PRESENT: Barnes, Goiffon, LaValle, Leroux, Miron City Administrator, Robert Museus City Attorney, Greg Galler City Engineer, Tom Angus City Clerk, Mary Ann Creager ADDITIONS TO AGENDA Public Hearing for Off Sale Liquor License (Oneka Ridge) Update on Meeting with May Township Meeting with Representative from Wilson Tool Animal Control Contract Discussion on Modern Recycling General Correspondence Miron made motion, Leroux seconded, to adopt the following Consent Agenda: City Council Minutes for November 8, 1995 City Council Minutes for November 20.. 1995 City Council Minutes for November 28, 1995 Letter - Brown's Creek Joint Powers Agreement Vehicle Purchase Letter requesting Joint Meeting with Rice Creek Watershed District All aye. Motion Carried. Councilman Leroux questioned certain claims for repairs to fire trucks. The Council requested an itemization of recent repairs to the City's fire trucks. Leroux made motion, Goiffon seconded, to approve the claims for December 4, 1995, in the amount of $53,977.69. All aye. Motion Carried. SPECIAL USE PERMIT (MCELMURY). Mr. Robert McElmury, 1923 Stillwater St., White Bear Lake, requested amendment of the special use permit for Bobber's Boat and Bait, 4444 1.29th Street North, to allow the business to operate during the winter months. This would include the rental of portable and permanent fish houses, and to provide lake access from 129th Street, and to sell bait, snacks, and =.2 beer. The Planning Commission conducted a public hearing on the proposed SUP amendment on October 25, 1995, and, again, considered the request on November 15, 1995. The Planning Commission recommended denial of the ASUP due to Bobber's Boat and Bait not beinq in compliance with the SUP, and concerns that additional traffic entering the lake at this point would pose a safety hazard. Attorney Greg Galler concluded that the City could not legally approve an ASUP because the proposed use is not allowed in the conservancy zoning district. Council member Debra Barnes stated that the report of the City Engineer indicated that access to Bald Eagle Lake during the winter months would not be a safety problem at this location, which is not in conformance with the recommendation received from the Planning Commission. City Council meeting of December 4, 1995 Page 2 Barnes made motion, LeroUX seconded, to deny the request of Robert McElmury for an amended Special Use Permit for Bobber's Boat and Bait, 4444 129th Street, to allow the business to operate during the winter months. The reasons for denial are to be outlined by the City Attorney in a Findings of Fact and submitted to the Council for their approval. All aye. Motion Carried. FINDINGS OF FACT (STEDT) On November 20, 1995, the City Council reviewed the findings and recommendations of the Planning Commission on the request of Dean and Rosalie Stedt, 7416 132nd St., to subdivide a 2C> acre parcel into one 13.1 acre parcel and one 6.9 acre parcel, all located in the SW 1/4 of T31N, R21W. The Council directed the City Attorney to prepare Findings of Fact and an Agreement between the City and the Stedts to limit the future housing density for the 1..3.1 acre parcel. The requested documents were submitted to the Council for their review. LaValle made motion, Barnes seconded, to approve the Findings of Fact, between the City of Hugo and Dean and Rosalie Stedt, limiting the future housing density for the 13.1 acre parcel. All aye. PUBLIC HEARING OFF' , SALE L.^I ()UOA LICENSE .FOR _ONEKA RIDGE GOL _F COURSE) The Oneka Ridge Golf Course requested a new Off Sale Liquor License to sell liquor at their golf course site. A public hearing was scheduled for tonight's meeting, and there were no oral or written comments. Leroux made motion, Goiffon seconded, approving an Off S'ale Liquor License for Oneka Ridge Golf Course, 5610 120th Street North, to expire on 12/1/96. All aye. Motion Carried. LETTER FROM NORM HORTON The City received a certified letter from Mr. Norm Horton, 10.3.0 Manville Ave., St. Paul, regarding his concerns with the City's handling of the Auto Recycling application of Modern Recycling, and, also, complaining of the treatment he received from the City Administrator. The Council directed the City Attorney to review the letter and determine if there is any potential liability problem for the City in this matter. 'The Council received the Attorney's opinion by separate correspondence. It was determined that no formal action was required. OAKSHORE PARK' HOME OWNERS' REQUEST The residents of the Oak Shore Parti: Subdivision requested a meeting of the Council to discuss the following issues: City Council meeting of December 4. 1995 Page _ 1. The City's purchase of the OSP homeowners' parkland. 2. The allocation of costs for the public improvements to the subdivision. 3. The possibility of reducing the SAC. WAC, and REC charges made when homes hook up to public utilities. They have proposed a meeting be held prior to the public hearing for the improvements scheduled for January 8, 1996. LeroUX made motion, Goiffon seconded, to schedule a special City Council meeting for December 27, 1995, at 7:30 PM, to discuss issues regarding improvements in the Oakshore Park. subdivision. All aye. Motion Carried. ELMCREST AVENUE STOP SIGNS At the request of an adjacent property owner, the City of Hugo petitioned MNDOT to conduct a speed study of Elmcrest Avenue, between 129th Street and CR S. As a result of the study, speeds were reduced on this stretch of road. MNDOT also recommended that the City place STOP signs at the intersection of Elmcrest Avenue and Cedar St. The City Engineer has reviewed this situation, and recommended placement of STOP signs at Elmcrest and Cedar Street. Mir -on made motion, Leroux seconded, directing City staff to have STOP signs installed for south bound traffic on Elmcrest Avenue at the intersection of 129th Street and at Cedar Street. "Stop Ahead" signs should also be placed 5(--)(-) feet prior to the STOP signs at each intersection. All aye. Motion Carried. APPOINTMENTS