Art and Mary Munger, 5311 165th Street, requested an amended SUP to allow the addition of 320 sq ft of accessory storage at the above address. This would increase the gross area of accessory buildings on the property to 5,568 =q ft, where 3,600 sq fit is allowed by ordinance. The Mungers' property consists of 19 acres zoned conservancy. The Planning Commission consider -ed this request on July 26, 1995, and recommended denial of the request as the property contains accessory buildings greatly exceeding i::.t;e square footage permitted by ordinance. Councilman Leroux felt that because of the large number of contiguous acres owned by Mr. Munger, including an additional 19 acre= parcel contiguous to that subject to the SUE', that the square footage limit was arbitrary, and that the 'SUE' should be granted. Leroux made motion, Miron seconded, to approve the Special Use Permit for Art Munger, 5311 165th Street, to allow the addition of 320 sq ft of accessory storage. All aye. Motion Carried. City Council meeting of August 7, 1995 Page PUS,lIC HEARING (SHORELAND ORDINANCE) A public hearing was held to consider adoption of an ordinance regulating the development of shorelands, and repealing inconsistent ordinances. This is an update of the City's existing shoreland ordinance required by recent changes in State law. Kien Tschida and Jim Merila addressed the Council with brief comments, and the Council discussed their concerns with the proposed ordinance: definitions, mapping, and erosion control. Miron made motion, Leroux: seconded, to table further discussion of the proposed ordinance until the meeting of August 21, 1995. All aye. Motion Carried. SPECIAL IJSE PERMIT (HARL_E:Y . J OHNSC: N , 7 F..._ )... Mr. Harley Johnson, Jr., 14195 Fenway Avenue, requested a SUP to construct a bb' x: 48' pole building at the above address. The property is currently zoned RR1, which allows 1,00 sq fit of accessory building. This property is subject to an existing SUP permitting a 48' x b•?' structure, which is already located on the site. The PC considered Mr. Johnson's request on July ib, 1995, and recommended approval of the SUP subject to special conditions. The property owner may const.ruct and maintain two buildings on the site for the storage and maintenance of equipment and materials related to the permitted business. The buildings may not exceed 3,168SF each. All equipment and mater.i.a.ls maintained on the site related to the business must be stored in the building when not in use. Permitted commercial activity on the site shall include only the cultivation, trucking, and sale of scud. The hours of product sales shall be limited to 7:00 AM to 7:00 PM, Monday through Saturday, and 9 AM to 7:00 PM on Sundays. Trucking of materials and equipment, to and from the site, shall be limited to the hours of 5:00 AM to 10:00 PM, Monday through Saturday. No sod may be hauled onto the site on Sundays. The property owners may maintain and operate two trucks up to 80,000 GVW, but not exceed 9 -ton per aisle when loaded. Sod grown off the site may be stored and sold on the site. The hours of operation contained in this Special Use Permit do not apply to the cultivation of sod on the site or adjacent. property. This Permit supersedes all previous Special Use Permits issued to this property. 9. The haul roads for the business shall be the most direct route from the site along Fenway Avenue and 140th Street to T.H. 61. The property owner shall be responsible for ensuring its agents use these routes. City Council meeting of August 7, 1995 Page _ iii. The property owner shall be responsible for controling dust raised by vehicles traveling_ to and from the business on Fenway Avenue. Control measures that can be used include the application of water, calcium chloride, or other measures approved by the City. Dust control shall be used to limit dust to the public right-of-way. All aye. Motion Carried. VARIANCE (OL.SON ). Mr. Ken Olson, 5577 180th Street, requested a variance to construct a pole shed in front of the dwelling located at the above address. Mr. Olson has indicated that this is the most practical spot to locate the storage shed due to the low drainage area behind His home, the location of the septic system, and his need to access the rear of his property along the east side of the house. Mr. Olson's request was considered by the Board of Adjustments and Appeals on .July 26, 1995, and was forwarded to the City Council without recommendation. Barnes made motion, Leroux seconded, that Mr. Olson submit a more detailed drainage plan and site plan, and the request be forwarded to the Board of Adjustments and Appeals for reconsideration. All aye. Motion Carried. E -:N I NEER MOVE:: Mr. .Joel Dresel, the City's consulting engineer currently employed by L_1S!