The meeting was called to order by Mayor Fran Miron at 7:00 PM.

ABSENT: Debra Barnes
The following items were added to the agenda for discussion: addendum to
Loucks report (Stoltzman), proposed civil penalty ordinance, proposed
study on Brown's Creek, and GA safety suggestions.
Leroux made motion, Goiffon seconded, to adopt the following_ consent
agenda:
Minutes for the City Council meeting of July 5, 1995
Claims for July 179 1995 in the amount of $172,590.84
On Sale 0.2 beer license (Church of St. John's)
On Sale 3.2 beer/cigarette licenses (Bobber's Boats & Bait)
The foregoing consent agenda was adopted unanimously.
JUVENILE CURFF'EW ORDJ NANCE.
A public gearing was held to consider adoption of an ordinance that would
set a nighttime curfew for juveniles. There were no oral or written
comments received by the Council.
Leroux made motion, LaValle seconded, to adopt ORDINANCE 95-302, AN
ORDINANCE ESTABLISHING CHAPTER 72 OF THE HUGO CITY CODE TO BE KNOWN AS THE
"CURFEW (=ORDINANCE.", AND SETTING UP A NIGHTTIME CURFEW FOR JUVENILES. THI'S
RDINANCE IS ADOPTED PURSUANT TO MN. STATUTE 145A.05, SURD. 9 AND MN.
STATUTE 412.221, S IBD . 32.
VOTING AYE: Goiffon, LaValle, Leroux, Miron
Motion Carried.

This matter was tabled from the Council meeting of July 5, 1995 to review
a. report from MPCA regarding their inspection of the subject site. The
City received a copy of the report, wraith contained no additional
information to assist in the licensing process. Councilman LaValle stated
that he was still concerned with contamination of groundwater at all
dismantling yards, and should be addressed at future renewal times.
LaValle made motion. Goiffon seconded, to approve the Auto Dismantling
License for Hugo Auto and Truck. Farts, 16615 Forest Boulevard, for the
period March 22, 1995 to March 22, 1996, and subject to special
conditions.

CERTIFICATE OF OCCUPANCY ORDINANCE
Miron made motion, Leroux seconded, to schedule a public hearing for
Monday, August 21, 1995, at 7:05 PM, to consider a proposed ordinance
adopting the Minnesota State Building Code as revised and providing for
its application, administration, and enforcement; and providing for the
repeal of all inconsistent ordinance.
All aye. Motion Carried.
The building inspector is to review the proposed ordinance and make any
comments regarding its content.

Allan Barnard, representing FCA, and Jonathan Miesen, representing Hugo
2000, had no objection to the Special Use Permit, as proposed.
LaValle made motion, Leroux seconded, to approve the Special Use Permit
for River City Asphalt to conduct mining operations at the E 1/2 of the SE
1.!4 of Section 22, WIN, R21W, subject to 12 special conditions.
All aye. Motion Carried.
R:f.VE.R Q'l:TY ASPHALT (MININS PERMIT)
The Council reviewed the Mining Permit, and the proposed 16 conditions,
with discussion of conditions 6I) (trees), 9 (escrow deposit), and 14
(defining operations), in particular. All parties came to an agreement
regarding 6D and 9, but the attorneys present disagreed on the definition
of "operations" as it related to the generator set.. RCA felt that the
generator should not by included in the definition of operations, and that
they should be allowed to warm up the generator one half hour prior to the
7:00 AM allowed start up time. Hugo 2000 felt that the generator was a
part of the definition, and should not be allowed to start until 7:00 AM.
LaValle made motion, Goiffon seconded, to approve the Mining Permit for
River City Asphalt to conduct mining operations at the E 1/2 of the SE 1/4
of Section 22, T31N, R21W, subject to 16 conditions. Condition 6C should
be determine by the City Engineer regarding the number of pounds of seed
to be applied to the site. Condition 9 should indicate an amount of
$2,500 to be deposited to cover the cost. of City inspections. Condition
14 should remain the same allowing_ for a start up time of 6:30 AM for the
generator set.

VOTING NAY: Leroux acid Miron
Motion Denied.
Leroux made motion, LaValle seconded, to change Condition 14 to allow for
a start up time of 6:45 AM for the generator set.

CIVIL PENALTIES-ORDINANCE
Miron made motion. Leroux; seconded, to schedule a. public hearing for
Monday, August 21, 1995, at 7:1(--) PM, to consider a proposed ordinance
establishing Chapter 232 providing for systems and procedures for the
processing of allegations of violations regarding City-issued licenses and
permits and providing civil remedial sanctions for violations thereof.
All aye. Motion Carried.
ADDENDUM TO _LOUCK.S REPORT (STOLTZ.MAN MATTER)_
The City received an Addendum to the LolAcks report, as provided at the
time of application for a Special Use Permit by Walter L. Stoltzman.
Leroux; made motion, Goiffon seconded, that the City accepts and
acknowledges the Addendum to the Loucks report, as amended.

'rhe City received two requests from James Brevig that the City consider-
adoption of an Ordinance which would designate certain roadways within the
for him to operate his golf cart.
Mir-on made motion, Leroux seconded, to deny Mr. Breviq's request because
r.l road safety concerns.

Mr-. Dreviq also requested that the City abandon the temporary 15' drainage
easement to drain along his northern property line. The City Engineer
stated that because of current and future need of this area for future
utility services, and that the Management Plan for the Homestead Avenue
pond has not yet been completed, he recommended not vacatiinq the easement
at this time.
Miron made motion, LaValle seconded, to deny the request because the City
could need the easement for some purpose in the future.

BROWN'S CREEK STUDY
Hugo's representative on the BCWMO was present at. the meeting to request
financial assistance from the City to do a study to determine methods for
protecting the Brown's Creek trout stream. The City Council stated that
they were willing to participate if the WMO would also do a stud/ to
determine solutions to the flooding on 140th Street and C.R. 57.
Leroux: made motion, Goiffon seconded, to approve payment of the $200
request, and a letter be sent asking that the WMO study the flooding
problems adjacent to Lake Plaisted and School Section Lake.

Councilman Leroux; expressed concern with wire flags that are left along
City roads by utilities after their worth: is completed.
Miron made motion, LeroUX seconded, directing City staff to review the
issue and report findings to the Council.
All aye. Motion Carried.
C.F. 8A DETOUR
David Schumann asked that the Council review a safety issue at the detour
intersection of 1:30th Street and Goodview Avenue. Brush at the northwest
corner of the intersection is interfering with vehicles attempting to
access Goodview Avenue. The property will be contacted regarding efforts
to remove the brush.
MISCELLANEOUS
The Council addressed the following:
1. Speed study performed by the Sheriff's Office on 15th Street. Mrs.
Lessard is to be provided with a copy of the report.
Letter from the owner of the Twin Fine Mobile Home Park regarding
their need for an emergency shelter.
Miron made motion, Leroux; seconded, that the Cit-;•, send a letter to
Washington County stating the City .'s concerns with the proposed trail to
be located in the Burlington Northern railroad bed.
