PUBLIC HEARING (AG PRESERVE ORDINANCE)
A public hearing was called to consider the adoption of an ordinance creating an
agriculture preserve zoning district within the City. For the purposes of
establishing the district, the ordinance uses the term "commercial food protection
district", to more closely align the purpose of the zoning district with State law.
The proposed ordinance allows for the zoning of property for commercial food
production and qualification for the State's agricultural preserve program. Alice
Waller addressed the Council with her suggestions for changes to the proposed
ordinance, including changing the name of agriculture preserve. The City Attorney
expressed concerns that this term may mislead people to believe that by changing a
property's zoning to "agriculture preserve", they automatically qualify for the
State's program of the same name. There were no other oral or written
comments.
Leroux made motion, Agness seconded, to adopt ORDINANCE 1996-312, AN
ORDINANCE AMENDING THE CITY ZONING ORDINANCES TO
ESTABLISH A ZONING DISTRICT TO BE KNOWN AS "LONG TERM
AGRICULTURE".

A public hearing was called to -consider amending the zoning ordinance to permit
child care centers in all zoning districts of the City. The Planning Commission
considered the draft ordinance and recommended approval subject to the following
changes: B class to read "seven or more clientele children being cared for"; A
class to read "six or fewer..... "; Section 3 to read "Class A without a Special Use
Permit". The hearing was called to order and there were no oral or written
comments. Council member Agness raised the question as to whether the
proposed ordinance agreed with State regulations relative to the number of
children allowed in a residence.
Agness made motion, Leroux seconded, to table this matter until the meeting of
November 18, 1996, to allow staff time to research the question.
All aye. Motion Carried.
The City Attorney prepared Findings of Fact relating to the City Council granting
Tom Houck and Linda Mezzenga a SUP to operate a child care center at the
southwest corner of T.H. 61 and 141st Street.
Barnes made motion, Miron seconded, to adopt the Findings of Fact to allow the
Oneka Child Care Center a SUP to operate a child care center.
All aye. Motion Carried.
HUGO SNOWMOBILE CLUB
Ken Strantz, representing the club, addressed the Council regarding the use of the
abandoned railroad bed for their trail. He also discussed east/west routes, and the
fact that they had not received everyone's permission. The City Administrator
referenced City ordinances stating that there is a very specific format for the club
to follow in designating snowmobile routes. The request may go directly to the
City Council, with no need of a public hearing.
Miron made motion, Barnes seconded, to table this matter until the proper
paperwork is filed with the City.

George Indykiewicz, 1920 West Highway 96, New Brighton, MN., has requested
a renewal of the Mining Permit on his property in the W 1/2 of the N1/2 of Section
17, in the City of Hugo to continue mining black dirt from the property. Staff
recommended renewing the permit under the same conditions as the existing
Mining Permit.
Leroux made motion, Goiffon seconded, to renew the Mining Permit for George
Indykiewicz until November 1, 1997, subject to the same conditions.
All aye. Motion Carried.
Mr. Tun Bever requested time to discuss conditions of the proposed SUP for his
property on 7131 132nd Street for use in the sale of flowers, trees, and shrubs and
other landscaping products; specifically, Mr. Bever is requesting permission to
maintain a display of landscaping rock, block., and other materials on the site. It is
not his intent to stockpile an inventory of this material, nor operate the machinery
necessary to support the use of such materials on the site. He does wish to be able
to show customers those products available. Council member Barnes presented
suggested changes to the Permit, and Mr. Bever agreed with her recommendation.
Goiffon made motion, Barnes seconded, to amend the previously approved SUP
for Tun Bever with Condition #4 to read as follows: Samples of modular block,
boulders, brick, rock, fountains, and other ornamental goods may be displayed on
site to facilitate the wholesale sales of such landscaping materials. However, there
shall be no exterior storage of these items and delivery of these non-agricultural
goods shall be direct from the manufacturer to the client.

PROPOSED FIRE HALL DISCUSSION
The Fire Chief, Tun Wisner, addressed the Council with questions that had been
posed during the Fire Department's door-to-door campaign promoting the Fire
Hall referendum.
CONCEPT REVIEW (SMM
Mr. Craig Smith requested that the Council review his proposal to subdivide 39
acres into six residential lots by use of cluster development. The property is

accessed by a 66 ft driveway easement used by the "Garden' from 132nd St.
Warren Olson, representing the Smith family, discussed amenities/flaws of the
proposal, and the Council agreed that the proposal was generally in the context of
present regulations. Mr. Olson stated that he will be preparing an application and
preliminary plat for presentation to the Planning Commission.
PROPOSED ANTENNA ORDINANCE
The City of Hugo has received multiple applications for the construction of cellular
telephone antennas within the community. Staff has been worldng on an antenna
ordinance to regulate their construction and location. Attorney Galler stated that
he was not satisfied with the draft submitted to the Council, and requested the
Council table action.
Leroux made motion, Agness seconded, to table this matter to allow the City
Attorney time to resubmit a revised ordinance.
All aye. Motion Carried.
The Council considered a resolution assessing delinquent utility bills from 1996.
Barnes made motion, Miron seconded, to adopt RESOLUTION 96-13, A
RESOLUTION DECLARING UNPAID UMXrY BILLS BE PLACED ON
THE TAX ROLLS.

MISCELLANEOUS
Dan Nadeau requested the City Council reconsider reduction of various fees
(WAC, SAC, REC) that were charged against his building project. Mr. Nadeau
submitted a sample of charges from other communities. It was noted that the
sample was from communities located outside of the metro area. Another
sampling of metro communities indicated that, although Hugo is on the high side,
charges are within range of other communities. Mayor Miron that Mr. Nadeau
that the Council would review City fees for new construction.

The City Council serves as the Board of Canvass for elections in the community,
and under State law, must meet immediately following elections to canvass local
election results to determine their accuracy. Staff recommended that the Council
recess tonight's meeting to 7:OOPM, November 6, 1996, in order to canvass the
results of the 1996 local election.
Leroux made motion, Barnes seconded, to recess tonight's meeting at 10:1 SPM
until 7:OOPM on November 6, 1996.
