HomeMy WebLinkAbout2011.06.23 PC MinutesMINUTES HUGO PLANNING COMMISSION June 23, 2011 Call to Order Chairman Schumann called the meeting to order at 7:00 p.m. PRESENT: Arcand, Gwynn, Kleissler, McRoberts, Rosenquist, Schumann ABSENT: Moore ALSO PRESENT: Bryan Bear, Community Development Director Dennis Fields, Community Development Assistant Rachel Juba, Planner Approval of Minutes of April 28, 2011 Arcand made motion, Gwynn seconded, to approve the Planning Commission minutes of April 28, 2011. All Ayes, Motion carried. Luedeke — Interim Use Permit for a Home Occupation Planner, Rachel Juba, gave the background to the Planning Commission. She explained that the applicant was asking for an Interim Use Permit to allow a home occupation at 17627 Henna Ave N. The home occupation was for a motor vehicle repair business on the property. Rachel explained the impacts, general standards, and conditions for approval of an IUP. Staff did not find that it met the spirit and intent of the ordinance or character of the area. Staff recommended Denial of the IUP request. McRoberts asked the size of the accessory buildings. Rachel answered that there are no restrictions on size and number of buildings on property greater than 20 acres in agricultural zoning districts. Schumann opened the Public Hearing. The applicant, Terry Luedeke, explained the business to the Planning Commission. He told the Commission that he does not advertise, and feels that it is a good fit in his neighborhood. He explained that there were many other businesses in the area along Henna Ave N and that he isn't adding a problem. He mentioned that his business is unique in that there are no mechanics that will work on larger equipment in the area. He let the Planning Commission know that he pays a share for the snow plowing, grading, gravel, and chloride on the shared driveway. Planning Commission Minutes — June 23, 2011 Page 2 Gwynn asked how many cars he worked on at a time. Mr. Luedeke answered that he usually is working on 2-3 vehicles at a time. Gwynn asked why he needs to store 10-12 cars on the property when he is only working on 2-3 at a time. Mr. Luedeke answered that some of the cars are his own, but he can also make a reduction in the number of cars stored at the property. Arcand asked if he thought he would have to move if he became more successful. Mr. Luedeke answered that he didn't have any plans of moving at this time. Michael Rokala, 17657 Henna Ave N, stated that he does not like the business on the property. He believes the business changes the character of the area from residential to commercial. He said that the road wasn't designed for that volume of traffic and that the weight and speed of the vehicles was an issue. Schumann asked what he wanted to see happen. Mr. Rokala said that he wanted the business to move. John Lutz, 8050 157th ST N, is a farmer in the area and told the Planning Commission that the applicant saves him a tremendous amount of time and money by having him in the city. He explained that Terry was a great guy and really wants to make things work between him and his neighbors so that he can stay in business. He hoped that the Commission would give him a chance to make things work. Brent Ausvold, 7495 195th ST N, does business with the applicant and things that Terry should stay working at his residence. He thinks that if the neighbors would sit down with him they could compromise and solve some of their issues. He noted that if it was such a problem, why wasn't there more people at the hearing complaining. Schumann closed the Public Hearing. Gwynn stated that if they landscaped it could take years to screen and be effective. He felt that heavy equipment on the gravel roads can damage the road quickly. Rosenquist added that the shared driveway will be a major issue down the road if no agreement is made. Arcand thinks he has a very successful business and thinks it will grow and need to be put in a more appropriate place. McRoberts stated that he does not want to run out the business but feels it is excessive. Planning Commission Minutes — June 23, 2011 Page 3 Kleisser stated that she grew up on a farm and understands the issues. She felt that there needed to be better answers for the problems and would like staff to set up another meeting with the applicant and the neighbors. Schumann noted that an IUP is to allow a business to grow. He thinks there are better opportunities to improve the site. Mr. Luedeke explained that the screening he would be putting in would be 15 foot coniferous trees that would already provide screening from the neighbors. McRoberts felt that the screening should be added immediately. Gwynn Motioned, Rosenquist seconded, to deny the IUP request and directed staff to meet with the applicant and the neighbors to see if it could be worked out before the City Council meeting. Aye- Gwynn, Rosenquist, Kleissler, Arcand, McRoberts Nay — Schumann Motion Carried to Deny the request. Update on Joint Planning Commission and City Council Workshop Bryan updated the Planning Commission on the previous land use workshop.
