The meeting was called to order by Mayor Fran Miron at 7:00 PM.

Leroux made motion, Goiffon seconded, to adopt the following Consent
Agenda:

The foregoing Consent Agenda was adopted unanimously.
Barnes made motion, Leroux seconded, to approve the minutes for the
regular City Council meeting of August 21, 1995, as amended.
All aye. Motion Carried.
PUBLIC HEARING (STORM WATER DRAINAGE UTILITY)
A public hearing was held to consider an ordinance establishing a storm
water drainage utility for the maintenance of the public drainage system.
There were no oral or written comments regarding this matter. After a
long discussion regarding methods available to the Council secure
financing, as well as costs associated with the City billing residents,
the following motion was made:
Leroux made motion, Barnes seconded, to table action on this matter until
the Council meeting of September 18, 1995 to determine if Washington
County would be able to include the billing on tax statements.
All aye. Motion Carried.
SHORELAND ORDINANCE
On August 7. 1995, the City Council conducted a public hearing regarding
the adoption of a revised ordinance regulating the development of
shorelands and repealing inconsistent ordinances. At the hearing, the
Council discussed the need to include a map with the ordinance indicating
those water bodies being controlled by the ordinance, renumbering of the
tables, and some grammatical corrections. The City Attorney received a
letter from Gerald Duffy, attorney representing Grace Development (Woods
of Bald Eagle), asking for delay in action on this ordinance. The Council

reviewed the ordinance, and had minor changes they wanted made to the
draft ordinance.
Leroux made motion, Goiffon seconded, to adopt ORDINANCE 95-305, AN
ORDINANCE REGULATING THE DEVELOPMENT OF SHORELANDS AND REPEALING
INCONSISTENT ORDINANCES.
VOTING AYE: Goiffon, LaValle, Leroux, Miron
VOTING NAY: Barnes
Motion Carried.
City Attorney Galler is to respond to Mr. Duffy notifying him of Council
action.
BROWN'S CREEK STORMWATER MANAGEMENT PLAN
The City Engineer is currently investigating the feasibility of
establishing managed outlets from the Plaisted/School Section/Goggins Lake
area, as well as the large pond currently flooding July Avenue. In
addition, he is reviewing the feasibility of the City taking emergency
measures to lower the water elevation of these water bodies. Pete
Willenbring of OSM reported his findings for Council review. After a long
discussion, it was determined that because of the number of governing
agencies involved, and permits needed to be obtained prior to any release
of water, there would be no "immediate" solution to the flooding problems.
Miron made motion, Goiffon seconded, directing the City Engineer to
prepare a fact sheet of information known in the flooding situation and
provide it to Grant Township, May Township, and the Brown's Creek WMO.
The City Administrator shall prepare a letter, for City Council approval,
for submission to Washington County, requesting the County's assistance to
find a solution to the flooding problems considering that the drainage
area crosses City and Township boundaries.

HOMESTEAD AVENUE POND OUTLOT FEASIBILITY REPORT
The City Attorney stated that he had heard from Jim Brevig's attorney
regarding this matter, and that he had asked that the Council deter any
action on this matter until he had addressed the Council. Pete
Willenbring from OSM has done all the research relative to this matter.
The Council discussed options available to relieve the drainage problem on
the Waller property, as well as how the project could be paid for through
assessments.
Leroux made motion, Goiffon seconded, directing the City Engineer to
provide a cost estimate to drain the area with a drain -tile system along
County Road BA, and contact Washington County for any comments they may
have on the proposed project. Greg Galler shall notify Mr. Brevig's
attorney of the action taken by the City Council.

PROPOSED 1996 LAW ENFORCEMENT CONTRACT
The City received the proposed law enforcement contract from Washington
County for 1996. The County proposes increasing the contract cost by 8.8%
over the 1995 cost. Staff does have some concerns regarding changes to
the agreement; specifically, the County is reducing the number of hours
credited to the City as transportation time for officers traveling between
Stillwater and Hugo at shift changes, and the County intends to purchase
squad cars in the future, charging the City a straight per -hour rate. The
City's finance director prepared a review of the contract for Council
consideration.
Miron made motion, Leroux seconded, directing the City Administrator send
a letter to Sheriff Jim Frank stating the City's dissatisfaction with the
proposed Contract, citing the particulars, and ask that Sheriff Frank
attend a Council meeting to discuss these issues.
All aye. Motion Carried.
WASHINGTON COUNTY COST PARTICIPATION POLICY
Washington County Department of Public Works prepared a policy regarding
cost sharing in joint city and county street projects to include
signalization of intersections, widening streets, construction of bike
paths and sidewalks, and other matters. The proposed policy has been
reviewed by the City Engineer and his comments were provided to the
Council for their consideration. A letter prepared by staff in response
to the County's proposed policy was presented the Council for approval.
Leroux made motion, Barnes seconded, that City staff forward the letter,
as drafted, to Washington County with City comments.
All aye. Motion Carried.
ADMINISTRATOR'S PERFORMANCE REVIEW
A performance review of the City Administrator was scheduled for August
22, 1995, but due to a lack of time, was not accomplished. The Council,
individually, commented on the Administrator's job performance.
BUDGET WORKSHOP
Staff proposed that the City Council establish September 11, 1995 as a
special Council meeting date to conduct a budget workshop in order to
determine the City's maximum tax levy for 1996.
Leroux made motion, Goiffon seconded, to recess tonight's meeting at 11:00
PM until September 11, 1995, at 7:30 PM, to conduct a budget workshop.
