PRESENT: Barnes, Goiffon, Leroux, Miron City Administrator, Robert Museus City Attorney, Greg Galler City Engineer, Tom Angus City Clerk, Mary Ann Creager ADDITIONS TO AGENDA Presentation from Captain Don McGlothlin Fire Department Referendum CONSENT AGENDA Goiffon made motion, Leroux seconded, to approve the following Consent Agenda: Minutes of October 6, 1997 General Claims for October 20, 1997 Findings of Fact - Rudy Off -Sale Liquor License - Swanny's Liquor Cigarette License - Swanny's Liquor All aye. Motion Carried. FINDINGS OF FACT (RUDY) At the Council meeting of October 6, 1997, the City Council approved a variance for the rear yard setback at 7375 -165th Street owned by Burns and Teresa Rudy. The Findings of Fact was prepared by the City Attorney to define the City's action. Adoption of the Consent Agenda approved the Finding of Fact as presented. OFF -SALE LIQUOR LICENSE (SWANNY'S LIQUOR) Swanny of Hugo, Inc., 14583 Forest Blvd. N., has requested an Off -Sale Liquor License. This is the site of the old Nadeau's Market. Catherine and Michael Anderson intend to move the off -sale operation from their existing restaurant to the neighboring building. The Andersons have provided the city proof of liquor liability insurance in the amounts required by law and have paid the appropriate fees. Adoption of the Consent Agenda approved issuance of the liquor license to Swannys of Hugo, Inc., as of November 1, 1997. City Council meeting of October 20, 1997 Page 2 CIGARETTE LICENSE fSWANNY'S) Swanny of Hugo, Inc. 14559 Forest Blvd. N., requested a cigarette license as part of their Off -Sale Liquor License. Adoption of the Consent Agenda approved the issuance of the cigarette license. CAPTAIN DON MCGLOTHLIN Captain Don McGlothlin of the Washington County Sheriffs Department addressed the Council informing them of a new program, Community Policing Effort, whereby he will be the liaison between his office and the City of Hugo. Should the City have any concerns with any aspect of the Sheriffs Department, Captain McGlothlin would be the individual to contact. He also stated that he would be attending at least one Council meeting a month. LINDEN HOUSE BURN The Council reviewed a letter from the Hugo Fire Department requesting the use of the old Linden home for training activities, including ladder drills, rescue drills, holes drills, etc. This training will culminate with a burn of the house in April of 1998. Leroux made motion, Goiffon seconded, to approve the Fire Department's use of the Linden property and the burning of the house in April, 1998, subject to the City's Maintenance Supervisor insuring removal of all asbestos from the site and the disconnection of the power and gas services prior to the live burn taking place. AUTO DISMANTLING LICENSE (ARK) Mr. Daniel Stewart, Automotive Recycling Kompany, 16813 Forest Blvd. North has requested an automobile dismantling license for his business at the above address. In addition, ARK has moved a number of mobile homes onto the site for scrapping. The Special Use Permit issued for the site permits the recycling and junking of automobiles only. The City has been informed by the Washington Sheriffs Department that an individual is living in one of the trailers as "a night watchman". Watchman's quarters is not a permitted, principal, accessory or conditional use in the Agriculture district. Miron made motion, Barnes seconded, to deny the request of Automotive Recycling Kompany, 16813 Forest Boulevard for the following reasons: City Council meeting of October 20, 1997 Page 3 1. There is no certified refrigerant reclaim operator working the site as required by Chapter 130-8, Division C. 2. There are 25,000 to 30,000 waste tires located on the site posing fire and health hazards. This is in violation of Chapter 130-8, Subdivision G. 3. Fencing surrounding the site is in a state of disrepair, and the visual screening is inadequate to block the dismantling activities from view of adjacent property and the public right-of-way. This is in violation of Hugo City Code, Chapter 130-8, Subdivision I. 4. There are a number of 55 -gallon drums stored on the site containing, what is expected to be, hazardous materials. The contents of these drums are not identified on the containers. This is in violation of Chapter 130-8, Subdivision H. MINING PERMIT RENEWAL (INDYKIEWICZ) Mr. George Indykiewicz, DBA, Brighton Excavating Company, 1920 Highway 96, New Brighton, has requested renewal of his mining permit to remove sand and dirt from his property in Hugo described as the W1/2 of the N1/2 of Section 17, T31N, R21 W, except a 330' by 660' tract located north and west of the center Section 17, and including a triangular parcel located in the E1/2 of the N1/2 of Section 17 west of TH 61 and south of Section 8. All subject to the railroad right-of-way and all other easements and right-of- ways dedicated for public purposes. Leroux made motion, Goiffon seconded, to approve renewal of the mining permit for George Indykiewicz. for a one year period, under the terms and conditions of the existing permit. All aye. Motion Carried. NO PARKING REQUEST (147TH STREET EAST OF FOREST BLVD.) Dr. William E. Barrett, 5673 147th Street, has requested establishment of a NO PARKING zone along his property abutting 147th Street. This request was reviewed by the City Engineer, who recommended approval of the request. Leroux made motion, Barnes seconded, to approve the request of Dr. Barrett for installation of NO PARKING signs along his property abutting 147th Street. All aye. Motion Carried. CITY COUNCIL VACANCY One application had been received for the position of City Council member for Ward 1. That letter was authored by Warren Arcand. City Council meeting of October 20, 1997 Page 4 Leroux made motion, Goiffon seconded, to appoint Warren Arcand to fill the Ward 1 vacancy. All aye. Motion Carried. CHARITABLE GAMBLING The City of Hugo Fire Department has requested that the City consider implementing a program that would require a certain percentage of charitable gambling proceeds be paid to the City for use in establishing an equipment replacement fund. Leroux made motion, Barnes seconded, directing the City Attorney to draft an ordinance implementing recovering gambling profits for use in acquisition of fire equipment. All aye. Motion Carried. WORK PLACE SAFETY POLICY Leroux made motion, Goiffon seconded, to approve the Work Place Safety Policy. All aye. Motion Carried. FIRE HALL INFORMATION MEETING Leroux made motion, Goiffon seconded, to schedule an informational Council meeting for November 12, 1997, Hugo City Hall, at 7:30PK to further discuss the Fire Hall referendum. All aye. Motion Carried. MISCELLANEOUS The City Administrator stated that a City Newsletter will be prepared for mailing the first week in November. Either Senator Grams or his representative will be present at the Council meeting of November 3rd to present a "service award" to the Hugo Fire Department. Resident Floreen Meyer was present to request City assistance to relieve flooding problems in her hayfield. The City Administrator will contact Tony of the RCWD requesting that he make an inspection of the area. City Council meeting of October 20, 1997 Page 5 Mayor Miron briefed the Council on the workshop conducted on October 18, 1997 regarding south Oneka Lake issue identification. Because of time limitations, this meeting will be continued on October 29, 1997 at 7:30PK Rice Lake Park Bldg.
