HomeMy WebLinkAbout2010.11.18 PC MinutesMINUTES HUGO PLANNING COMMISSION November 18, 2010 Call to Order Chairman Schumann called the meeting to order at 7:00 p.m. PRESENT: Arcand, Gwynn, Kleissler, McRoberts, Schumann ABSENT: Moore, Rosenquist ALSO PRESENT: Bryan Bear, Community Development Director Dennis Fields, Community Development Assistant Rachel Juba, Planner Approval of Minutes of October 28, 2010 Gwynn made motion, Kleissler seconded, to approve the Planning Commission minutes of October 28, 2010 with this change. All Ayes, Motion carried. Public Hearing — Zoning Map and Ordinance Updates to be consistent with the 2030 Comprehensive Plan Planner, Rachel Juba, gave the background to the Planning Commission. She explained that the Council adopted the 2030 comprehensive plan in March of 2010 and there is a 9 month time period in order to make the zoning ordinance consistent with the comprehensive plan. Rachel Explained the major changes including additions and deletions in the zoning ordinance and performance standards. The Ordinance Review Committee reviewed the changes and recommends approval. Schumann opened the public hearing. Sarah Frederickson, 5955 180th ST N, asked questions about the 2030 land use maps and who gets to decide what gets put there. She expressed concerns about high density residential around Hardwood Creek. She claimed that she was ignored by staff when she called or emailed the City. Community Development Director, Bryan Bear, explained the differences between the land use and zoning maps. He also explained to the audience the comprehensive plan process and the noticing that went out to each of the property owners while the decisions were being made. Patrick Shearen, 14187 Froest Blvd. N, felt that he would have a large financial loss if his property changed from commercial to residential zoning. He wanted to be able to sell his property or put a business there sometime in the future. Planning Commission Minutes —November 18, 2010 Page 2 Schumann asked if the central residential district allowed for multi -family homes. Rachel Answered townhomes and twin homes are allowed with a conditional use permit. McRoberts asked for some clarification why Mr. Shearen's zoning was changing. Bryan explained that staff looked for inconsistency between the land use and zoning maps. The land use plan had the property guided for residential. He also explained that the question is how should the property should develop in the future and how it would be hard to rebuild a home on property that was zoned for commercial. Sandra Jasinski, 17431 Greystone Ave N, asked if the property would always have a minimum lot size of 1 unit per 10 acres. Rachel answered that the future urban service area in which she is zoned would change from 1 unit per 10 acres to 1 unit per 20 acres. Mike Gallivan, 12493 Forest Blvd. N wanted to check the zoning change and questioned if there would be a tax increase on his property. Rachel stated that he is currently zoned single family detached residential and it would be changed to NS neighborhood service which is a commercial zoning district. Schumann answered that the tax is usually based on the highest and best use of the property by the assessor. Mr. Gallivan asked if the property to the south is changing to this zoning district as well. Rachel answered that the property has been approved with a Planned Unit Development but would have a commercial use. Mr. Gallivan asked if a drive through business would be allowed in the NS district and about the option of having an accessory building on the property. Rachel answered yes a drive though is allowed with a Conditional Use Permit. She also explained that accessory buildings are allowed however they are approved on a case by case basis. Stephen Shaw, 17940 Foxhill Ave N, had questions about the land uses in his area. He questioned why his property would be guided for medium density when other areas of the City were guided for low density. Schumann stated that the land use map is a general district overlay and that his property may not actually be used for that use when or if it develops. Rachel added that his property is currently zoned Future Urban Service. Planning Commission Minutes —November 18, 2010 Page 3 Schumann closed the public hearing. Gwynn felt that staff should meet with Mr. Shearen and surrounding property owners to take a closer look at that area. Arcand and Kleissler agreed. McRoberts felt that it was important that the members of the Ordinance Review Committee be present to give input. Some of the Committee members were absent and he wanted to table the item. McRoberts motioned, Kleissler seconded, to table the item until December 9, 2010 and reopen the public hearing at that time. All Ayes, Motion Carried.
