PRESENT: Barnes, Goiffon, Johnson, Leroux Mayor Fran Miron arrived at 7:40PM. City Administrator, Robert Museus City Attorney, Greg Galler City Engineer, Tom Angus City Planner, Ed Elliott Deputy Clerk, Carole LaBelle Administrator requested the White Oak Heights Development Agreement be removed from the consent agenda. Motion made by Goiffon, seconded by Barnes to approve the following consent agenda: City Council minutes for March 17, 1997 General claims for April 7, 1997 Charitable Gambling License (St. John's Church) Certification of Local Performance Measures All aye. Motion carried. Development Agreement - White Oak Heights In January the City Council approved a plat for the development known as White Oak Heights, subdividing a 39 acre parcel into six, single family, residential lots, and three outlots under the clustering concept. The applicants have requested three building permits to begin construction on three residences. They have also requested to change the proposed name from Hadley to Hannah. Administrator Museus stated that it would not be advisable to change the street name to Hannah considering the City already has a Henna Avenue. The three building permits could be issued; however, no certificate of occupancy could be issued until improvements are constructed. Motion made by Leroux, seconded by Goiffon to recommend approval of the White Oak Heights Development Agreement as amended. All aye. Motion carried. Site Plan Approval - Lauren McCullough Well Drilling Lauren McCullough Well Drilling, 15597 Forest Blvd., has requested site plan approval to construct a 36' X 12' addition to the front of their existing building at the above address. City Council meeting of April 7, 1997 Page 2 Motion made by Barnes, seconded by Johnson to table this request until April 21, 1997 and the following questions have been answered: 1. Certification is received from competent authority that the first floor elevation of the proposed addition complies with current flood plain regulations. 2. A parking plan is received in accordance with Chapter 219. 3. A landscaping plan is provided in accordance with Chapter 320-5, Subd. K. 4. Final inspections are conducted as required for existing buildings on the site and certificates of occupancy are issued. 5. The project is reviewed and approved, if required, by the Rice Creek Watershed District. 6. Septic system plans are reviewed by Washington County HELM. All aye. Motion carried. Rezoning - LaCasse Mr. Gary LaCasse, 16953 Forest Blvd., has requested to rezone approximately three acres of property located in the southeast corner of 170th Street and Forest Blvd., from agriculture to industrial. It is Mr. LaCasse's intent to use the property as a residence while constructing a 42'X 80' garage on the site for his truck repair business. Administrator Museus stated that the request would constitute spot zoning and the comprehensive plan recommends that area become commercial. Mayor Miron arrived at 7:40PM. Motion made by Leroux, seconded by Barnes to recommend denial of the request of Gary LaCasse and directed the City Attorney to prepare Findings of Fact for the denial. AYE: Barnes, Goiffon, Leroux, Miron NAY: Johnson Motion carried. Forest Lake Times - Howard Lestrud Mr. Howard Lestrud of the Forest Lake Times stated it was strictly a business decision to charge for delivery service in Hugo and to discontinue delivery of the complimentary Peach to all residences in Hugo. Residents are charged different rates based on the carrier service hired by ECM Publishers. City Council meeting of April 7, 1997 Page 3 Motion made by Leroux, seconded by Miron to retain the Forest Lake Times as the City's official newspaper, but to also publish public notices in the White Bear Press as a courtesy to city residents. All aye. Motion carried. Fire Department Report The Fire Chief has requested a workshop meeting with the Council to discuss Fire Department issues including budget, equipment replacement, etc. He has indicated a preference for the last week in April, if possible. Motion made by Barnes, seconded by Leroux to schedule a workshop with the Hugo Volunteer Fire Department on April 29th, 7:30PK Hugo City Hall. All aye. Motion carried. 150th Street/Ineersoll Avenue Improvement Project Bids Motion made by Barnes, seconded by Miron to award the contract for construction of 150th Street/Ingersoll Avenue Improvement Project to RO-SO Contracting as recommended by the city engineer. All aye. Motion carried. Cash Surety Request (RCWD) The City of Hugo proposed to the RCWD that the City post an escrow to guarantee construction of the mitigation wetlands required for construction of 150th Street near the City's new Post Office. This would allow a delay in the construction of the new wetlands until plans are prepared for the regional ponds proposed along Clearwater Creek. The intent here is that the money that would be used to construct the mitigation wetlands for 150th Street would be used for the improvement of Clearwater Creek. Based on the City Engineer's cost estimate, the RCWD has requested an escrow of $23,000. The City would commit to constructing the required wetlands by November 1, 1998. Motion made by Leroux, seconded by Goiffon to approve Resolution 97-5. AYE: Barnes, Goiffon, Leroux, Miron NAY: Johnson Motion carried. City Council meeting of April 7, 1997 Page 4 Peloauin Industrial Park The City has received three proposals from qualified firms to conduct appraisals and potential assessments for the Peloquin Industrial Park Improvement Project. The cost and methodologies of the firms were widely different. After presentations from the three firms the following motion was made. Motion made by Miron, seconded by Barnes to direct Administrator Museus work with Lake State Realty Company to establish specific properties for appraisal and to refine the scope of the work. All aye. Motion carried. Seotic System Ordinance Revisions Motion made by Miron, seconded by Leroux to adopt the Washington County Tri - annual septic system inspection ordinance when completed. All aye. Motion carried. Litigation City Attorney Greg Galler updated the Council on the Homestead Avenue Pond, Oneka Estates Lien, River City Asphalt, and Riopel cases. Council recommended that inspection and well testing be performed at the River City Asphalt site. Carnelian Marine Watershed District Board Vacancy A board member of the Carnelian Marine Watershed District has resigned, effective March 17, 1997. The Washington County Board has requested nominations from cities and townships for replacements to serve the remainder of the term. Only a small portion of the City is within the Carnelian Marine Watershed District. Motion made by Leroux, seconded by Goiffon to make no recommendation for the Carnelian Marine Watershed District seat. All aye. Motion carried. City Council meeting of April 7, 1997 Page 5 Fence Viewer Request Mr. Joel Hursh has requested the City appoint a fence viewer to assist in resolving a line/fence dispute between Mr. Hursh and an abutting property owners. Mr. Hursh resides in Ward 2. In the past, the City has appointed the Councilman from the ward to serve as the fence viewer. Motion made by Leroux, seconded by Miron to appoint Jim Leroux as fence viewer for the Hursh/Riopel dispute. All aye. Motion carried. Mayor Miron stated that he and Councilman Leroux attended a recent Rice Creek Watershed meeting and requested that they be allowed to join the upcoming inspection tour through Hugo on April 12th.
