PRESENT: Barnes, Goiffon, LaValle, Leroux, Miron City Attorney, Greg Galler City Engineer. Joel Dresel City Clerk, Mary Ann Creager LeroUX made motion. Goiffon seconded, to approve the following consent agenda calendar with the Understanding that discussion of the rock crusher ordinance and certificates of occupancy be tabled: A. Minutes for Council meetino of March 20, 1995 B. Minutes for Recessed Council meetino of March 28. 1995 C. Claims for April 3, 1995 for $66,828.01 D. Charitable Gambling Application (HUgo Lions Club) E. Fire Fighter Retirement F. 3.2 Deer License (HUgo Lions Club) G. GroUndskeeper Appointment H. Variance (Sadowski) I. Special Use Permit (Walsh) J. Special Use Permit (Montanari Homes) M::. Special Use Permit (Concrete Yard Ornaments) L. Foch:. Crusher Ordinance The foregoing consent calendar was approved unanimously. SITE PLAN APPROVAL. (WILSON TOOL). On March 22. 1995, the Hugo Planning Commission considered the request of Wilson Tool for site plan approval to construct a .36,2x)0 square foot building on their property in the Bald Eagle Industrial Parti;. The building will be used as an office (4.800 sq ft) with the balance being used as a manufacturing machine shop. The PC recommended approval of site plan. John Glenn, representing Wilson Tool, was present at the meeting and distributed landscaping plans for the proposed building. The City Engineer stated that he will review the drainage plan for the proposed building. Mir -on made motion, LaValle seconded, to approve the site for Wilson Tool, 12912 Farnham Avenue, for construction of a 36,200 square foot building on their property in the Bald Eagle Industrial Parti:.. Approval is subject to the City Engineer reviewing drainage and landscape plans. All aye. Motion Carried. PRELIMINARY PLAN APPROVAL (WOODS OF BALD EAGLE) The Council considered the Planning Commission's Findings of Fact and recommendations pertaining to the request by Grace Development Corporation to develop a Planned Unit Development (PUD) named Woods of Bald Eagle, located south of 130th Street and west of the Bald Eagle Industrial Park. In order for this project to be approved, it requires both a PUD permit and plat approval. Staff recommended approval of the preliminary plat in accordance with the 210 conditions established by the PC. The PUD permit would be issued concurrently with final plat approval. This matter was City Council meeting of April 3. 1995 Page addressed at length, with numerous issues being raised by the Council and public in attendance. Attorney Galler, itemizing these issues, suggested that the Council set a date for a workshop to address these concerns. Leroux made motion. Barnes seconded, to table this matter until April 24, 1995. at 7:30 PM, to address concerns raised by the Council and public regarding the development known as Woods of Bald Eagle. All aye. Motion Carried. HEARING (LIQUOR ORDINANCE VIOLATION) A public hearing was scheduled for 7:05 PM to consider whether or not R.J.'s Restaurant and Lounge. 13891 Forest Blvd., has violated Section 10, SUbd. ', of HUgo City Code by selling alcoholic beverages to persons under the age of 21. The City received a letter from Mr. Minich stating that he would be out of town, and asked that this matter be moved to a later date. Miron made motion, Leroux seconded, to table the public hearing until May 1, 1995. at 7:05 PM. All aye. Motion Carried. DANGEROUS DOG DECLARATION In response to reports filed by the Washington County Sheriff's Dept., and upon recommendation of the City Attorney, staff recommended that the City Council declare a male, two-year old Rottweiler, owned by Frank J. Arcand, 12878 Irish Avenue, a dangerous dog_ in accordance with Minnesota Statues. Section 347.50. LaValle made motion. APPOINTMENT OF ANIMAL CONTROL OFFICER Staff recommended that the City Attorney, Greg Galler, be appointed an animal control officer of the City in order to issue dangerous dog citations under State Statute. Mr. Galler would work in cooperation with the City's appointed animal control officer, Animal Control Services, Inc. Leroux made motion, Barnes