HomeMy WebLinkAbout2011.09.22 PC MinutesMINUTES HUGO PLANNING COMMISSION September 22, 2011 Call to Order Vice Chair Kleissler called the meeting to order at 7:15 p.m. PRESENT: Arcand, Gwynn, Kleissler, McRoberts, Moore, Rosenquist ABSENT: None ALSO PRESENT: Bryan Bear, Community Development Director Dennis Fields, Community Development Assistant Rachel Juba, Planner Approval of Minutes of September 8, 2011 McRoberts made motion, Arcand seconded, to approve the Planning Commission minutes of September 8, 2011. All Ayes, motion carried. Bergman — Minor Subdivision Planner, Rachel Juba, explained to the Planning Commission that she is still working with the applicant on the minor subdivision. She recommended that the Planning Commission table the item at the request of the applicant. McRoberts made a motion, Arcand seconded, to table the item until the next meeting as requested by the applicant. All Ayes, motion carried. Variance — Text Amendment McRoberts motioned, Arcand seconded, to remove the tabled item. Rachel gave the background to the Planning Commission. She explained the text changes and recommended approval of the changes to the Commission. McRoberts asked what is considered a practicable difficulty, and things that the statute is open ended. Rachel answered that variances are reviewed on a case by case basis and the applicant would still have to meet the criteria for approval. Planning Commission Minutes — September 22, 2011 Page 2 Bryan stated that staff will be looking for something unusual or unique in some way. The application would have to meet the spirit and intent of the ordinance. Kleissler opened the public hearing Kleissler closed the public hearing. Moore stated that he is ok with the changes proposed. Rosenquist motioned, Gwynn seconded, to approve the ordinance text amendment as presented. All Ayes, Motion Carried. McRoberts Abstained. Accessory Dwelling Unit Ordinance McRoberts motioned, Rosenquist seconded, to remove the tabled item. Rachel gave the background to the Planning Commission. She explained that the City Code does not allow for a property to have a Mother-in-law apartments, or secondary dwelling units on a property. The accessory dwelling unit would not be for a second family or rental and must meet requirements set in ordinance. Staff recommended approval of the ordinance. McRoberts stated that it may be appropriate to add a maximum number of occupants to the ordinance. Bryan answered that enforcement would be difficult to try and limit the number of people, however they could add such condition if the Commission wishes. He added that it would be difficult to meet the other requirements outlined in the ordinance with more occupants. Gwynn asked if they had seen a similar case in the past? Rachel answered that the Planning Commission did see an application for a horse boarding facility with allows for living quarters under a conditional use permit. Moore asked what happens at the sale of the property and the new owners rent the accessory apartment. Rachel answered that our code enforcement would follow up with the issue if we received complaints. McRoberts asked what affect this would have on a home occupation and number of vehicle trips allowed. Rachel answered that it is only counted if it were a business related vehicle trip. Gwynn made a motion, Arcand seconded, to approve the item as presented. All Ayes, motion carried. Dave Schumann Resignation Bryan explained the letter he received from Dave Schumann submitting his resignation from the Planning Commission. He explained that Dave will be moving out of the City of Hugo and will no longer qualify as a Commission member. This creates a vacancy on the Planning Commission and Board of Zoning Appeals. Bryan asked the Commissioners to submit a letter of interest to him for anyone interested in being the Chair of the Commission or serving on the Board of Zoning Appeals. McRoberts motioned, Gwynn seconded, to send Dave Schumann a statement of appreciation for his years of service. All Ayes, motion carried McRoberts motioned, Rosenquist seconded, to recommend Bronwen Kleissler as the new chair of the Planning Commission. All Ayes, motion carried. City Bus Tour / City identity Meetings Staff updated the Planning Commission on the Bus Tour scheduled for October 15, 2011 at 10 A.M. Planning Commission scheduled the City Identity Meeting for November 17, 2011. Adjournment Arcand motioned, Gwynn seconded, to adjourn. All Ayes, motion carried. Meeting adjourned.
