HomeMy WebLinkAbout2009.08.13 PC MinutesMINUTES HUGO PLANNING COMMISSION August 13, 2009 Call to Order Chairman Schumann called the meeting to order at 7:00 p.m. PRESENT: Galler, Kleissler, McRoberts, Moore, Rosenquist, Schumann ABSENT: None ALSO PRESENT: Bryan Bear, Community Development Director Dennis Fields, Community Development Assistant Rachel Simone, Associate Planner Approval of Minutes of July 9th, 2009 Galler made motion, Moore seconded, to approve the Planning Commission minutes of July 9, 2009. All Ayes Motion carried. Abstain: Rosenquist, McRoberts Public Hearing for a Conditional Use Permit at 6128 Goodview Ave Trail Circle North Associate Planner, Rachel Simone, gave the background to the Planning Commission. The request was to allow 125% of the maximum accessory building space. The applicant wanted to build a building that was 324 square feet on the property where 260 square feet is allowed. The application meets the criteria and staff recommended approval of the CUP request. Schumann asked if the trailer for the applicant's home based business was allowed to be stored outside. Rachel answered that he cannot store the trailer outside, he is only allowed one work related vehicle, trailers are not allowed. McRoberts asked if he needed an IUP for his home based business. Rachel answered that the applicant meets all of the criteria for having a home based business without an IUP. Schumann opened the public hearing. Planning Commission Minutes — August 13, 2009 Page 2 Paul Courneya, 6122 Goodview Trial Circle N, came to speak at the public hearing. He stated that he is the closest property owner to the proposed building, and that he is planning to store the business trailer in the building. He shared concerns with the Planning Commission regarding backing up the large trailer and showed pictures of the fence between the properties that has already been damaged from the applicants trailer. Paul owns the fence and said he has not agreed to fix the damages. He was also concerned with other employees stopping by all the time with work vehicles. Schumann asked who installed the fence. Paul answered that Midwest Fence Company originally installed the fence, and that it was placed 6 inches on his property for maintenance purposes. Galler questioned some of the materials shown in the photos of Mr. Carter's backyard. The applicant, Benjamin Carter explained that those were materials being used for the proposed building and the sand was laid down in the area where the building would be. Moore asked the applicant what vehicles does he normally keep on the property. Mr. Carter answered that usually there is a car and a work truck parked there. McRoberts asked if this should be considered as an IUP due to the negative effects. Bryan answered that the ordinance would normally not allow a work related trailer on the property, therefore without the trailer there he meets the criteria for a home occupation. He also reminded the Planning Commission that the application was for the CUP and not for the home occupation. Rosenquist asked what he would store in the building if he didn't put the trailer in there. Mr. Carter answered that he would most likely store equipment and materials in the building. Schumann closed the Public Hearing. Galler stated that the Planning Commission should allow the CUP because home occupation and CUP requests are two separate issues. Rosenquist stated that he has issues with the application however he meets the criteria for the CUP. Galler made a motion, seconded by Moore, to approve the CUP. McRoberts thinks this item should be brought back as an IUP. Planning Commission Minutes — August 13, 2009 Page 3 Ayes: Galler, Rosenquist, Moore, Schumann, Kleissler Nay: McRoberts Motion carried. Discussion on Hunting Issues Community Development Assistant, Dennis Fields, gave a presentation to the Planning Commission regarding hunting issues and ordinance changes. The City Council directed the hunting committee to meet and discuss the current Shooting Regulations Ordinance and issues surrounding Bald Eagle Lake and make a recommendation to the City Council. Dennis presented the recommendations to the Planning Commission. Staff recommended to adopt the shooting regulations ordinance as presented. Schumann felt that Bald Eagle Lake has outgrown hunting in that area. Also he felt that it wasn't a very large impact because it isn't allowed on other areas of the lake in other jurisdictions. Rosenquist was in favor of creating a hunting map which would outline areas of the City that would be "closed" or "open" to hunting. Kleissler thought the map was a good idea. McRoberts thought the map idea was also a good idea and hunting should not be allowed on the lake. McRoberts made a motion, Moore Seconded, to approve the proposed Shooting Regulations Ordinance. All Ayes, motion carried. Rosenquist thought the City shouldn't adopt an ordinance change that the City Attorney doesn't feel we could enforce if challenged. Schumann made a motion, Moore seconded, to add language to the ordinance to prohibit the discharge of a firearm within the ordinary high water mark on Bald Eagle Lake. Ayes: Moore, Schumann, Kleissler, McRoberts Nay: Galler, Rosenquist Motion carried. Planning Commission Minutes — August 13, 2009 Page 4 Variance Procedures Rachel Simone gave a presentation to the Planning Commission and discussed the ORC recommendations. Galler Motioned, Rosenquist seconded, to make no changes to the variance procedures. Adjournment Rosenquist Motioned, Galler seconded, to adjourn. All Ayes. Motion carried.
