HomeMy WebLinkAbout2003.05.08 PC MinutesMINUTES HUGO PLANNING COMMISSION MAY 8, 2003 Call to Order Chairperson Schumann called the meeting to order at 7:00 p.m. PRESENT: Bailly, Kleissler, Malaski, McRoberts, Peltier, Rosenquist, Schumann ABSENT: None ALSO PRESENT: John Rask, Community Development Director Michele Lindau, Planning Commission Secretary Minutes of April 24, 2003 Malaski made motion, Peltier seconded, to approve of the minutes of April 24, 2003 as amended. All Ayes. Motion carried Lakeview Hugo, LLP Amended PUD for Fable Hills The Planning Commission had scheduled a public hearing to consider the request of Lakeview Hugo, LLP, 3500 Willow Lake Boulevard, Suite #100, Vadnais Heights, for approval of a PUD amendment for Fabled Hill (formerly called Legacy) located east of Elmcrest Avenue, west of Europa Avenue and South of 140th Street. Len Pratt, Developer, had requested the item be tabled to allow him an opportunity to work through some outstanding issues. Schumann suggested the Commission take public comments and he turned the Chair over to Vice Chairperson Malaski. Malaski opened the public hearing. There were no comments and she recessed the public hearing until May 22, 2003 Malaski make motion, Bailly seconded, to table the request until May 22, 2003. All Ayes. Motion carried. Planning Commission Meeting May 8, 2003 page 2 Keiger Amended Conditional Use Permit The Commission held a public hearing to consider the application of Kieger Family Limited Partnership, 5609 Turtle Lake Road, Shoreview, to amend the existing Conditional Use Permit for 5885 165th Street North to allow a garden center and landscape supply business on the property. The Community Development Director explained that Keiger Enterprise currently had a Conditional Use Permit for an environmental clean-up business, including vehicle repair facilities, cold storage, exterior storage of vehicles and equipment, and company offices. It was noted that Kieger had relocated their business, and activity on the present site had decreased. Pat Iwan, manager of the landscape business, was present at the meeting. Malaski opened the public hearing. Cathy and Rick Suess, 5725 165th Street North, said she had spoke to Mr. Iwan and work had been done all weekend to build a berm and plant evergreen trees. Mrs. Suess said they had done an excellent job to buffer their property and she commended their cooperation. She had issues with them being open on Sundays and all year long. The Suesses stated that there was a lot of noise at all hours coming from the site. Schumann suggested Sunday hours be limited to noon and the other uses of the property be removed from the Conditional Use Permit. Malaski said that most landscape companies are open until 5:00 pm. Dave and Pam Ochs, 5756 165th Street North, said they don't mind the landscaping business being on the site but they do have a problem with early hours. They said they are still hearing noises at 4:00 a.m. Mr. Ochs said Mr. Iwan paid him a visit and left his home abruptly after using inappropriate language. Mrs. Ochs said that the noise occurs so regularly that she did not want to call the police each time. Schumann said it might be difficult to determine which business it was coming from. Iwan said that, to the best of his knowledge, there should be no one on the property after hours. There were no other comments and Malaski closed the public hearing. Bailly asked if the regular hours could be adjusted on the Conditional Use Permit and the Community Development Director said they could. Rosenquist suggested a starting time of 7:00 am. It was noted that other types of business were operating on the site and Schumann said he felt that several people on one permit could be problematic. Planning Commission Meeting May 8, 2003 page 3 Rosenquist suggested a letter be sent to all business at the site to caution them on the noise complaints. The Community Development Director said he would ask Washington County Sheriffs Department to patrol the area. Rosenquist asked how much material would be stored on the site. Iwan said approximately 200 cubic yards of woodchips and mulch and approximately 500 yards of dirt. Kleissler asked if the woodchips or mulch would be treated with any chemicals and if any measures would be taken for rodent control. Iwan said nothing would be treated with chemicals and he had not given much thought to rodent control but will address the problem should it occur. Peltier said she thought they should change the opening hours from 6:30 am to 7:00 am. Schumann asked what type of business they would be conducting during the winter and Iwan said they would be doing snow removal and supplying materials to contractors. Iwan said most contracting jobs started at 7:00 am and that was why he wanted to open his business at 6:30 am. McRoberts asked what other activities were taking place on the site. Iwan said other businesses were Mateo Excavating, which had five trucks; a tennis court sealer company; a roll -off company, a concrete company, which had three trucks and a bobcat; and National Recycling Company who rented outside storage space to store a semi -trailer. Rosenquist made motion, McRoberts seconded, to tabled action in order for staff to re -inspect the site to determine how many and what type of businesses were located on the property. All ayes. Motion carried. Schumann stated that the Commission would reopen the public hearing at that time. Amendment to Comprehensive Plan to Adiust MUSA Boundary The commission considered the application of the City of Hugo for a Comprehensive Plan Amendment to include approximately 84 gross acres (46 net acres) within the MUSA. The property is east of Highway 61 and south of 165th Street. The Community Development Director provided background saying that the request was tabled at the April 10 and April 24 Planning Commission meeting. Staff had met with Beverly Aplikowski and Frank Puleo on April 30, 2003 and discussed options for serving the properties with municipal sewer. Vice Chairperson Malaski opened the public hearing but there were no comments. Planning Commission Meeting May 8, 2003 page 4 McRoberts made motion, Peltier seconded, to recommend approval to incorporate the properties into the MUSA. All Ayes. Motion carried. Potential Road Improvement Proiects for I35E Corridor The Community Development Director explained several regional transportation issues regarding the CASH 8/14 and the I35E Corridor. Miscellaneous Discussion McRoberts related to the Commission concerns from the residents along 145th Street about rezoning the property to residential since it had been determined that CSAH 8 would not follow the current alignment along 145th Street. It was determined the City should wait to consider the rezoning of the property until after it was determined how other road issues would be solved. Malaski brought up the subject of Meth labs and hazardous waste cleanup and suggested that the City consider an ordinance that would require the landowner be liable for the cost of cleanup of Meth lab site. Malaski mentioned that the gravel pit had not been doing reclamation in the past few years and suggested the City contact them to ensure that the City is not left with the bill.
