PRESENT: Barnes, Leroux, Miron City Administrator, Robert Museus City Attorney, Greg Galler City Engineer, Tom Angus City Clerk, Mary Ann Creager ABSENT: Andrew Goiffon OATH OF OFFICE Warren. Arcand, appointed by the City Council to fill the unexpired Ward 1 Council term, took the Oath of Office. CONSENT AGENDA Leroux made motion, Barnes seconded, to approve the following Consent Agenda: City Council minutes for October 20, 1997 General Claims for November 3, 1997 Amended Special Use Permit (Vacinek) All aye. Motion Carried. SPECIAL USE PERMIT (VACINEK) Kevin Vacinek, dba Concrete Yard Ornaments, Inc., 5855 165th Street, has requested to amend his SUP in order to add a 20' x 50' addition on the south side of the existing building on the site. This matter was the subject of a public hearing before the Planning Commission on October 22, 1997, and the PC recommended approval of the request. Adoption of the Consent Agenda amends the SUP for 5855 165th Street by allowing a 20' x 50' addition onto the south side of the existing building on the site. FIRE SERVICE AWARD Linda Westrom of Senator Rod Grams' office presented the Hugo Volunteer Department the Congressional Fire Service Institute Award, and thanked them for their contributions to the City. SPECIAL USE PERMIT (MIRON) George and Patricia Miron, 8825 170th Street, have requested a SUP to operate a beauty shop out of their home at the above address. The property is located in the agricultural district. The Hugo PC considered this request at their meeting of October 22, 1997, and recommended approval of the request. City Council meeting of November 3, 1997 Page 2 Hugo City Code, Chapter 3204, Subd. C(3), allows beauty shops as a SUP in the ag district, but 320-3B (41) states, "...a home occupation shall not be interpreted to include barber shops, beauty shops, automotive repair, tourist homes, restaurants, or similar uses." For this reason, staff recommended denial of the SUP. Because the applicant is the Mayor's brother, Fran Miron removed himself from discussion of this matter. At present, there are at least two Special Use Permits that have been issued for beauty shops in residences within the City. The Council discussed the conflicting regulations, stating that they would be corrected at the time of adoption of the new zoning ordinance presently being considered by the Planning Commission. Leroux made motion, Barnes seconded, to approve the request of George and Patricia Miron, 8825 170th Street, to operate a beauty shop out of their home. Leroux made motion, Arcand seconded, to amend the previous motion to include that precedent has been set as two other SUP's have been issued by the City for beauty shops in residences, and subject to the following special conditions: 1. The business activity conducted in the home shall clearly be incidental to the use of the structure as a dwelling. 2. The business activity shall not be conducted in any accessory structure, including a garage, and there shall be no storage of equipment or supplies in any accessory structure or outside the dwelling. 3. No external alteration of any building, driveway, fence, or other structure shall be permitted to serve the business or occupation. 4. The existence of the home occupation shall not be apparent beyond the boundaries of the site, except a name plate not to exceed one square foot in size affixed directly to a building. 5. The business or occupation shall be carried on by members of the family residing in the dwelling plus no more than one non-resident of the dwelling. 6. No motor shall be used in the business that exceeds one horse power. 7. The business or occupation shall not create any radio or television interference or create noise audible beyond the boundaries of the site. 8. No smoke, odor, liquid or solid waste shall be emitted by the business or occupation. 9. Not more than one truck of not more than 3/4 ton capacity used in the business or occupation, shall be kept on the site. No semi -trailers shall be allowed. 10. A home occupation shall not create pedestrian, automobile, or truck traffic in excess of the normal amount experienced by other homes in the district. All aye. Motion Carried. City Council meeting of November 3, 1997 Page 3 BALD EAGLE INDUSTRIAL PARK (IN -PROGRESS REVIEW) The City of Hugo has not been able to enter into an agreement for the development of the Jackson property as part of the Bald Eagle Industrial Park expansion project, leaving the City with three options: 1) exercise the City's right of eminent domain and condemn the property, or that part of the property required for the planned extension of public streets and utilities; 2) construct Falcon/Fenway Avenues and relocate 134th Street to the north, avoiding the Jackson property; or 3) not constructing the project at all. Under Options 1 and 2, assessments to the Jackson property may be warranted. Barnes made motion, Leroux seconded, to schedule a special Council meeting for November 10, 1997, Hugo City