Barnes made motion, Leroux seconded, to approve the following Consent Agenda:

GENERAL CLAIMS
Barnes made motion, Goiffon seconded, to approve the General Claims for November 18,
1996 in the amount of $17,426.88.
All aye. Motion Carried.
CHARITABLE GAMBLING LICENSE (EAGLES)
Leroux made motion, Goiffon seconded, to approve the Charitable Gambling License for the
Fraternal Order of Eagles #94 to sell pulltabs, tipboards, paddlewheels, and conduct raffles
at the Keystone Lounge, 12010 Keystone Avenue, and waiver of the 30 -day waiting period.
All aye. Motion Carried.
ZONING ORDINANCE AMENDMENT (CHILD CARE FACILITIES)
At the Council meeting of November 4, 1996, the City Council conducted a hearing on a
proposed ordinance amending the City's zoning ordinance by allowing child care facilities in
all zoning districts of the City. At that time, the Council questioned if the ordinance
limitations on the number of children permitted in a daycare facility in a residential district

was in compliance with State law, and tabled action on the ordinance. The amended
ordinance reflects State Statute, and permits that daycare facilities in residential districts
may have up to 14 children, the limit imposed by law.
Leroux made motion, Agness seconded, to adopt ORDINANCE 1996-313, AN
ORDINANCE ESTABLISHING CHAPTER 75 OF THE CITY CODE, DESIGNATING
AND DEFINING ZONING DISTRICT FOR DAYCARE CENTERS WITHIN THE CITY
OF HUGO.
VOTING AYE: Agness, Barnes, Goiffon, Leroux, Miran
Motion Carried.
SUP RENEWAL BALD EAGLE SPORTSMAN ASSN.)
The Administrator stated that the City has not received any complaints relative to the Club's
operation. The Council then reviewed the existing Permit and conditions noting changes
when needed.
Leroux made motion, Goiffon seconded, to renew the SUP for the Bald Eagle Sportsman
Association for a two-year period, with the noted changes.
VOTING AYE: Barnes, Goiffon, Leroux, Miron
ABSTAINED: Tim Agness
Motion Carried.
ED WALLER (DRAINAGE)
The Council reviewed a letter written by Ed Waller regarding drainage under T.H. 61 near
Forest Boulevard, and the need for ditch/culvert cleaning.
Leroux made motion, Goiffbn seconded, that the City contact the RCWD regarding our
interest in having Hardwood Creek cleaned, and that the City will coordinate the cleaning
effort among the agencies involved (RCWD, MNDOT, and Washington County).
All aye. Motion Carried.
HEARING (ALLEGED LIQUOR LICENSE VIOLATION)
It is alleged that alcoholic beverages were served to a minor at Senor Ricci's of Hugo, Inc.,
located at 14777 Forest Blvd., on March 2, 1996. When this matter was brought to the
City's attention, the Council authorized staff to negotiate a Stipulation Agreement with Mr.
Raymond Bogatty, owner of Ricci's. The City was not successful in these efforts, and
subsequently the City Council established this evening's meeting as a time to conduct a
hearing on the violation in accordance with Chapter 150 of the City Code. Washington
County Deputy Tim Tudhill, representing the City, and Mr. Raymond Bogatty, owner of
Ricci's, representing himself, testified before the Council with their version of the events of
City Council meeting of November 18, 1996

