HomeMy WebLinkAbout2006.12.14 PC MinutesMINUTES HUGO PLANNING COMMISSION December 14, 2006 Call to Order Chairman Schumann called the meeting to order at 7:05 p.m. PRESENT: Bailly, Hoffbeck, Kleissler, Schumann, Weidt ABSENT: McRoberts, Rosenquist ALSO PRESENT: Bryan Bear, Community Development Director (CDD) Michele Lindau, Planning Commission Secretary Rachel Simone, Community Development Intern Minutes of October 26, 2006 Weidt made motion, Kleissler seconded, to approve the Planning Commission minutes of October 26, 2006 as submitted. Ayes: Hoffbeck, Kleissler, Schumann, Weidt Abstain: Bailly Motion Carried. Lametti and Sons, Inc., CUP for Exterior Storage The Planning Commission held a public hearing to consider the application of Lametti and Sons, Inc., 16028 Forest Boulevard North, for a Conditional Use Permit (CUP) to allow interior and exterior storage of material and equipment, and processing of cured -in-place pipe that would be done inside of an existing building. The property is located in the Restricted Industrial zoning district where exterior storage and light manufacturing is only allowed with a conditional use permit. The CD Intern explained that the applicant did have a conditional use permit to allow these uses on the property that expired in March of 2005. Staff drafted a new conditional use permit for Lametti and Sons Inc that revised the expired CUP to be current with what uses were currently taking place on the property. It also included a new condition that the CUP is reviewed every five years but would not expire. Schumann asked if there had been any complaints on the past CUP. The CDD said there was a Planning Commission Minutes — December 14, 2006 Page 2 minor issue with a fence that had been addressed. Fred Chase, Vice -President of Lametti and Sons, Inc, said he had appeared before the Commission a few years prior when they built a new building. He said he recognized the community was growing around them and they were trying to clean up the exterior storage on the site. He had talked with neighboring property owners and they are proactive in planning how the properties might develop when City services became available. He apologized for being late in amending the CUP. Schumann asked how the current use was different than the use under the expired CUP. Chase said that five years ago they were operating out of an old farm house and modular structures, which had been eliminated when the new building was construction. On the western edge of the property there was a lean-to with exterior storage. In 1995-96, they entered into the cured -in-place pipe business and converted the northern part of the building for manufacturing. Schumann opened the public hearing. There were no comments and he closed the public hearing. Schumann acknowledged that the Lamettis had been a good neighbor and he had no issues with the CUP request. Weidt made motion, Bailly seconded, to recommend approval of the CUP for Lametti and Son's, Inc. All Ayes. Motion carried. Rooftop Screening Discussion The Commission discussed the screening of ground and roof top mechanical equipment in regard to commercial and industrial developments in the City, specifically in regard to the requirement for screening the roof top equipment on the Oneka Pet Resort located at 13477 Fenway Boulevard Circle North in the Bald Eagle Industrial Park. The City had received a screening plan for the building that included a drawing showing that the roof top mechanical equipment would not be seen from the center of the cul-de-sac. Staff had done an inspection of the property and while the equipment was partially screened from view, the equipment could be seen from the center of the cul-de-sac and Highway 61. Staff provided the Commission information on the approving resolution. The CD intern showed pictures of other business in the Industrial Park with roof top mechanical equipment and compared how they were screened. Schumann questioned whether screening interfered with the operation of the equipment. The CDD said it could and the best option would be to raise the parapet wall. Planning Commission Minutes — December 14, 2006 Page 3 Hoffbeck suggested the requirements for roof top screening be different for retail and industrial uses. Bailly asked if the roof top equipment was larger than originally intended on the Oneka Pet Resort building and wondered if the equipment could be painted to blend in with surroundings. Schumann said the requirement for screening was part of the original agreement, and the applicant should meet the spirit and intent of it. The CDD explained a temporary Certificate of Occupancy had been issued and the only issue was the screening of the roof top equipment. Andy Faulkner, Faulkner Construction, who worked on the building, explained that the air units ended up to be higher than intended and questioned what they were to be screened from. The CDD said they were required to be screened from public view and Weidt said he felt the view from the cul-de-sac and Highway 61 was important. The Commission agreed the equipment needed to be screened and asked staff to work with the applicant on a way to comply with the requirement. Code Enforcement Update On July 20, 2006 there was a joint meeting between the City Council and Planning Commission to talk about code enforcement issues. At that meeting the code enforcement subcommittee was formed to work on the issues that the City had received complaints about. The subcommittee consisted of Council Members Becky Petryk and Frank Puleo, and Planning Commission Members Bob Rosenquist, Tom Weidt, and Kelly Bailly. The subcommittee focused on the topic of parking and storing of recreation vehicles and created an ordinance which defined "recreational vehicles" and addressed how many recreational vehicles could be parked or stored on the property, where they must be parked, and what would be required for setbacks and screening. The Commission reviewed the ordinance and forwarded it to the City Council. Goal Setting for 2007 The Commission discussed their goals for 2007 and agreed on the following: Finish the Rural Preservation Ordinance Finish the Code Enforcement Updates Complete 2008 Comprehensive Plan Update Develop Plans for the Northern Gateway Planning Commission Minutes — December 14, 2006 Page 4 Cancellation of December 28, 2006 Meeting The CDD explained there were no applications for the December 28, 2006 agenda. Bailly made motion, Kleissler seconded, to cancel the December 28, 2006 Planning Commission meeting. All Ayes. Motion carried. Adiournment Weidt made motion, Kleissler seconded, to adjourn at 8:19.
