HomeMy WebLinkAbout2008.06.12 PC MinutesMINUTES HUGO PLANNING COMMISSION June 12, 2008 Call to Order Chairman Schumann called the meeting to order at 7:00 p.m. PRESENT: Burmeister, Kleissler, McRoberts, Moore, Rosenquist, Schumann, and Weidt ABSENT: NONE ALSO PRESENT: Bryan Bear, Community Development Director Dennis Fields, Community Development Assistant Rachel Simone, Associate Planner Oath of Office Greg Burmeister read and signed the Oath of Office, making him a Planning Commissioner for the City of Hugo. Approval of Minutes of May 8, 2008 Weidt made motion, Schumann seconded, to approve the Planning Commission minutes of May 8, 2008 as presented. Ayes: McRoberts, Moore, Rosenquist, Schumann, Weidt Abstain: Kleissler, Burmeister Motion carried. Home Occupation ordinance Text Amendment Associate Planner, Rachel Simone gave a background on the current ordinance and what changes to the text were proposed. She stated that the changes would be to the number of vehicles allowed for a home occupation. This would allow a resident to have two (2) business vehicles, also allowing one to exceed the required 9,200 pound limit. Rachel noted that City Council directed the Planning Commission to consider this issue at this meeting and to make a recommendation back to the City Council. Schumann opened the public hearing. Schumann closed the public hearing. Burmeister asked whether trailers were allowed under this change or only motorized vehicles. Planning Commission Minutes — April 24, 2008 Page 2 Rachel read a section of the code dealing with trailers allowed on a lot, and the conditions required. Rosenquist thought that the number of trailers allowed on the property should be limited to one. McRoberts stated that by relaxing the standards, it could cause a visual blight and he thought the trailers should be screened as well. Rachel pointed out a portion of the ordinance that states that trailers must be adequately screened. McRoberts asked that the word adequately be removed because it is not definite enough. Schumann asked whether only the smaller business vehicle would be the one allowed to park in the driveway, or would the large one also be allowed to park there. Bryan mentioned that they should focus on the extra vehicle and the size of that extra vehicle, because the ordinance limits the space and location of trailers, and other storage areas. McRoberts motioned, Rosenquist seconded, to approve the text amendment with modifications to the text in SUBD. 2 Letter J to require the larger vehicle to have straight chassis and not including trailers, and modifications to SUBD. 13, Letter B to only allow the smaller business vehicle, under 9,200 pounds, to park in the driveway, and to remove the word "adequately" from the ordinance. All Ayes, Motion Carries Nuisance Ordinance Text Amendment Regarding Noise Associate Planner, Rachel Simone gave a background on the current ordinance and what changes to the text were proposed. The code enforcement subcommittee determined that the existing language was adequate with the exception of car stereos. Rachel read the proposed ordinance text changes. She added they could also make a restriction regarding the time that this could be enforced. Schumann asked staff if they were aware of any problems with this from other communities. McRoberts asked why this was specific to motorized vehicles and not a home as well. Brian assured the commission that the current code can enforce the noise at a home, but that it is hard to enforce a moving vehicle without a text amendment to the ordinance specifically for cars. He added that the ordinance currently covers motors or vehicles in disrepair but does not cover the issues with music and other audio. Schumann opened the public hearing. McRoberts Motioned, Kleissler seconded, to approve the text amendment with changes to the text adding all audio, not only music. All Ayes, Motion Carries. Nuisance Ordinance Text Amendment Regarding Junk Cars Associate Planner, Rachel Simone gave a background on the current ordinance and what changes to the text were proposed. She stated that the proposed ordinance will not allow junk vehicles on properties in the urban area of the city that are developed. Properties that meet certain criteria will be allowed to store no more than two junk vehicles, provided the vehicles are adequately screened from adjacent properties, and are not located on the grass in the front yard. The code enforcement sub committee drafted an expanded definition for junk vehicles that Rachel read to the Planning Commission. Schumann opened the public hearing. Schumann closed the public hearing. Schumann proposed car covers for partially dismantled cars as an alternative for screening. McRoberts asked that the word adequately be removed because it is not definite enough. He also stated that the word inhabited be added before dwelling to ensure that someone is living in the home. McRoberts motioned, Kleissler second, to accept the text amendment with modifications to the text to remove the word "adequately," and to add the word "inhabited" to the ordinance as discussed.
