
All aye. Motion Carried
1997 LAW ENFORCEMENT CONTRACT
The Council considered the proposed 1997 Contract for Law Enforcement Services
between Hugo and the Washington County Sheriffs Office. Language in the Contract
remains the same as in previous years, including Washington County purchasing and
providing the squad car for the City. Estimated budget impact of the Contract is an
indrease of 7% for law enforcement services in the coming year. Councilman Leroux
expressed concern with the increases associated with the Contract for the past few years.
Barnes made motion, Goiffon seconded, to approve the 1997 Law Enforcerneat Contract
between the City of Hugo and the Washington County Sheriffs Office, and authorizes the
Mayor to sign the Contract on behalf of the City.
VOTING AYE: Barnes, Goiffon, Johnson, Miron
VOTING NAY: James Leroux
Motion Carried.
Miron made motion. Leroux seconded, directing the City Administrator to send an
accompanying letter when returning the signed Contract, expressing the City's concern
with the large percentage increases in Contract costs for the past few years.
All aye. Motion Carried.
BRIDGE REPORT
The City Engineer, in accordance with State Law, conducted an inspection of the bridges
located within the City of Hugo, which are the City's responsibility to maintain. His
report was provided to the Council, and he recommended repairs on two bridges:

1. Along on 129th Street along the north end of Bald Eagle Lake.
2. On Forest Road crossing Hardwood Creek.
Barnes made motion, Goiffnn seconded, authorizing repair of the guardrail and riprap
along the .bridge on 129th Street at the north end of Bald Eagle Lake. Repairs will be done
in the Spring to keep costs down.
All aye. Motion Carried.
Miran made motion, Leroux seconded, that the bridge on Forest Road crossing Hardwood
Creek be ` watched7 for any changes, and traffic control signs will be installed, if needed.
All aye. Motion Carried
ROFESSIONAL SERVICES EVALUATI
The Council received forms for evaluating the contract services provided by Tom Angus,
Pete Willenbriag, Ed Elliott, and Greg Galler. Staff requested that the Council complete
and return these forms to the City Administrator by February 3, 1997.
MISCELLANEOUS
Mayor Miron noted that he had received a call fiom Lenny Munch, owner of RJ's,
regarding the quality of his water. Mr. Munch stated that he had not paid his utility bill,
and requested that the penalty be waived because of the poor water. Mayor Miron asked
that he put his request in writing, which was not done. Ordinance states that a license can
be revoked because of nonpayment of City charges.
Barnes made nation, Miron seconded, directing the City Attorney to start hearing
procedures for possible revocation of RJ's liquor license for nonpayment of the City's
utility bill. Proposed date of said hearing is February 18, 1997.
All aye. Motion Carried
FINDINGS OF FACT (RICCP'S)
Because the City Attorney noted an addition was needed to the previously -approved
Findings of Fact regarding the liquor license violation at Ricci's Saloon, the following
motion was made:
Miron made motion, Goiffon seconded, to vacate the previously -approved Findings of Fact
for Ricci's Saloon, and approve the amended document.
All aye. Motion Carried.
COMPREHENSIVE STORMWATER MANAGEMENT PLAN
Pete Willenbring of WSB presented the Council with the newly -revised Plan., stating that
the Plan is 95% finalized.

Miron made motion, Goiffon seconded, directing Pete Willenbring to notify all required
agencies that the City of Hugo is planning to adopt its Comprehensive Stormwater
Management Pian on March 17, 1997.

FIRE HALL COMM UME
Dave Schumann, Committee member, updated the Council on their latest meeting.
LITIGATION UPDATE
City Attorney Galler updated the Council on the following matters: Roger Dupaul,
William Lowell, James Brevig, and RCA.
Barnes made motion, Miron seconded, directing the City mor to send a letter to
River City Asphalt putting these on notice that their Mining Permit will not be approved if
all requested information is not submitted to the City.
All aye. Motion Carried.
CABLE EOUIPMENT
Miron made motion, Leroux seconded, directing City staff to establish a log of when the
cable equipment is not functioning properly.
All aye. Motion Carried.
Leroux made motion, Goiffon seconded, to adjourn at 8:50PM.
