Goiffon, LaValle, Leroux,, Miron City Attorney, Greg Galler City Engineer, Joel Dresel City Clerk, Mary Ann Creager The following items were added to tonight's agenda for discussion: condition of City roads, letter from Lee Johnson regarding black powder testing at the DESA, and letter requesting reservation of City park. Leroux made motion, LaValle seconded, to approve the minutes for the City Council meeting of March 6, 1995, as amended. VOTING AYE: Goiffon, LaValle, Leroux. Miron ABSTAINED: Barnes Motion Carried. Leroux made motion, Goiffon seconded, to approve the claims for March 2c), 1995, in the amount of $24.813.37. All aye. Motion Carried. PUBLIC HEARING (ROCK CRUSHER ORDINANCE) Attorney Galler explained the conflict existing in the City ordinance that necessitates the need for the proposed ordinance. After discussions with Dean Atkinson's attorney, Bruce Malkerson, Attorney Galler submitted the language suggested by Mr. Malkerson, as well as his own suggested changes. Councilmember Barnes felt it necessary that dust and noise should be addressed to protest surrounding property owners. The public hearing was opened and the following comments were made: Dave Schumann, no problem with rock crushing, valuable resource: Dean Atkinson, requested that the Council approve ordinance modification; and Ed Waller, conduct all mining activities at one site to save City road. The public hearing was closed, and the Council then discussed the hauling in of materials and the use of existing materials on site. The Council did agree that the Atkinson mining site should not be sold, at a later date, to another contractor for use as a commercial site. Councilman LaValle stated, for the record, that Mr. Atkinson has not hauled in any recycling materials to his property for the last two years. Goiffon made motion, Barnes seconded, to table this matter until the meeting of April 3, 1995. All aye. Motion Carried. PUBLIC HEARING (PIPELINE SETBACK ORDINANCE) The public hearing was called to order and there were no oral or written comments. Leroux made motion, Goiffon seconded, to adopt ORDINANCE 95-296, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY ESTABLISHING BUILDING SETBACK REQUIREMENTS FROM CERTAIN PIPELINES. A11'aye. Motion Carried. City Council meeting of March 20, 1995 Page 2 PUBLIC HEARING (REVISED MRV ORDINANCE) Deputy Jerry Cusick was. present to answer questions regarding the proposed ordinance. It was suggested that signs be posted at Goodview and SA, and County Road 8 and Frenchman, informing snowmobilers of City regulations. Goiffon made motion, Miron seconded, to adopt ORDINANCE 95-297, AN ORDINANCE REPEALING CHAPTER 181 IN ITS ENTIRETY AND ADOPTING A REVISED MOTORIZED RECREATIONAL VEHICLES ORDINANCE. All aye. Motion Carried. Miron made motion. LaValle seconded, directing staff to post signs at Goodview and 8A, and Frenchman Road and C.R.8, informing snowmobilers of City regulations. All aye. Motion Carried. CHARITABLE GAMBLING LICENSE (HUGO FIREMEN'S RELIEF ASSN) Goiffon made motion, Miron seconded, that the City of Hugo has no objection to the issuance of a Charitable Gambling License to the Hugo Firemen's Relief Association, for conducting of bingo on June 2,•_•,4, 1995, and raffle on June 4, 1995 during Good Neighbor Days. The City also waives the =0 -day waiting period. All aye. Motion Carried. HUGO FD RETIREMENT (MIKE NELSON) Miron made motion. Barnes seconded, to table this matter until the City Administrator receives a report Greg Burmeister regarding FD documents that surfaced at the Council meeting of March 6, 1995. All aye. Motion Carried. RESERVE CITY PARK (TOM LACASSE) Goiffon made motion, LaValle seconded, that the City authorize use of the City picnic shelter for the Arthur LaCasse family picnic on June 25, 1995. All aye. Motion Carried. SET COMPOST SITE HOURS LaValle made motion, Goiffon seconded, to set the 1995 compost site hours as follow: I. Every Saturday in May from 9:00 AM to 4:00 