PRESENT: Barnes, Goiffon, LaValle, Leroux. Miron , City Administrator, Robert Museus City Attorney, Greg Galler City Engineer, Tom Angus City C1erk,'Mary Ann Creager ADD TO TONIGHT'S AGENDA Discussion of Lake Air Estates drainage Discussion of C.R. 8A project General correspondence LaValle made motion, Barnes seconded, to adopt the following Consent Agenda: Minutes for the City Council meeting of September 13, 1995 Minutes for the City Council meeting of September 18, 1995 Letter Regarding Parking at Subway's Award gravel bid to Valley Paving for a project cost of X24, =7o.oO Reduce Oneka Estates Letter of Credit to $102,000.00 The foregoing Consent Agenda was adopted unanimously. The Council discussed the payment of $271.�►66.69 for the C.R. SA project. Councilmember Barnes felt that payment should be withheld until the road is further improved to make it more passable. Barnes made motion, Leroux; seconded, to withhold payment to Washington County for the C.R. 8A project until such time as more extensive improvements are made to the road. COUncilman LaValle did not feel it was appropriate to withhold the funds because the County was making every effort to make sure that the contractor was performing, and withholding the payment may damage the City's relationship with the County. Barnes and Leroux; withdrew their motion. Miron made motion, Goiffon seconded, to approve the claims for October 22, 1995. in the amount of $297.086.27. All aye. Motion Carried. 1.995/96 SNOWPLOWING AGREEMENT The City received a quote from Keith Greenwaldt for removing snow from City -owned parking lots and sewer substations. Mr. Greenwaldt will charge $42.50 per hour, including labor and equipment. This is the same price charged for 1994/95 season. Staff recommended retaining Mr. Greenwaldt to perform such work. Councilman LaValle felt that the maintenance employee could take care of the City's plowing needs, as a new truck needs to be purchased in the near future. It was determined to hire Mr. Greenwaldt for another year to allow time for the City to purchase a vehicle. City Council meeting of October 2, 1995 Page 2 Miron made motion. Leroux, seconded, to contract with Keith Greenwaldt for the 1995/96 snowplowing of City -owned property at a cost of $42.50 per hour. The 1996/97 snowplowing will be performed by City employees. All aye. Motion Carried. HEARING ON PETITION TO VACATE A PORTION OF 128TH STREET A public hearing was held to consider the request of Wilson Tool International to vacate an 80' easement, known as 128th Street. from the west side of T.H. 61 to the east line of Farnham Avenue, and from the west line of Farnham Avenue to the east line of Falcon Avenue. Wilson Tool is the property owner on both sides of the easement, which runs across their proposed parking lot and a DNR protected wetland. The City's current street plan for that area does not include construction of 128th Street, nor its connection to T.H. 61. Staff recommended approval of the vacation. Mr. Tom Emery, representing Wilson Tool, was present stating Wilson Tool's reasons for the request: aid in their future growth and planning purposes, and use easement for additional vegetation and buffer from adjoining residential property. The Council was reluctant to vacate this easement without having an alternate access to T.H. 61, and because easement abuts wetlands, the DNR will need to be notified of this vacation process. Leroux made motion. Miron seconded, to table this matter to allow time to notify the DNR of the vacation process, and placed on the Council agenda after receipt of their comments. All aye. Motion Carried. PETITION OF LOCAL IMPROVEMENT OF 177TH STREET The City received a petition from owners of not less than 35% in frontage of the real property abutting on 177th Street, between the east line of Greystone Avenue, and the west line of Henna Avenue, requesting that the road be paved pursuant to Minnesota Statutes, Section 429. In accordance with the Statute, staff recommended that the City Council adopt the resolution declaring the adequacy of the petition and ordering the City Engineer to prepare a feasibility report for the project. The Council discussed the following in conjunction with this request: 1. Include a short section of Greystone in the project to connect the road to 177th Street, west of Greystone? 2. Construct street in compliance with City standards? 3. How extensive a feasibility report is necessary for the project? 4. Safety/ of 90 degree curve on Greystone. Leroux made motion. Goiffon seconded, to adopt RESOLUTION 1995-14, A RESOLUTION DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT FOR IMPROVEMENT OF 177TH STREET THROUGH RECONSTRUCTION TO THE CITY'S PAVED 9 -TON RURAL STANDARD, INCLUDING CONNECTION ALONG GREYSTONE AVENUE TO 177TH STREET WEST OF GREYSTONE AVENUE. VOTING AYE: Barnes, Goiffon, LaValle, Leroux, Miron Motion Carried. City Council meeting of October 2, 1995 Page 3 PETITION FOR ESTABLISHMENT OF PUBLIC PARK. IN THE RICE LAKE MEADOWS SUED Residents of Rice Lake Meadows presented the Council with a petition of 53 names requesting that a public park be established in their neighborhood. Miron made motion, Leroux seconded, directing City staff to refer the petition to the Planning Commission for their review during deliberations of the PUD for Rice Lake Meadows. All aye. Motion Carried. REQUEST TO USE COUNTY RIGHT-OF-WAY BY SNOWMOBILES Ms. Julie Schneider of the Star Trail Association appeared before the Council regarding the use of the County