seconded, that the City Attorney be appointed an animal control officer of the City for the purpose of dealing with dangerous dog declarations. All aye. Motion Carried. DISCUSSION OF STORM WATER ISSUES Peter Willenbring of OSM presented the Council with the Comprehensive Stormwater Management Plan for the Clearwater Creek Watershed. '-6jrj€j. l fh@@ting of Aori 1 3, 1995 Paae Leroux; made motion, Miron seconded, to endorse the concept of the Flan and direct the developing engineer, Fete Willenbring, to present the Flan to the Rice Creek Watershed District for their review and comment. All aye. Motion Carried. Mr. Willenbrinq also submitted status reports on the elevation of culverts along Hardwood Creek and the Homestead Avenue pond. Miron made motion, Leroux: seconded, that the City Council host a public meeting on May 2, 1995, Hugo City Hall, at 7:30 PM, to facilitate a meeting for the Minnesota Department of Natural Resources on the various issues associated with the design for the Homestead Avenue pond outfall Study. All aye. Motion Carried. APPLICATIONS FOR SOLD WASTE HAULERS LICENSE The City received applications from Waste Management of Blaine. 1(.)050 Naples Street NE, and Pierre's DoAll Service, Inc.. 12863 Keller Avenue. HUgo. for licenses to haul solid waste in the community. HUgo City Code. Chapter 120-8. limits the number of licenses that the City may issue to six; (6). Currently, five licenses have been issued by the City. Since the completed application from Waste Management Blaine was submitted on February 28, 1995, and the completed application by Pierre's DoAll Service was submitted on March 16. 1995, staff recommended that the sixth license be issued to Waste Management. If the Council wished to allow a seventh hauler to operate within the City, a hearing would have to be scheduled to amend City ordinance. Barnes made motion, LaValle seconded, to accept staff's recommendation and issue the City's sixth solid waste hauler's license to Waste Management Blaine. All aye. Motion Carried. There was no recommendation to amend City ordinance to increase the number of City licenses to seven. At this time, Pierre's DoAll Service is not licensed to operate in the City. FIRE DEPARTMENT REQUEST Jim Wisner. Chief of the Hugo Volunteer Fire Department, requested that the City Council consider establishing a committee to investigate the need for a new Fire Hall to serve the community. This committee would be made up of serving fire fighters, interested citizens, and perhaps a member of the Council and Planning Commission. Leroux; made motion. Barnes seconded, authorizing the formation of a committee to' investigate the need for a new Fire Hall, and directing City staff to wore with the Fire Chief to establish parameters of the committee. At the suggestion of Councilman LaValle, staff was directed to publish a notice in the City's legal newspaper soliciting members from the community. ANIMAL CONTROL ORDINANCE Council member Barnes requested that discussion of an animal control ordinance be placed on the Council agenda. Barnes, made motion, LeroUX seconded, to schedule a public hearing to consider adoption of a domesticated animal ordinance for May 1, 1995. After discussion of the proposed ordinance, certain changes were requested by the Council. Barnes and LeroUX withdrew their motion. Barnes made motion, LaValle seconded, to table action on the proposed ordinance Until the meeting of April 17, 1995, to allow time for the City Attorney to draft a revised ordinance. All aye. Motion Carried. MISCELLANEOUS Congressman Bill Luther will be at City Hall on Saturday, April 29. 1995, between 11:00 AM and 12 noon for a "Listening Session." Bruce Bernin sent a letter to the City thanking for the improvements made to his road. Council calendar for April, 199-5: - Road tour (April 8th at 9:0(--) AM) - Neighborhood meeting (April 10th) - Board of Review (April 17th, 9:00 AM to 11:00 AM) - Woods of Bald Eagle Workshop (April 24th at 7:-30 PM) Attorney Galler is preparing the contingency purchase offer for the Gary Svoboda property as a possible site for the new Rost Office.