`i. will be moving_ to the firm Short Elliot Hendrickson . Mr. Thomas Angus. proposed as a possible replacement by OSM, was introduced at the meeting to present his qualifications to the Council. L.aValle made motion, Goiffon seconded, that the City of Hugo appoint Tom Angus to serve as the City's consulting engineer effective upon Mr. Joel. Dresel's end of employment by OSM. A:l.l. aye. PROPOSED STORMWAT ER UTILITY(::iF;I_� I NAPJCE_ The Council reviewed an ordinance establishing a storm water drainage utility for the maintenance of the public drainage system in the City of Hugo, and establishing a mechanism to fund such utility through fees charged to all property owners in the City on a regular and ongoing basis. Staff requested that the Council review the ordinance for comment and establish a public hearing date of September 5, 1995 to consider its adoption. LaValle made motion, Miron seconded, to schedule a public hearing for September 5, 19955 7:05 PM, to consider- adoption of a storm water utility ordinance. All aye. Motion Carried. City Council meeting of August 7, 1995 Page 4 BROWN'S CREEK WATERSHED STUDY The City received a request from BCWMO to contribute $2,400 toward a hydraulic management study of Brown's Creek. On July 17, 1995, the City Council agreed to contribute $200 towards such a study, but also requested that the WMO study the flooding problems adjacent to Lake Plaisted and School Section Lake as part of the study. Staff had concerns that the revised study, as proposed by the WMO, be of sufficient scope to provide information for the future management of the water levels on the landlocked basins in the south eastern portion of the community. Peter Leete, MNDNR. was present and explained trout protection program. Barnes made motion, Leroux seconded, to allocate expenditure of $2,400 toward a hydraulic management study of Brown's Creek on the condition that. the BCWMO provide the City with some assurance that the study be of sufficient scope to provide information for the future management of the water levels of Lake Plaisted and School Section Lake. All ave. Motion Carried. GOOSE HUNTING PROPOSAL FOR BALD EAGLE -he MNDNR received a complaint regarding the number of geese on the north end of Bald Eagle Lake, and the resUltant grazing and fouling of residential property along the shoreline. The DNR informed the City that tl,e most practical method tc, control the goose population in this area wc..,uld be through a special goose I-,unting season, which would occur from September i-11, 1995. Staff telt that the introduction of the special hunting season into this residential area would create concerns from a.di acent property owners. FIRE CHIEF' RECOMMENDATION FOR FIRE FIGHTER SUSPENSION Jim Wisner, Chief of the Hugo, FD, has requested the City consider taking disciplinary action against a fire fighter due to not meeting attendance requirements during the first si.::: months of 1995, under Section 1209 of the Department's SOF'. Fire fighter= are required to respond to at least 35 of the assigned station calls, participate in at least 60 of the scheduled training sessions, and attend 60% of the work drills in any six-month period. The Chief indicates that according to the official records of the Department. the fire fighter has attended only four of 11 scheduled drills and meetings in the second quarter of 1995, for an attendance rate of 36%, and did riot meet the minimum requirements during the first quarter. The Chief requested that the Council suspend the fire fighter from the Department for a period of three months. Attorney Galler stated that because this was a personnel matter, it should be considered confidential, and discussed in a closed session of the City Council. City Council meeting of August 7, 1995 Page 5 PRIORl'TY REVIEW ANP UPDATE Staff requested that the Council establish a date for a workshop to conduct an in -progress review of the work being performed on City priorities for 1995, and to begin discussion of Council priorities for 1995, as a beginning to the City's budget development process. The Council also indicated previously that they wished to conduct a biannual review of the City Administrator's job performance. LaValle made motion, Leroux; seconded, to schedule a. special meeting of the Hugo City Council for August 22, 1995, at 7:30 PM, to discuss priorities for 1995 and 1996, biannual review of the City Administrator's job performance, interview applicants for maintenance supervisor, and conduct the Fire Department disciplinary hearing for the fire fighter referenced above. All aye. Motion Carried. Di_ W T ON RE-:DEVEL._OP ENT Due to the development activity starting to occur in the City's downtown area along T.H. 61, near C.R. 8, the Mayor requested that discussion of creation of a redevelopment district for the .area be discussed by the Council., Leroux made motion, LaValle seconded, to schedule a workshop for August 28, 1995, at 7:30 PM, to discuss establishment of a redevelopment district for the downtown area of the City of Hugo. All ave. Motion Carried, Miron made motion, Leroux; seconded, authorizing the City Engineer to provide a legal description for a future site for the Post Office, at a Cost not to exceed $2,000. All aye. Motion Carried. L t.*..E E!....AI:STFP SI:GNl The Cit;: was informed of "NO BOAT LAUNCHING" signs that had been placed adjacent to Lake Plaisted. The City Council had approved NO PARKING signs, but no approval was granted for the boat launching signs. Miron made motion, LaValle seconded, that the City have the NO BOAT LAUNCHING signs removed from 140th Street adjacent to Lake Plaisted. All aye. Motion Carried. LETTER FROM CARL ZIEGLER The City received a letter from Carl Ziegler inquiring why property owners are not notified of the result of Board of Review. City Council meeting of August 7, 1995 Page b Miron made motion, Leroux seconded, directing the City Administrator write Mr. Ziegler explaining City/Washington County policy/ for the Board of Review. All aye. Motion Carried. LETTER FROM DARRELL GRANGER The City received a letter from Darrell Granger regarding the unsightliness of the access road located north and east of T.H. 61 and 148th Street. Miron made motion, Goiffon seconded, directing_ City staff to review the site and make a. recommendation at the Council meeting of August 21, 1995, All aye. Motion Carried.
