Moon made motion, Goiffon seconded, to approve the following Consent Agenda
items:
General Claims for October 21, 1996 in the amount of $66,474.81.
All aye. Motion Carried.
Moon made motion, Barnes seconded, to approve the minutes for the City Council
meeting of October 7, 1996, as amended.
All aye. Motion Carried.
SPECIAL USE PERMIT (PEI
At the Council meeting of October 7, 1996, the City Council considered the request of
Kevin and Jean Peltier and SBA, Inc., to construct a 150' monopole on the Peltiers'
property 5787 -130th Street (southwest corner of 130th Street and Goodview Avenue).
The Planning Cornmission previously considered this request and reoommended approval
of the SUP for the site. The Council expressed concerns regarding the impact of the
proposed antenna on the Benson Airport, whether this type of use should be covered by a
franchise, and the potential need for construction of a public road along the easement being
granted to SBA for access to the antenna site. In order to consider these matters, the
Council tabled action on the SUP until this evening's meeting. 4, 1996. Trevor Blaska,
representing SBA, Inc., presented the Council with an AIRSPACE SAFETY ANALYSIS
for Benson Airport for their review. Because the City Attorney did not receive data
regarding franchising until this evening, the Council made the following motion:
Miron made motion, Agness seconded, to table action on this request until the meeting of
November 4, 1996.

RESOLUTION APPROVING THE DISSOLUTION OF THE BROWN'S CREEK
WMO
The Minnesota Board of Soil and Water Resources has declared that the Brown's Crack
WMO has failed to implement its plan for the management of storm water within the
Brown's Creek watershed. This is the first step in legally dissolving the WMO. The
Council considered a resolution requested by the Washington County Soil and Water
Conservation District approving the dissolution of the Joint Powers Agreement which
created the Brown's Creek WMO. The WCSWC service feels that this is the most direct
method in resolving the dissolution of the WMO in preparation for reassigning the
responsibilities for storm water management in the area. Staff recommended approval of
the resolution.
Barnes made motion, Goiffon seconded, to adopt RESOLUTION 96-11, A
RESOLUTION APPROVING THE DISSOLUTION OF THE BROWN'S CREEK
WATERSHED MANAGEMENT ORGANIZATION.

ED LIOUOR LICENSE VIOLATION
It is alleged that on March 2, 1996, a bartender in the employ of Mr. Raymond Bogatty,
doing business as Ricci's Cantina in Hugo, served alcohol to a minor in violation of the
City's liquor licensing ordinance. On April 15, 1996, the City Council approved the City
entering into a Stipulation Agreement with Mr. Bogatty in lieu of conducting a disciplinary
hearing on the alleged violation under Hugo City Code, Chapter 150, Section 12. Mr.
Bogatty has indicated his unwillingness to enter into the Stipulation Agreement, and staff
recommended that the Council conduct a hearing on the violation on November 18, 1996.
Barnes made motion, Goiffon seconded, directing City staff to schedule a hearing for
November 18, 1996, at 7:05PK to discuss an alleged violation of the City's liquor
licensing ordinance by the selling of alcohol to a minor at Ricci's Cantina.

1996 ROAD GRAVELING CONTRACT
Three bids were received by the City for the proposed 1996 road graveling project. Staff
recommended that the City purchase the material from the low bidder, Forest Lake
Contracting, at their bid price of $3.98 per ton. Total project cost is expected to be
$11,836.20.
Goiffon made motion, Agness seconded, to accept the low bid of $3.98 from Forest Lake
Contracting, for the 1996 road graveling project.

ORDINANCE VIOLATION (HANSEN)
Barnes made motion, Goiffon seconded, authorizing the City Attorney to start civil action
against Darryl Hansen, 14420 Irish Avenue, for alleged zoning violations.
All aye. Motion Carried.
POST OFFICE ESCROW
Goiffon made motion, Barnes seconded, to adopt RESOLUTION 96-12, A
RESOLUTION ESTABLISHING AN ACCOUNT TO FUND THE CONSTRUCTION
OF A PORTION OF 150TH STREET, AND DIRECTING THE CITY ENGINEER TO
LET BIDS ON THE PROJECT.
VOTING AYE: Agoess, Barnes, Goiffon, Miron
Motion Carried.
City Attorney Galler stated that a Mr. Peterson had been arrested for his 9th DWI, and the
City can confiscate his vehicle at a cost to the City of $500.00.
Barnes made motion, Goiffon seconded, that the City not proceed with forfeiture of the
Peterson vehicle.
All aye. Motion Carried.
Goiffon made motion, Barnes seconded, to adjourn at 8:12PM.