Hall, at 7:30PK to further discuss improvements for the Bald Eagle Industrial Park. All aye. Motion Carried. PELOOUIN INDUSTRIAL PARK (IN -PROGRESS REVIEW) Questions have been raised regarding the status of the proposed improvements project for Peloquin Industrial Park, including the extension of sewer and water service to the Park and construction of streets. Staff believes that in order to proceed with this project, the City Council will again need to notice a public hearing for the proposed improvements. Planning workshops for the area have been conducted with the property owners and residents of the area. The results of these workshops are before the Planning Commission for their consideration. The City Administrator outlined two Plans for Council consideration: 1) extend utilities and make assessments, or 2) extend utilities from TH61 to the east in increments. He stated that he will be meeting with the City Engineer to determine if the 2nd option was possible. Miron made motion, Barnes seconded, that the City delay action on any proposed improvements in the Peloquin Industrial Park until strategic direction for this area's development is adopted by the City. SNOWMOBILE TRAIL ALONG TH61 As of yet, the Hugo Snowmobile Club has not provided the City an application for the establishment of a snowmobile trail on the Hardwood Creek trail west of TH61, in accordance with requirements with Hugo City Code, Chapter 181.10. It is expected that once adequate snowfall for the operation of snowmobiles is present, snowmobiles will be using this right of way, as they have in the past, with or without Council approval. In addition, it is legal for snowmobiles to operate in the ditch along TH61, immediately adjacent to the Hardwood Creek trail. It is a practical impossibility to differentiate City Council meeting of November 3, 1997 Page 4 between the trail and the ditch in most areas. For this reason, the City must either prohibit the use of snowmobiles along TH61 or establish a public snowmobile trail along the Hardwood Creek trail under its own auspices. This is, of course, is an activity the City has been involved with in the past, and will require a contract for the grooming and maintenance of the trail, as well as an assumption by the City of the liability for use of the trail. Adrian Kramarczuk, speaking on behalf of the club, requested tabling of this matter. Miron made motion, Leroux seconded, directed City staff to draft a letter to the Hugo Snowmobile Club and Washington County outlining the City's concern with snowmobiles crossing Hardwood Creek north of 177th Street due to the removal of the bridge and the wooden posts in the stream bed. All aye. Motion Carried. CONTRACT FOR SEPTIC INSPECTIONS The Council considered an Agreement for On -Site Septic Inspection Services between the City of Hugo and Washington County. This Agreement will continue the existing relationship between the City and County, where the County staff performs on-site septic inspection services and approves the construction of septic systems within the City. This is a self -funding Agreement where all costs associated with the program are recovered by the County through fees and charges. Leroux made motion, Barnes seconded, to approve the Agreement for On -Site Septic Inspection Services between the City of Hugo and Washington County. All aye. Motion Carried. PROPOSED CHARITABLE GAMBLING ORDINANCE The Council considered a draft ordinance regulating charitable gambling in the City. Staff recommended a public hearing date of December 1, 1997. Miron made motion, Leroux seconded, to schedule a public hearing for December 1, 1997, at 7:05PK to consider adoption of the proposed Charitable Gambling Ordinance. All aye. Motion Carried. PROFESSIONAL SERVICES EVALUATION The Council considered evaluation sheets for the individuals and firms providing professional services to the City. The Council indicated its desire to conduct these evaluations on an annual basis. Staff requested the Council return the completed forms at the Council meeting of December 1, 1997. No further action was required. City Council meeting of November 3, 1997 Page 5 BUDGET WORKSHOP DATE In preparation for the City's Truth in Taxation hearing scheduled for December 15, 1997, staff requested the Council establish a date for a budget workshop the first week of December, 1997. This will be a final review of the budget proposed for 1998, and a discussion of the remaining issues related to the Fire Chiefs budget requests. Leroux made motion, Barnes seconded, to schedule a budget workshop for December 8, 1997, Hugo City Hall, at 9:OOAM. All aye. Motion Carried. 157TH STREET CULVERT Leroux made motion, Barnes seconded, direct City staff to investigate the repositioning of the the Hardwood Creek culvert located on 157th Street. All aye. Motion Carried. 130TH STREET WEEDS Councilman Warren Arcand requested that the weeds along 130th Street, between Goodview and TH61, be removed prior to winter's snowfall.
