HUGO PLANNING COMMISSION
FEBRUARY 12, 2004
Call to Order
Chairperson Schumann called the meeting to order at 7:03 p.m.
PRESENT: Bailly, Hoffbeck, Kleissler, Schumann
Malaski arrived at 7:35

Minutes of January 21, 2004
Kleissler made the motion, Bailly seconded, to approve the minutes as submitted.
All Ayes. Motion carried.
Haas - Rezoning to Lone -Term Agricultural
The Planning Commission held a public hearing to consider the application of Charles
and Marykay Haas to rezone their property at 15500 Keystone Avenue North from
Agricultural to Long -Term Agricultural. The applicant requested the rezoning to allow
the property to be included in the Metropolitan Agricultural Preservation Program, which
provides tax relief for agricultural and conservation land in exchange for restrictive
zoning requirements and an eight-year commitment to leave the property in agricultural
use.
Chair Schumann opened the public hearing.
Edward Tschida, 9822 152nd Street North, owns the adjacent parcel to the west, which
was recently rezoned and put into the Preservation Program. Tschida said he felt it was a
great idea and recommended it to anyone who wants to preserve their land.
Bailly made motion, Kleissler seconded, to recommend approval of the rezoning of
15500 Keystone Avenue North from Agricultural to Long -Term Agricultural.

St. Sauver/Seng Lee — Minor Subdivision
The Planning Commission held a public hearing to consider the request of William St.
Sauver for a minor subdivision to create two lots from a 69.34 acre parcel. The proposed
lot sizes would be 27.33 and 42.01 acres.
The original application filed with the City on January 8, 2004, included the Seng Lee
parcel to the north. Since the time of application, Lee withdrew his portion of the
request.
Chair Schumann opened the public hearing. There were no comments so he closed the
public hearing.
Hoffbeck made motion, Bailly seconded, to approve the minor subdivision for St. Sauver,
removing the conditions in the draft resolution pertaining to the Seng Lee parcel.
All Ayes. Motion carried.
Leibel — Minor Subdivision
The Commission held a public hearing to consider the application of Curt Leibel, 16740
Henna Avenue North, for a minor subdivision to create three residential lots on his 30 -
acre parcel. The existing home and the two proposed parcels would all have access to
Henna Avenue North, an existing gravel road. The parcels would be 10 acres each and
would meet the minimum lot standards for the Agricultural zoning district.
Chair Schumann opened the public hearing. There were no comments and Schumann
closed the public hearing.
Bailly made motion, Hoffbeck seconded, to recommend approval of the minor
subdivision for Curt Leibel with the conditions of the draft resolution.
All Ayes. Motion carried.
Oakwood Land Development - Beaver Ponds South Plat
The Commission held a public hearing to consider the application of Oakwood Land
Development for preliminary plat approval to construct 45 homes on 20 acres. The
development would be know as Beaver Ponds South, and located north of 125th Street
and south of the existing Beaver Ponds development off 130th Street.
As part of the development, the developer proposed to dedicate 2.1 acres of parkland,
which would be consistent with City requirements. The proposed development lot size
and setback requirements would comply with ordinance requirements.

Dan Jackson, 14846 Flay Road, said parking along the road during soccer games was
causing problems. He was also concerned about safety at the intersection of TH61 and
130th Street and questioned why the proposed development was not connected to 125th
Street to the south.
Developer Len Pratt explained that when parkland is dedicated in lieu of paying the
parkland dedication fee, there is nothing definitive in place for the use of the land. Pratt
suggested it could be used for additional parking. He acknowledged that park systems
come from long-range visions and encouraged the neighborhood to get involved with the
planning of the park.
Darin Carlson, 12808 Fondant Trail, had concerns about expanding the park because of
the additional cars and traffic. Carlson also felt there should be another outlet to help
with the traffic problems at 130th Street and TH61.
Commissioner Bailly said she was at the Parks Commission meeting the previous night
and there was discussion about the proposed parkland. Uses proposed for the park area
were construction of a parking lot or construction of a basketball area.
Alison Schram, 5713 128th Street, complimented Pratt on the proposed development but
agreed that there were issues with the parking along the road. Schramm said she felt a
parking lot was very important.
Gerald Hauble, 5460 125th Street, said he owned the land for the proposed development
and the land to the west, but not the land to the south, which would provide access to
125th Street. Hauble indicated that there were wetlands on the land to the west that would
make it difficult to put a road access there.
Pat Aden, 12852 Fondant, commented on the likely increase in traffic at the intersection
of TH61 and 130th Street with the development of Northern Pines and Fable Hills.
Jason Schmidt, 12843 Fondant Trail, asked why 130th and TH61 was not a controlled
intersection.
Commissioner Malaski pointed out that Hugo was one of many communities seeking stop
lights for busy intersections. Malaski agreed that there were issues that needed to be
resolved regarding the parking for the soccer fields and said she felt a meeting was
necessary between the Parks Commission, surrounding property owners, and the
developer to discuss the development of the parkland.
Chair Schumann recessed the public hearing.
Malaski made motion, Bailly seconded, to table this agenda item until their meeting
March 11, 2004.

Gene's Disposal — CUP and Variance
The Commission held a public hearing to consider the request of Gene Wegleitner, owner
of Gene's Disposal Service, Inc., for a Conditional Use Permit to allow a recycling center
and for exterior storage exceeding the size of the principal structure. The exterior storage
would be used for storing rolloffs and for sorting material. Also requested was a variance
from the paving requirements.
The property is located at 5661 152nd Street North (Peloquin Industrial Park) and is part
of the former site of American Structural Metals. On the property is an existing building
approximately 10,840 square feet in size.
The applicant indicated that he wanted to purchase the property and use the front half of
the building for storage and office, and rent out the rear portion of the building to another
user.
Staff recommended approval of the Conditional Use Permit but denial of the variance
from the paving requirements because it did not meet the standards required in the
Comprehensive Land Use Regulation.
Chair Schumann opened the public hearing. There was no one present but the applicant.
Schumann closed the public hearing.
Commissioner Hoffbeck asked the applicant why he was requesting the variance and the
applicant indicated that it was because of the high cost associated with paving the entire
parking and storage area.
The applicant said there was a mesh screening used to cover the rolloff containers.
Malaski said she did not feel it was an appropriate cover to contain the odors. The
applicant said the refuse would only be there for a short time.
Commissioner Bailly said she felt the paving of the exterior area was necessary and the
south part of the lot could remain gravel if it wasn't going to be used.
Commissioner Kleissler asked how the potential renter would access the building. The
applicant said the property could be accessed from Freeland Avenue. The Planner
indicated that there should be an easement over the property to the east for that access.
It was noted that any additional new tenants would be required to apply for a conditional
use permit if necessary.
The applicant asked to work with staff on paving and parking issues.
Malaski made motion, Bailly seconded, to recommend approval of the Conditional Use
Permit for recycling and exterior storage, and recommend denial of the variance from the
paving requirement.

Planning Commission Minutes — February 12, 2004
2004 Goals for the Planning Commission
The Commission reviewed their goals for 2004. The Commission focused on the
downtown redevelopment plan as being a priority for 2004. The Commission was
reminded of the joint workshop with the Council for February 23, 2004 at 7:00 pm to
begin discussions on downtown redevelopment.
The Commission received a draft copy of the Planning Commission 2003 annual report.