right-of-way, along the old BN railroad tracks, for use by snowmobilers during the upcoming snowmobile season. It was the consensus that use of the County right-of-way by snowmobiles was not an appropriate use. LaValle made motion. Barnes seconded, that a letter be sent to Washington County stating that the City of Hugo is opposed to the use of the County right-of-way, along the t -r* old BN railroad tracks, as a snowmobile trail. All aye. Motion Carried. RESOLUTION DECLARING MINIMUM MAINTENANCE ROAD The City's 1995 graveling plans includes placing gravel on a stretch of Everton Avenue south of 165th Street. This road is used to gain access to agricultural property, and has not been constructed to established City standards. In order to avoid the City acquiring additional liability for this roadway, and to notify the public that this easement will not be maintained to usual City standard, staff recommended that the Council adopt a resolution declaring Everton Avenue, from the south line of 165th Street to a point approximately 1/4 of a mile to the south, a minimum maintenance public road, in accordance with Minnesota Statutes, Section 412.62i1. Miron made motion, Goiffon seconded, to adopt RESOLUTION 1995-15, A RESOLUTION ESTABLISHING A MAINTENANCE STANDARD FOR EVERTON AVENUE SOUTH OF 165TH STREET. VOTING AYE: Barnes, Goiffon, LaValle, Miron ABSTAINED: Leroux Motion Carried. HOMESTEAD AVENUE POND REPORT As directed by the City Council, the City's Engineer and Finance Director prepared a proposed assessment roll, under Minnesota Statutes, Section 444, for constructing a drainage system to pipe water from the Homestead Avenue Pond and along the south line of the Waller property. The Council had previously indicated a desire to establish a public informational meeting for residents subject to the assessments. Mayor Miron questioned the cost of the tiling project, and suggested that the City obtain bids. City Council meeting of October 2, 1995 Page 4 Miron made motion, Goiffon seconded, directing City staff to obtain a bid to install tile from the Homestead Avenue pond along the south line of the Waller property, prior to setting a public informational meeting. All aye. Motion Carried. At this time, City Engineer Tom Angus introduced Todd Hubmer, who is replacing Pete Willenbring at OSM. COMPLAINT REGARDING NOISE AT LOCAL BUSINESS The City received a complaint from a resident living adjacent to RJ's regarding loud music on the site. This is the second complaint from the resident. The Washington County Sheriff's Department has also indicated an interest in receiving prior notice on entertainment events happening in the community. The City of Hugo currently does not have an ordinance requiring permits for special events conducted in the "open" or off site. The Council may wish to consider the adoption of an ordinance regulating special events in the community. Leroux made motion, LaValle seconded, directing Citi staff determine the feasibility of incorporating open or off-site special events with issuance of liquor licenses. All aye. Motion Carried. 1995 PRIORITIES The Council received a revised City's Priority Worksheet, as amended based on comments received from the Council. Staff requested that the Council complete the worksheets by October 16, 1995, and establish a date for a workshop shortly thereafter to consider the City's 1996 priorities. No further action was taken. LAKE AIR ESTATES DRAINAGE PROJECT The City Engineer received one quote ($46,000) to perform the drainage work. at Lake Air Estates. Because of the cost of project, it was determined that the City should obtain bids, and consider assessing the project for improvements rather than paying for it out of general funds. Miron made motion. Barnes seconded, authorizing the City obtain firm bids for the Lake Air Estates drainage problem for opening on November 3. 1995, and presented to the Council at their meeting of November 6, 1995. Miron made motion, Leroux seconded, amending_ the motion to include two options for the project: cleaning ditch or installation of drain tile. VOTE ON AMENDMENT: All aye. Motion Carried. VOTE ON ORIGINAL MOTION: All aye. Motion Carried. City Council meeting of October 2, 1995 Page 5 CORRESPONDENCE The City received a letter from Louann Lindbeck with an offer to install a park bench, bike rack, or other similar items, at no cost to the City, as part of an American Education Week Project. Miron made motion, LaValle seconded: directing City staff to address the letter from Ms. Lindbeck and request installation of a bike rack in the City's park adjacent to City Hall. Al� aye. The City received a letter from Scott Neamy requesting an official document from the City giving permission to the Sunshiners 4H Club to proceed with the restoration project at the Walker Cemetery. Miron made motion. Leroux seconded, directing City staff to address the letter from Scott Neamy and forward a copy of the City ordinance regulating cemeteries within the City. All aye. Motion Carried. MISCELLANEOUS Wally Stoltzman addressed the Council regarding a request from the owner of the Twin Pine Mobile Home Park for a speed study on T.H. 61 in front of the Park:. The City Administrator will follow up on the request and report at the next Council meeting. The intersection of T.H. 61 and 145th Street needs minor maintenance for pedestrian traffic. The City Administrator will inspect and report. Bill Wunderlich addressed the Council requesting that a public access be provided to School Section Lake.
