Ler-oU: made motion, Barnes seconded, to table approval of the Council minutes for November S. 1995 for resubmittal after changes are made. All. aye. Motion Carried. MINOR SUBDIVISION (S1"EDT} Dean and Rosalie Stedt. 7416 132nd Street, and Lorraine St. Sauver, 1812 Birch St, W8L, MN., have applied to subdivide a 20 -acre parcel into one 1_'.1 -acre parcel and one 6.9 -acre parcel, all located in the SW 1/4 of Section 27, T31N, R21W. Though the 6.9 -acre parcel proposed does not meet the standards of the City's zoning ordinance, the Planning Commission recommended approval of the subdivision since the two parcels are already geographically separated by a separate .30 -acre parcel owned by the applicants. The PC recommended approval of the subdivision at their meetinq of November 15, 1995, subject to the condition that Parcel C (6.9 i cres) be adjusted to include 200 ft of road frontaae on 1.=2nd Street. The property line between Parcels B and C to be adjusted to provide a total of 10 acres for Parcel C, and waiver of the park•:.1and dedication fee. Miron made motion. LeroUX seconded. directing the Cit -v Attorney to prepare z:. Findings of Fact to permit a variance for road frontage and an Agreement to limit the future housing density for 1=.1A parcel to one Unit. All aye. Motion Carried. APPLICATION FOR SNOWMOBILE ROUTE The Washington County Star Trail Association applied for Use of the County trail. right-of-way adjacent to TH 61 from CR 8 north to Forest Lake City Council meeting of November 20. 1995 Page 2 Township as a snowmobile route. Their application is in compliance with Hugo City Code, Chapter 180-10, except that an operations and maintenance plan was not provided by the Association. In addition, the map provided by the Association for the trail system in Huqo includes the section of CR BA between TH 61 and Goodview Avenue, which was recently improved by the addition of curb and gutter, and sidewalk:. This section of BA is not currently a permitted snowmobile route approved by the City. Nora Gallmeyer and Pat Goulette appeared before the Council stating actions the Club has taken to obtain approval of landowners for the use of 130th Street as a trail to TH 61. Leroux made motion, Miron seconded, that a letter be forwarded to Washington Council stating that the City of Hugo has no objection to the use of the County Trail right-of-way from CR 8 to the north County line by snowmobilers durinq the 1995/96 winter season. The preferred alternative for routing snowmobile traffic from CR 8A to the County trail shall be over Egg Lake on the "sumac trail". VOTING AYE: Goiffon, Leroux, Miron VOTING NAY: Barnes and LaValle Motion Carried. BROWN'S CREEK. JOINT POWERS AGREEMENT With Washington County Commissioner, Dennis Hegberq, present, the Council reviewed the proposed amendment to the Joint Powers Agreement establishing the Brown's Creek WMO. The amendments provide greater authority to the Organization to undertake improvement projects, and provides the Organization authority to levy ad valorem property taxes. The City Administrator and Attorney agreed that the Agreement was "too preliminary" and required additional wort:.. Miron made motion, Goiffon seconded, directing City staff to prepare a letter to the BCWMO on the proposed Joint Powers Agreeement, and present it to the Council for approval at their meeting of December• 4, 1995. All aye. Motion Carried. DEVELOPMENT AGREEMENT (WOODS OF' BALD EAGLE) The Council reviewed the proposed Development Aqreement between the City of Hugo and Grace Development Corporation for the subdivision known as the Woods of Bald Eagle. After a lengthy discussion of the Agreement, and requested changes, the following motion was made: Barnes made motion. LaValle seconded, to approve the Development Agreement for the subdivision known as WOODS OF BALD EAGLE, between the City of Hugo and Grace Development Corporation, as amended. All aye. Motion Carried. FINAL PLAT_ WOODS OF BALD EAGLE) LaValle made motion, Goiffon seconded, to approve the final plat of WOODS OF BALD EAGLE, subject to changing the name of 127th Street/Europa Avenue to Europa Blvd. All aye. Motion Carried. City Council meeting of November 20, 1995 Page FIFE HALL REPORT The Council reviewed the recommendation of the citizens` committee appointed to determine the needs for a new Fire Hall in the community, as well as separate information provided by the City Administrator and the Fire Department. Committee chairman, Wally Stoltzman, was present statinq that there was a strong difference in opinion on the best way to resolve the existing housing problem. LeroUx made motion, Barnes seconded, to table action on the Fire Hall report until the Council meeting of December 18, 1995 to