HomeMy WebLinkAbout2003.05.22 PC MinutesMINUTES HUGO PLANNING COMMISSION MAY 229 2003 Call to Order Chairperson Schumann called the meeting to order at 7:12 p.m. PRESENT: Bailly, Kleissler, Malaski, McRoberts, Peltier, Rosenquist, Schumann ABSENT: None ALSO PRESENT: John Rask, Community Development Director Kendra Lindahl, Planner Michele Lindau, Planning Commission Secretary Minutes of Mav 8, 2003 McRoberts Made motion, Peltier seconded, to approve of the minutes of May 8, 2003 as submitted. All Ayes. Motion carried Kieger Amended CUP The Planning Commission continued the public hearing to consider the application for an amendment to the Conditional Use Permit for 5725 165th Street North. The applicant is requesting an amendment that would permit a garden center and landscape supply business on the property. Kieger Enterprises had a conditional use permit for an environmental clean-up business, including vehicle repair facilities, cold storage, exterior storage of vehicles and equipment, and company offices. On May 8, 2003, the Planning Commission had considered the conditional use permit amendment and tabled action in order for staff to re -inspect the site to determine how many and what type of businesses are currently located on the property. In review of the site and City files, staff noted the businesses operating on the site were Mateo Excavating, American Surfacing, Lorenz Concrete and Masonary, and Kieger Enterprises (Magnum Co. LLC.). Also noted were a large number of semi trailers being stored on the property, as well as pallets of materials that were not permitted as part of Keiger Enterprise's Conditional Use Permit. The applicant indicated that the materials would either be removed from the site or they would apply for a separate conditional use permit. The Community Development Director explained that Kieger Enterprises had significantly Planning Commission Meeting May 22, 2000- page 2 downsized their environmental cleanup business and would like to use a portion of the site for a garden center and landscape supply business that would occupy approximately one -acre of the 15 - acre site. Rick Suess, 5725 165th Street North, said he spoke to Pat Iwon about shortening the hours on the original permit in exchange for longer hours for the retail business. Pat Iwon said he agreed with the proposed hours and would enforce it with his tenants. McRoberts asked if the issue of the exterior storage had been resolved and Iwon said the trailers and pallets would be gone by the end of the following week. Rosenquist asked if any police reports had been filed because of the noises coming from the site late at night. The Community Development Director said there had but the Sheriff was unable to determine where the noise was coming from. Malaski pointed out that the applicant had not submitted a landscaping plan and the Community Development Director said that the site was heavily landscaped, and a landscape plan was not a required submittal for a conditional use permit amendment if the configuration of the property was not changing. Malaski said she felt that monument signage and landscape plans should be included with applications for property along the Hwy 61 corridor. Kleissler asked that the condition pertaining to the height of the sign be amended to explain how it was to be measured. Malaski made motion, Peltier seconded, to recommend approval of the conditional use permit, and instructed staff to inspect the site to ensure they were in compliance with their existing permit. All Ayes. Motion carried. Ramberg CUP Amendment for Rodeos The Planning Commission held a public hearing to consider the request of Dan Ramberg, 5676 170th Street North, for an amendment to his conditional use permit related to the number of rodeo events allowed on the property. The existing conditional use permit allows three rodeos not to exceed twelve days per year. Ramberg would like to remove the restriction on the number of events, but keep the limit at twelve days. Schumann opened the public hearing but there were no comments. Ramberg said he interpreted the existing permit as allowing 12 days of rodeos with no limit on rodeo events. He stated that he has already scheduled more than three events. Planning Commission Meeting May 22, 2000- page 3 McRoberts made motion, Bailly seconded, to approve the amendment to the conditional use permit to allow 12 days of rodeos. All Ayes. Motion carried. Malmstrom CUP for Home Occupation The Planning Commission held a public hearing to consider the request of Walter and Nancy Malmstrom, 16011 Harrow Avenue North, for a conditional use permit to teach art lessons in their home and detached garage. Ordinance requires a conditional use permit for a home occupation to be conducted in an accessory building in the agricultural zoning district. Malaski asked if businesses other than teaching art lessons could be conducted from the building in the future. The Community Development Director said the conditional use permit would be specific to the teaching of art lessons. Schumann opened the public hearing. Nancy Malmstrom, the applicant, said she taught art in Mahtomedi and White Bear for years. Malmstrom said there would usually be between three to five students there at one time. She said there would never be more than nine students at one time and she does understand the traffic issues with cars coming and going. Malmstrom explained that she would teach 1/2 hour lessons in the morning and afternoons about three days per week, Monday through Friday. There were no other comments and Schumann closed the public hearing. The Commission and Malmstrom discussed the hours and agreed to the hours of 9 am to 5 pm and a limit of ten students. The Commission said the hours, days, and number of students should be clarified