Ayes: Hoffbeck, Rosenquist, Schumann, Weidt Abstain: Kleissler, Bailly Motion carried. Randy Nugent - Pavement Guys Holdings, LLC for Site Plan, Variance, CUP The Commission held a public hearing to consider the application of Pavement Guys Holdings, LLC, 6937 West Shadow Lake Drive, Lino Lakes, for approval of a site plan, variance, and conditional use permit to allow construction of a 15,065 square foot office/warehouse building on a vacant lot in the Peloquin Industrial Park. The applicant is requesting a variance to permit a 30 foot side yard setback where 40 feet is required by ordinance and a conditional use permit to allow exterior storage. The Planner presented the application to the Commission. The foot print of the building would be 12,000 square feet with a mezzanine. She informed the Commission that the applicant was currently storing vehicles and equipment on the site without City approval. Rosenquist said he felt the handicap parking was located too far from the entrance, and the Planner said she would check with the State to see if there were any requirements. David Larrive, 6109 151St Street North, said he lived due east of the site and between his backyard was a pond and berm. Mr. Larrive was concerned about the hours of operation, lighting on the site, and the type of exterior storage. The contractor on the project explained that the storage area would be screened by the fence and there would be shrubs by the pond. For lights, there would be two light poles. Exterior storage would consist of bobcats, trailers, and trucks. Operating hours would be from 7 am to approximately 6 pm, Sunday through Saturday. He showed the Commission pictures that were taken of existing neighboring properties, pointing out that they were using Class 5 rock and felt the applicant should not be required to pave their parking. Chair Schumann pointed out that the Zoning Code had changed and now required it to be done. Mr. Nugent said he was unaware that they were not allowed to park their vehicles on the property and someone was illegally dumping trash on the site. He said he felt that the requirement for 27 trees was excessive and they were planning to stagger the trees in back. They would be storing bobcats and seal coating equipment. The storage area would be screened with the existing fence and Nugent said they could fill it in with lattice or vines. He also said they could put six additional trees in back and another two in front. The CCD suggested moving the pond to provide more of a separation between the exterior storage area and the pond which would provide more room for landscaping and avoid the area from becoming a place for storage. Mr. Nugent explained he had done much upgrading from the original plan. He pointed out the Industrial Park was there prior to the new development (Oneka Ponds). Rosenquist inquired on the Sunday hours. The CCD explained that the ordinance was vague regarding noise and there were no specific standards in the Industrial District. Nugent said they would not be working on site, just picking up equipment and leaving. Most of their business involved commercial parking lots. The contractor said it would not be a `walk-up' business, only employees would be there. Nugent agreed he could put sidewalks in but felt it made no sense, and curb and gutters made no sense. Nugent's partner, Auger Reinhart, said he felt it was not likely that it would ever become a retail area, and a fence around the exterior storage would prohibit them from working freely there. With the fence, it would be hard to maneuver the vehicles. Planning Commission Minutes — April 14, 2005 Page 3 of 5 Schumann suggested a fence on three sides with a full compliment of landscaping. Hoffbeck asked Nugent when he felt he would need to make use of the back storage area. Nugent said it would probably be within a few years. Rosenquist pointed out that that center spaces of the building probably would not meet the handicap requirements for parking. Nugent said he would rather pave the whole thing instead of fencing. He pointed out the other properties in the park. The CCD informed him that staff was addressing issues on the neighboring properties. Bailly referred to the design of the building and said she felt it would be difficult to lease the center area. Hoffbeck asked if Nugent planned on eventually taking over the entire building and Nugent said he did. Schumann explained that industrial tax base created a source of revenue for the City and that was why the City was concerned about the future tenants. Weidt asked what type of business and equipment Reinhart would have. Reinhart said they do striping, sweeping, and seal -coating with bobcats, trailers, sweepers, and miscellaneous trucks. Weidt asked what the bays would be used for. Nugent said they would be for maintenance. He informed the Commission that he used environmentally friendly chemicals they would probably be stored outside. Weidt agreed that it would not be conducive to put a fence on the west side of the storage area. He suggested the fence be pushed to the back with slats and more shrubbery. The parking could be lengthened 20 feet. Larrive said he would like to see the fence constructed to the property line with the berm inside the fence. Schumann pointed out that the fence would also provide a sound barrier. Weidt asked if all the equipment would be secured. Nugent said he would like to see the whole site secured but he needed to work with the property owner to the south to see if they would help pay for a fence. Planning Commission Minutes — April 14, 2005 Page 4 of 5 Schumann said the east end of the property should have full landscaping in place, and the entire outdoor area should be paved and fenced on three sides. A sidewalk should be constructed on the east and west sides of the building. He saw no problem with granting a ten -foot variance. Rosenquist asked about the exterior storage of the chemicals. Nugent explained that they would dig down several feet and put plastic under Class 5 rock that the tank would be sitting on. In case of a spill, the Class 5 could easily be dug out. Rosenquist suggested he meet with staff regarding it and the CCD said it would be addressed with the building permit. The planner talked about moving the doors to the east and west ends and re -orientating the offices. Rosenquist pointed out that people could not be brought through the storage area. Nugent agreed to move the door to the west elevation and re -orientate the office on the west end. Larrive questioned the proposed lighting. Nugent said it would be directed away from the homes. It would be low lighting on low poles. The planner said it could be made a condition of approval. Schumann closed the public hearing. Bailly made motion, Rosenquist seconded, to table the application until the next Commission meeting on April 28, 2005. All Ayes. Motion carried. Schumann reopened the public hearing and recessed it to reconvene on April 28, 2005. The Commission took a short break. Discussion on Home Occupations The Commission began discussion on the Home Occupations ordinance citing several areas in the ordinance they felt should be changed. They discussed conducting home occupations in accessory structures, interim use permits, storage, alterations of buildings, setbacks, definition of permitted businesses, and the general wording of the ordinance. The Commission agreed to form a committee to work with the CCD on revising the ordinance. Hoffbeck and Weidt would be part of this committee.
