HUGO PLANNING COMMISSION
April 28, 2005
Call to Order
Chairman Schumann called the meeting to order at 7:03 p.m.
PRESENT: Bailly, Kleissler, McRoberts, Rosenquist, Schumann, Weidt
Hoffbeck arrived after roll call.

Weidt made motion, Bailly seconded, to approve the minutes of April 14, 2005 as amended.
Ayes: Bailly, Hoffbeck, Kleissler, Rosenquist, Schumann, Weidt

Randy Nugent - Pavement Guys Holdings, LLC for Site Plan, Variance, CUP
The Commission continued the public hearing to consider the application of Pavement Guys
Holdings, LLC, 6937 West Shadow Lake Drive, Lino Lakes, for approval of a site plan, variance,
and conditional use permit to allow construction of a 15,065 square foot office/warehouse
building on a vacant lot in the Peloquin Industrial Park. The application was considered at the
Planning Commission meeting on April 14, 2005. The Commission tabled the request to allow
the applicant to address issues raised by the Commission.
The applicant had revised the plans to show the relocation of the west entrance of the building,
revised ponding and parking stalls, and additional sidewalks, landscaping, and curbing.
The Planner pointed out that the plan still did not show all curbing and did not show the trash
enclosures in the rear of the building.

Randy Nugent asked to be exempt from the curbing requirement. The Ordinance requires that
concrete curbing be installed. Nugent offered to construct asphalt curbing.
Schumann explained that curbing prevents encroachment and aides in water runoff. He felt that
could be accomplished with a lay -down curb or bump -up asphalt curb. He suggested asphalt
curbing in only certain areas.
Nugent said he was in the business of asphalt and would be sure to maintain asphalt curbing.
Rosenquist pointed out that the plan did not show the storage tank to be located in the exterior
storage area. He asked that a condition of approval be added that the applicant work with the
building inspector on the tank construction. He said he felt the building could be redesigned so a
variance was not necessary.
Hoffbeck said she felt the applicant had complied with their previous concerns and was not
worried that the applicant would not maintain the asphalt.
Weidt said he felt the applicant had made the changes to the plan that were requested and noted
that it was tough property to put a building on.
Bailly said she felt that either curbing would accomplish what it was intended to do and she was
okay with the project.
McRoberts said he could live with the setback variance, pointing out that no neighbors came
forward to oppose it.
Kleissler felt they made a good effort to make the requested changes and approved of the changes
to the ponding on the east end. Since asphalt was the applicant's business, she felt a bituminous
curbing would be appropriate and a condition could be added to the approval that the curbing be
maintained.
Schumann said they needed to consider what would happen if the building was sold to someone
else. He would be okay with lay -down curbing.
Rosenquist agreed with Schumann that lay -down curbing would still control the water.
Weidt made motion, McRoberts seconded, to approve the request with the conditions established
adding a variance for the bump -up curbing.

Schwieters Properties Site Plan
The Commission considered the application of Schwieters Properties for site plan approval to
allow for the construction of a 45,000 square foot building on Lots 4 and 5, Block 1 of Bald
Eagle Industrial Park, 3rd Addition. The building would be located directly south of the three
existing Schwieters buildings and would be intended primarily for storage of lumber and other
materials currently being stored at the former Interstate Lumber site on the southwest corner of
TH61 and 140th Street North. Construction on the site will also include the installation of a
railroad spur. The CDD explained that the railroad spur would be a team track that can be used
for unloading of materials for Schwieters as well as other businesses in the City.
Schumann asked if there was a road to be constructed to the spur and who would pay for it. The
CDD explained that the entrance would be off the existing cul-de-sac and Schwieters would
construct the driveway. It would be maintained in agreement with the railroad, Schwieters
Properties, and the City.
The CDD pointed out that additional landscaping needed to be added and the exterior storage on
the existing Schwieters' site was not adequately screened. Materials stored on the site are
stacked extremely high, making it a challenge to screen.
Schumann wondered if the site could be screened by conifers planted near the highway which
would be in the line of site from roadway traffic.
Rosenquist questioned whether planting in the railroad or highway right-of-way would be
permitted.
McRoberts said that allowing the exterior storage without the required screening would be setting
a bad precedence, and the City needed to ensure compliance with the ordinance.
Schwieters was currently using the track located at the former Interstate Lumber site and was also
storing materials there. They would like to terminate that and use the proposed team track and
the building. When the interior storage reaches capacity, they would store materials outside and
construct the screening at that time. It was anticipated they would reach building capacity in a
few years.
Rosenquist said the exterior storage was very visible and they should not wait two years to
screen. Something should be done in the interim.

Hoffbeck asked about how the railroad spur would be constructed and how the public would
have access.
The CDD explained that the tracks would be installed by a contractor through Minnesota
Commercial Railroad and Schwieters Properties would dedicate an easement for access to the
railroad spur.
Weidt said he felt the screening should be brought into compliance.
Bailly questioned the impacts to the wetlands.
The CDD said the City was working with all agencies involved with the wetland and it would be
a conditional of approval.
Brenda Kunkel, representative for Schwieters, explained they had been working on the
agreement for the team track for the last few years and they need to move out of the Interstate
Lumber site. She said Schwieters Properties was looking into different types of screening.
Schumann suggested they come up with a tentative plan and provide some escrow to ensure it
would be done.
Hoffbeck said she would like to see a plan of the whole campus showing the entire screening
area.
McRoberts made motion, Rosenquist seconded, to table the request to allow the applicant to
work on a plan to screen the whole exterior storage area
All Ayes. Motion carried.
Miscellaneous
McRoberts referred to previous discussions regarding the Victor Gardens North development.
One of the conditions added by the Planning Commission was that anyone buying a home in the
area be advised that agricultural zoning existed on adjacent properties and what types of uses
were permitted there. McRoberts was disturbed by the fact that the condition was deleted by
staff without consulting the Commission and asked that it not happen again.
The CDD apologized and said the condition was part of the plat approval. He stressed it was not
staff's intention to do things differently than what is intended by the Planning Commission.
Many items are discussion topics and are not included in the motions.