in the permit. Malaski made motion, Peltier seconded, to recommend approval of the conditional use permit for 16011 Harrow Avenue North with the permitted hours, days, and number of students stated on it. All Ayes. Motion carried. Emmerich Development PUD and Preliminary Plat for Diamond Point The Planning Commission held a public hearing to consider the request of Emmerich Development Corporation, 1875 Station Parkway, Andover, for a comprehensive plan amendment, rezoning, PUD general plan and preliminary plat for 125 single family detached homes and 2 outlots in "Diamond Point East" and 50 single family detached homes and 3 outlots in "Diamond Point West". The comprehensive plan amendment is requested to include Planning Commission Meeting May 22, 2000- page 4 approximately 59 acres east of Goodview Avenue in the Metropolitan Urban Service Area (MUSA). The City Planner presented the plat to the Commission. Schumann opened the public hearing. Mike Gair, Land Planning and Site Design; Mike Quigly, Project Manager; and Larry Olson, Civil Engineer from Emmerich Development, were present at the meeting. Gair explained that MUSA services were available for the eastern portion of the site, and that they have secured the property to the west, which made it financially and technically possible to develop the property. Gair explained the phasing of the project, saying they would work on water management issues, reconstruction of the road, and earth movement prior to construction of the homes. John Waller, 14010 Homestead Avenue North, was there representing his mother Margaret Waller, 14310 Homestead Avenue North. Waller said they felt the project was premature because no one has discussed the ditch issue. The Wallers were concerned that additional homes would increase runoff due to more impervious surface. Florence Meyer, 6358 145th Street North, said she felt it was inconsistent with the comprehensive plan because the plan states the Urban Reserve District would not be developed until 2015. Meyer was concerned about the increase in traffic on 145th Street North during the time Goodview would be under reconstruction. She was also concerned that the wildlife would be disturbed. Dean Zerwas, 6732 Egg Lake Road, asked if sewer and water would be installed along Goodview Avenue when the street was improved. The Community Development Director said that the sewer is scheduled to go north from the development site, and the sewer is to go to the south for the properties south of the site. Jim Anderson, 6191 144th Street North, was concerned about the amount of traffic that would be directed to 147th Street North. Mark Mathias, 6131 144th Street North, said he moved to Hugo three years ago and was not happy with the potential increase in noise and pollution. Marshall Langemo, 6151 144th Street North, asked if they had given any consideration to extending Goodview Avenue to the north. The Commission discussed the construction traffic that would travel through the residential area. Waller commented on the dangerous intersection of CSAH 8 and Goodview Avenue North. Planning Commission Meeting May 22, 2000- page 5 McRoberts said that the wildlife corridors could not be preserved how they exist today and that most of the land being set aside in the proposed development is not buildable. He also said that he was sympathetic to road issues. Kleissler said her major concerns were road and traffic issues. Malaski said she appreciated the developers not asking for the maximum density. Rosenquist said they should consider Goodview Avenue and CSAH 8 joining at a 90 -degree angle, and perhaps warning signs should be installed. Schumann said there were many water management issues to be resolved. Peltier said she needed more time to review the plat. Dean Zerwas said he felt that the narrow street in the development and medians would make it difficult to maneuver tractors, trailers, and snowplows. Rosenquist made motion, Malaski seconded, to recommend approval of the request of Emmerich Development subject to the conditions in the resolution. The Commission made specific mention of the need to improve Goodview Avenue and address the drainage issues. Ayes: Bailly, Kleissler, McRoberts, Rosenquist, Schumann Nay: Malaski Abstain: Peltier Motion carried. Lakeview Hugo Amended PUD for Fable Hills The Planning Commission continued the public hearing to consider the request of Lakeview Hugo, LLP, 3500 Willow Lake Boulevard, Vadnais Heights, for a PUD amendment to add the property located at 13507 Elmcrest Avenue to the PUD and amend the development standards for Fabled Hill. Len Pratt, Developer, was at the meeting to answer questions regarding the amendment. Cindy LaCasse, 13487 Elmcrest Avenue North, said that she felt the construction on the McCollar property started too early; part of the back of their property flooded and the developers were currently working on correcting the problem. She said Pratt agreed to start work after 7:00 am and to construct an evergreen buffer between their property and the development. David Briggs, 13455 Elmcrest Avenue North, was concerned about the traffic on Elmcrest and the dusty roads. Planning Commission Meeting May 22, 2000- page 6 Schumann closed the public hearing. McRoberts made motion, Peltier seconded, to recommend approval of the PUD amendment for Fabled Hills. All Ayes. Motion carried. Miscellaneous Malaski mentioned that there were children playing on the sand pile by the bike trail along Highway 61. She also noted that there were teenage boys on skateboards playing dare with cars and cautioned on the danger of this. Malaski praised the Hugo Lions Club for the beautiful job they did with installing the flags along Highway 61. Adjournment Sandy made motion, Peltier seconded, to adjourn at 10:10 pm. All Ayes.