TO HARDWOOD CREEK. TRAIL COMMITTEE The County's public works department requested that the City of Hugo appoint three members to a committee to evaluate the findings and recommendations of the development plan for the Hardwood Creek Trail (abandoned BN Railroad right-of-way). Lerou:: made motion, Goiffon seconded, to appoint Council members Debra Barnes and Fran Miron, as well as Planning Commissioner, David Schumann, to the Hardwood Creek Trail Committee. All aye. Motion Carried. PLANNING COMMISSION APPOINTMENTS The City Council will need to appoint two Planning Commission members in January, 1996. One appointment will be for a one-year period to replace Tammy Miltz-Miller, who resigned. The second position is to fill the seat currently held by Ken Rubenzer, which expires 12-31-95. Mr. Rubenzer has indicated an interest in continuing to serve on the Planning Commission. The City has also advertised the vacancies and received two applications. City Council meeting of December 4, 1995 Page 4 Fast practice of the City has been to appoint a committee of one Planning Commission member, one City Council member, and the City Administrator to interview candidates, and recommend to the Council individuals for appointment to the PC. Miron made motion, LaValle seconded, that the following be appointed to serve on a committee to interview applicants for the Planning Commission vacancy: Jim LeroUX, Teddy Peltier, and Robert MUseus. All aye. Motion Carried. PROPOSED TELECOMMUNICATIONS ORDINANCE The Council considered an ordinance governing the construction, installation, operation, repair, maintenance, removal, and relocation of telecommunications equipment in the City. This ordinance was prepared by the City Attorney based on a model recommended by the League of Minnesota Cities. This ordinance would regulate cable and other telecommunication companies activities within City rights-of-way. The ordinance provides the City greater authority to ensure that construction sites are properly restored. It was suggested that the ordinance cover all utilities, and that the Citi Engineer offer his comments. Miron made motion, Goiffon seconded, to schedule a public hearing for February 1996, at 7:05 PM. to consider the proposed telecommunications ordinance. All aye. Motion Carried. PERFORMANCE REVIEW Staff requested guidance on the process preferred by the City Council for conducting the annual performance review of the City Administrator. In the past, the Council received worksheets that were tabulated by the City Attorney's office, and scheduled a block of time to formally review and comment upon the Administrator's job performance. The Attorney will forward new worksheets, as well as the worksheets from the last review, to the Council. Leroux: made motion, LaValle seconded, that the performance review for the City Administrator be conducted at the special Council meeting of December 27, 1995. All aye. Motion Carried. DECEMBER 7TH COUNCIL WORKSHOP The City Council met on November 28, 1995, to review the proposed Comprehensive Plan recently recommended by the Planning Commission. The Council was not able to complete its review of the document at that time, and discussed meeting again on December 7th, 1995. If the Council desires to conduct such a meeting, then this evening's meeting should be recessed until 9:.30 AM. December 7th, 1995. City Council meeting of December 4, 1995 Page 5 MAY TOWNSHIP MEETING Administrator Museus gave a brief report of the recent meeting with May Township regarding flooding problems in our communities. WILSON TOOL LaValle made motion, Goiffon seconded, to schedule a special meeting of the Hugo City Council for January 25, 1996, at 7:30 PM, to meet with representatives of Wilson Tool to tour their place of business. All aye. Motion Carried. ANIMAL CONTROL CONTRACT LerouX made motion, Barnes seconded, to table action on the revised Animal Control Contract until December 18, 1995. All aye. Motion Carried. GENERAL_ CORRESPONDENCE There has been general discussion regarding a possible dinner meeting with the RCWD on January 17, 1996, at the White Bear Country Inn. This matter will be discussed further at the Council meetinq of December 18, 1995. The Cit;: received a letter from WBL Area Public Schools requesting that the City assist them in the development of a District 64 Comprehensive Development Plan. Miron made motion, Lerou:; seconded, that the City Administrator assist the WB school district in their efforts to develop a Comprehensive Development Plan. All aye. Motion Carried. MODERN RECYCLING At this time, Modern Recycling does not have a license to operate in the City of Hugo. Attorney Galler stated that a Washington County deputy investigated the site, and reported that business was being conducted a usual. It was Attorney Galler's recommendation that leoal action be started to stop Modern Recycling from conducting business until they obtain a license from the City. Barnes made motion, Miron seconded, authorizing the City Attorney to start legal action against Modern Recycling to prevent them from conducting business until they obtain a license from the City. All aye. Motion Carried. CARNELIAN MARINE WATERSHED VACANCY The City received notice that a vacancy exists on the Carnelian Marine Watershed District, the term to expire on June 21, 1996. Because the City Council meeting of December 4, 1995 Page 6 area of land in Hugo lying within this District is so small, the Council asked that staff send a letter to each resident seeking someone interestec in filling the vacancy. LETTER TO LUCIE SCHWARTZ LeroUX made motion, Goiffon seconded, to approve the draft letter to Lucie Schwartz to quit claim property to the City, as well as authorization to convey property to James Olson without the need for subdivision. All aye. Motion Carried. J I M VI ELL I SON Mr. Jim K.'ellison. 4394 129th Street, requested that the Council consider inclUding the area in which he lives in the improvements being proposed for the Oakshore Park. subdivision.
