PRESENT: Goiffon, LaValle, Leroux„ Miron City Attorney. Greg Galler City Engineer, Tom Angus City Clerk, Mary Ann Creager ABSENT: Debra Barnes Leroux made motion, LaValle seconded, to approve the following Consent Agenda: Minutes for the City Council meeting of February 29, 1996 Minutes for the City Council meeting of March 4, 1996 Minutes for the City Council meeting of March 11, 1996 Claims for March 18, 1996 Hire Seasonal Building Assistant Findings of Fact (McCullough) All aye. Motion Carried. SITE PLAN APPROVAL (GAMBONI) Thomas M. and Kathy L. Gamboni, 5473 145th Street, requested site plan approval to construct a 30' x 32' garage on their property at the above address. The property is currently CB, and is being used for residential purposes. They intend to remove the existing garage from the site. The 960 square foot garage proposed is under the 1,000 sq ft allowed by ordinance. Location of the garage meets all setback requirements of the City in the CES district, as well as residential districts. Residential use of this property is a nonconforming use, but the City has permitted improvements to residential properties in the CES district in the past, in accordance with Hugo City Code, Chapter 320-4, Subd. K(4). The property is located in the downtown planning area. Miron made motion, Goiffon seconded, Thomas Gamboni, 547. 145th Street, to property. BUILDING ASSISTANT to approve the site plan request of construct a 30' x 32' garage on his an application for residential site refunded $60.00 application fee. Mr. Vern Bartlette is hired as assistant to the City's Building Official for the 1996 construction season. His employment will start April 1, 1996 at $9.70/hour. PERMIT VIOLATION HEARING A public hearing was scheduled for 7:30 PM to consider an allegation that Mr. David Deschane, 13580 Geneva Avenue, violated the conditions of a building permit issued to him on April 4, 1994, and had not paid the fees associated with such permit. Mr. Deschane was notified of the hearing by certified mail. City Council meeting of March 18, 1996 Faae 2 The Council was informed that Mr. Deschane had paid double the application fee during the day on March 18. 19969 but that they check had not been deposited and cleared by the bank. LaValle made motion. Leroux seconded, to table further action on this matter to make sure Mr. Deschane's check clears the bank. All aye. Motion Carried. SITE FLAN AP'P'ROVAL (INTERSTATE LUMBER) At the Council meeting of March 4, 1996, consideration was given to an application from Interstate Lumber Company for site plan approval to construct an additional building on their property at the intersection of C.R. 8 and T.H. 61. At this meeting, Mr. Mendlik stated that he would remove the trailers from the site should the Council approve the site plan. Council tabled action on this matter pending receipt of a revised site plan, and the City Engineer's review of construction setbacks to insure traffic safety on the adjacent roadways. Mr. Angus stated that he had no concerns with the site plan, as presented. ALLEGATION OF LIQUOR LICENSE VIOLATIONS The City Attorney received a complaint that an underage person was served alcohol at Ricci's Saloon on March 2, 1996, in violation of the liquor license issued by the City. In a recent, similar occurrence at another establishment, the City Council determined to hold a public hearing to determine if the allegations are true, and what sanctions, if any, are warranted against the establishment. Miron made motion, Leroux; seconded, to table action on this matter until notified by the City Attorney that the criminal case against Ricci's has been decided. The Attorney is to forward a letter to owner(s) of Ricci's Saloon indicating the seriousness of the charges, as well as the City's intent to hold a hearing after the criminal case has been decided. VISION STATEMENT AND GUIDING PRINCIPLES (DOWNTOWN REDEVELOPMENT) At a previous meeting, the City Council received copies of the Vision Statement and Guiding Principles developed at the downtown visioning workshop conducted by Hoisington Koegler Group, Inc. City Council meeting of March 18, 1996 Page 3 Miron made motion, Goiffon seconded, that the City approves the Vision Statement and Guiding Principles as developed at the Downtown Visioning Workshop conducted by Hoisington koegler Group. Inc. All aye. Motion Carried. TIF WORKSHOP As part of the Bald Eagle Industrial Park planning process, staff recommended that the City Council conduct a workshop to hear general information regarding the use of Tax Increment Financing in Minnesota. Representatives from Ehlers and Associates would be present at the workshop to explain the legal and administrative processes of TIF use, as well as potential use in the City of Hugo. Leroux, made motion, Goiffon seconded, to establish April 11, 1996, at 9:15 AM, for a workshop to explain the legal and administrative processes for TIF (Tax Increment Financing). All aye. Motion Carried. ROAD RESTRICTIONS (RESOLUTION) The Council considered a resolution establishing Spring road weight limits for the City of Hugo, which would run concurrently with those established by Washington County. Leroux made motion, Goiffon seconded, to adopt RESOLUTION 96-2. A RESOLUTION SETTING ROAD RESTRICTIONS FOR THE YEAR 1996. VOTING AYE: Goiffon, LaValle, Leroux, Miron Motion Carried. MISCELLANEOUS Councilman LaValle stated that he had been informed by a resident that a developer had constructed a road on his property. LaValle will follow-up on the complaint. David Schumann asked that the Council discuss deferred assessments at the TIF workshop. Attorney Galler was directed to memo the Council, prior to the workshop, of the legalities for deferred assessments. Resident Ron Sparrow requetted that residents be notified of the upcoming "charrette" for Downtown Redevelopment to be held on March 29 and 30, 1996. Miron made motion, LaValle seconded, that a notice of the Downtown Redevelopment "charrette" be sent to previously noticed residents, as well as residents present at the previously held workshop. LaValle made motion, Miron seconded, that staff attempt to have a press release of the upcoming "charrette" in the White Bear Press. Resident Wally Stoltzman requested that the Council attempt to keep daytime meetings/workshops to a minimum to allow working residents an opportunity to attend them. Resident Stoltzman also expressed concern that a certain road was not barricaded by the City to warn motorists of impending danger. Miron made motion, LaValle seconded, to adjourn at 8:05 PM.