allow members of the Committee to provide additional comments, if they desire. All aye. Motion Carried. LaValle made motion, Barnes seconded, to accept the report of the Fire Hall Needs Committee, thanking them for their time and effort to serve the community. All aye. Motion Carried. OAK -.SHORE PARK FEASIBILITY REPORT The Council received the City Engineer's feasibility report for the construction of improvements inclUdinq sewer, water, storm sewer, and streets for the Oakshore Park subdivision, as well as a stretch of Ethan Avenue south to 1^_'nd Street. Barnes made motion, Goiffon seconded, to adopt RESOLUTION 95-20, A RESOLUTION RECEIVING REPORT AND CALLING HEARING ON IMPROVEMENT FOR THE OAk::SHORE PARK. SUBDIVISION. VOTING AYE: Barnes, Goiffon, LaValle, Leroux, Miron All aye. Motion Carried. Miron made motion, LaValle seconded, directing City staff to schedule an informational meeting with Oakshore Park residents prior to the public hearing of January 8, 1996. All aye. Motion Carried. F..".LMCREST AVENUE SPEED LIMIT The City Council requested that. MNDOT conduct a speed study on Elmcrest Avenue, between 129th Street Arid CSAH 8. Their report recommends that three speed zones be established on this stretch of Elmcrest Avenue at 7.5 mph, 40 mph, and 45 mph. Miron made motion, LeroUX seconded, to adopt RESOLUTION 95-21, A RESOLUTION CALLING FOR THE POSTING OF SPEED LIMITS ON ELMCREST AVENUE BETWEEN 129TH STREET AND CSAH 8. VOTING AYE: Barnes, Goiffon, LaValle, LeroU.;, Miron Motion Carried. City Council meeting of November 4, 1995 Page 4 LETTER (ATKINSON) The Council received separately a letter from the attorney representing Dean and Ruby Atkinson regarding their Mining Permit application. The letter requests that the Council meet with the Atkinsons and their attorney prior to conducting a public hearing on the application. The attorney is to be notified that Mayor Miron and Councilman Leroux: are willing to meet with them. LETTER (SCHUMANN) At the last Council meeting, the Council received a recommendation from Dave Schumann that, as part of all Development Agreements, the City should require the developer to provide a disclosure statement providing purchasers of residential lots information on land -use limitations on the property being purchased, as well as plans for future development in the area. After discussion, the Council determined that the Statement would place unnecessary additional burden on City staff, and not be implemented. LETTER (WILSON TOOL) The City Council received an invitation from Wilson Tool International to visit their facility in Hugo, and see a demonstration of products produced. The invitation would also include a meal. A tour of this business would be beneficial to Understand how Wilson Tool fits into this community and what their needs are. Accepting the meal would be in violation of State law. Miron made motion. Goiffon seconded, directing City staff to schedule a site visit with Wilson Tool in late January, 1996, with a "Dutch treat" dinner option. All aye. Motion Carried. COMPREHENSIVE PLAN REVISION On November 15, 1995, the Planning Commission recommended adoption of the revised Comp Plan previously received by the Council with the following revisions: 1. Property owned by the Waller's, along Homestead Avenue, be placed in the City's agriculture district. . The boundary line between the urban and rural service areas be adjusted along Oneka Lake Boulevard to the center of this roadway omitting property to the ea=_•t of Oneka Lake BoUlevard from the Urban service district. _. The urban preserve district be extended to the south around Oneka Lake, but retaining the area adjacent to the Peloquin Industrial Park in the urban service district. Staff recommended that the Council establish a workshop to d1SCUSS the Plan with the planning consultant. City Council meeting of November 20, 1995 Page 5 Miron made motion. LaValle seconded, to schedule a Council meeting for November 28, 1995, at 9:20 AM, to discuss the revised Comprehensive Flan and the proposed 1996 budget. All aye. Motion Carried. ANIMAL CONTRACT LaValle made motion, Leroux seconded, to place the Animal Control Contract on the December 4, 1995, Council agenda. All aye. Motion Carried. ROGER DUFAUL Councilman LaValle stated that he had received a certified letter from Norm Horton, Sr., regarding possible litigation. Miron made motion, LeroUX seconded, to table this matter until the meeting of December 4, 1995, to allow time for review by the City Attorney. All aye. Motion Carried. CITY ENGINEER'S REPORT Mr. AngUS updated the Council on the following: emergency access for Oneka Estates via the Linden driveway. 134th Street railroad crossing_. and stop sign locations for 140th Street.