PM. 2. The 1st Saturday in June, July, August, and September from 10:00 AM tc 2:00 PM. 3. Every Saturday in October from 9:00 AM to 4:00 PM. 4. The ist two Saturdays in November from 9:00 AM to 4:00 PM. Pity Council meeting of March 20, 1995 Page 3 SCHEDULE SPECIAL CITY COUNCIL MEETING Barnes made motion, Goiffon seconded, that tonight's meeting be recessed, rather than adjourned, until March 28, 1995, 7:30 PM, to hold a workshop, in conjunction with the Fire Department and the State Fire Service, to discuss the Fire Department's proposed Standard Operating Procedures. All aye. Motion Carried. CONDITION OF CITY ROADS Mayor Miron informed the Council of road complaints received by the City. A resident adjacent to the 121st Street Bald Eagle Lake access claimed damage to his property as a result of sand being dumped to prohibit vehicular access. This matter will be turned over to the City's insurance agent. LaValle made motion, Goiffon seconded, that the Council conduct a road tour on April 8, 1995, at 9:00 PM. The City Engineer and City Attorney are requested to participate in the tour. All aye. Motion Carried. LETTER. FROM LEE JOHNSON (BLACK; POWDER TEST AT BESA) The City received a letter from attorney Lee Johnson regarding the proposed black powder test to be conducted by the Planning Commission, and the Council concurred that the City should set parameters for the test. LaValle made motion, Barnes seconded, that the experimental black power test to the conducted at the Bald Eagle Sportsman Association, as allowed by the City Council, be conditioned according to adopted standards as determined by an environmental noise engineering firm. Test results shall be provided to the City Council. Cost of the test shall be borne by the applicant (DESA). The BESA has the option of withdrawing their request for the black power test. All aye. Motion Carried, RESERVE CITY PARK ( CUMMI NGS ) The City received a request from Linda (Frisson) Cummings to reserve the City Park on July 1 and 2, 1995. The City had already taken action on a previous Brisson request, approving July 1, 1995. Leroux made motion, LaValle seconded, to allow use of the City park, with the exception of the tennis courts, on July 2, 1995, as requested. Leroux made motion, Barnes seconded, to amend the previous motion to limit use of the ballfields to the eastern field only. VOTE ON AMENDMENT: All aye. Motion Carried. VOTE ON ORIGINAL MOTION: All aye. Motion Carried. City Council meeting of March 20, 1995 Page 4 ATTORNEY GALLER Mr. Galler reported that the City has received the $1200.00 for the forfeited Chevy Glazer owned by Shawn McGovern. Mr. Galler stated that if the City has any menial projects that needed to be done in the City, that they should contact Sentence to Service. He stated that there are more workers than jobs available. Mayor Miron and Councilmen Goiffon and LaValle will coordinate the Citi efforts with the County. MISCELLANEOUS Resident Ed Waller questioned the City Engineer of the status of the report to the RCWD regarding culvert elevations. Mr. Dresel will follow up on the request. LETTER FROM KEN PETERSON (CERTIFICATES OF OCCUPANCY) The City received a letter from the electrical inspector regarding the need for the City to issue Certificate of Occupancy. This matter is to be placed on the Council agenda for April 3, 1995. Councilman Goiffon inquired as to the status of the Walker cemetery matter. This will be reviewed on the City road tour of April 8th. RELOCATION OF HUGO POST OFFICE The Council reviewed a draft letter to Tim Garry regarding land located north of Flay Avenue as a possible site to relocate the Hugo Post Office. The City Administrator and City Engineer are to research the costs for obtaining access and utilities to the site. Miron made motion, LaValle seconded, to set discussion of relocation of Hugo Post Office on the agenda for the special meeting of March 28, 1995. Mr. Tim Garry is to be invited for this discussion.