March 2, 1996. After all testimony was presented to the Council, the following motion was
made:
Barnes made motion, Leroux seconded, that this Council make a finding that the Licensee
did, in fact, violate Chapter 150, Section 9, of the Hugo City Code by furnishing alcohol to a
person under 21 years of age.
VOTING AYE: Agness, Barnes, Leroux, Miron
VOTING NAY: Andrew Goiffon
Motion Carried.
Barnes made motion, Leroux seconded, that the City of Hugo impose a $500 civil fine on
Raymond Bogatty, owner of Ricci's Cantina, for violating Hugo City Code, Chapter 150,
Section 9, by furnishing alcohol to a person under 21 years of age.
VOTING AYE: Agness, Barnes, Leroux
VOTING NAY: Goiffon and Miron
Motion Carried.
Goiffon made motion, Leroux seconded, allowing Mr. Bogatty 60 days from today's date m
which to make payment of the $500 fine.
All aye. Motion Carried.
COUNCILMAN TIM AGNESS LEFT THE MEETING AT 9:OOPM.
FIRE HALL DISCUSSION
On November 5, 1996, as part of the general election, the City conducted a referendum on
whether to issue general obligation bonds in an amount not to exceed $1,100,000 for
construction of a new fire hall. The result of the referendum was 1,524 against, and 981 in
favor. Councilman Leroux suggested that a questionnaire be sent to residents asking why
they voted against the referendum. It was concluded that there were three areas of
contention: 1) site, 2) cost of project, and 3)remodel or new construction.
Miron made motion, Barnes seconded, directing the Fire Hall Committee reconvene, with
Dave Schumann as Chair, and a subcomnuttee meet to determine costs for remodeling the
existing facility, with both Committees reporting findings to the Council.

128TH STREET VACATION
Previously, Wilson Tool had requested the vacation of a portion of 128th Street, which
bisects its property. This street easement is partially wetlands, and has not been improved.
At the street vacation hearing, the Council expressed concerns regarding the potential future

need of that easement for construction of a bike trail, and the impact that the vacation of the
street would have on firture negotiations with the railroad and MNDOT for necessary street
accesses to T.H. 61. Wilson Tool has again raised the issue of the City vacating 128th
Street, as they are currently considering expansion plans.
Leroux made motion, Goiffon seconded, to schedule a public hearing for December 16,
1996, at 7:05PK to consider vacation of a portion of 128th Street , bisecting the Wilson
Tool property in the Bald Eagle Industrial Park.
All aye. Motion Carried.
JOINT MEETING (MAY TOWN BOARD)
Ed Matthiesen, Montgomery Watson, engineer for the proposed School Section/Goggins
Lakes outlet project, has informed the City that the downstream impact analysis will be
completed by the middle of December. Discussions with Rebecca Johnson, of the May
Town Board, indicate December 19,19% as a proposed date for a joint meeting between
May Township and the City of Hugo to consider the results of the report, and determine a
course of action to relieve the flooding in the basin.
Miran made motion, Goiffon seconded, to schedule a joint meeting of the May Town Board
and Hugo City Council for December 19, 1996, at 7:30PK Withrow Elementary School, to
discuss the engineering report on the doRmstream impact for the School Section/Goggins
Lakes outlet project.
All aye. Motion Carried.
The received a draft letter from May Township regarding the appropriate amount of
Washington County's contribution for the flood mitigation project.
Miran made motion, Goiffon seconded, directing staff to redraft the Township's letter and
attempt to schedule a meeting with May Township, the City of Hugo, and Washington
County prior to the joint meeting of December 19, 19% to discuss the project.

FINAL REVIEW (1997 PROPOSED BUDGE n
The Truth in Taxation hearing of the City's 1997 tax levy has been scheduled for December
16, 1996. Prior to this hearing, staff suggested a review of the 1997 proposed budget in
light of the recent changes discussed for street and utility work.
Miron made motion, Leroux seconded, to schedule a workshop for Tuesday, December 3,
1996, Hugo City Hall, at 7:30PK to further the City's 1997 proposed budget.

SrM PLAN APPROVAL (POST OFFICE)
Barnes made motion, Mum seconded, to approve the Site Plan for the proposed Hugo Post
Office subject to the following conditions:
1. Establish a cooperative effort to determine proper elevations for the building.
2. Establish more vegetation for necessary screening along T.H. 61.
All aye. Motion Carried.
Goiffon made motion, Leroux seconded, to adjourn at 10:15PM.
