HomeMy WebLinkAbout2003.06.26 PC MinutesMINUTES HUGO PLANNING COMMISSION JUNE 26, 2003 Call to Order Chairperson Schumann called the meeting to order at 7:00 p.m. PRESENT: Bailly, Kleissler, McRoberts, Rosenquist, Schumann ABSENT: Malaski, Peltier ALSO PRESENT: John Rask, Community Development Director Michele Lindau, Planning Commission Secretary Minutes of June 12, 2003 Schumann made motion, Bailly seconded, to approve of the minutes of June 12, 2003 as submitted. All Ayes. Motion carried Solid Ground Development Plat and CUP for Former Legion Site The Planning Commission had scheduled a public hearing to consider the request of Solid Ground Development, 4756 Banning Avenue, White Bear Lake, for a conditional use permit and preliminary plat for 10 townhome lots on property located east of Highway 61 between 147th Street and 148th Street (the American Legion Property) to be known as the Historic Legion Post Villas. Staff had found that a variance was necessary in order to permit the proposed detached garages where an ordinance requires townhomes to have an attached garage. Jeff Bock, Project Manager, asked the Commission to table the request to allow them time to submit additional information on the project and hold a meeting with the adjacent property owners on June 30, 2003. Schumann opened the public hearing but there were no comments. The public hearing was recessed until the Planning Commission meeting July 10, 2003. Rosenquist made motion, McRoberts seconded, to table the request until July 10, 2003. All Ayes. Motion carried. Planning Commission Meeting June 26, 2003 - page 2 Amendment to Change Side Yard Setback in the LA, AG, and RR Zoning District The Commission held a public hearing to consider decreasing the side yard setback from 40 feet to 20 feet in the Rural Residential, Agricultural, and Future Urban Service Zoning Districts. The CD Director explained that the City had received numerous requests for side yard setback variances, which had all been recommended for approval by the Board of Zoning Adjustments and approved by the City Council. The side yard setback was increased from 20 to 40 feet in 1999 as part of a comprehensive update to the Zoning Ordinance. The ordinance had created a hardship for many property owners who had constructed their homes and planned future improvements based on the 20 -foot setback requirement. Schumann agreed that many homes were laid out based on the 20 -foot side yard setback. The CD Director said he was unable to find anything in the minutes that directly discussed the change to a 40 -foot setback. Schumann stated he was involved in the plan update and didn't recall any discussion that would have initiated the change. McRoberts said the Commission should not assume that the change was overlooked just because it was not discussed. Rosenquist said he preferred the 40 -foot setback and would rather have property owners request variances. He said that to decrease the setback to 20 feet would permit construction of new homes too close to property lines that abut agricultural uses. Bailly suggested a "grandfather" clause be added to the ordinance to permit the 20 -foot setback for homes built prior to 1999. McRoberts agreed with Rosenquist that homes should not be constructed 20 feet from Agricultural property. The CD Director said they could consider limiting the 40 -foot setback to accessory buildings only. Schumann opened the public but there were no comments so he closed the public hearing. Rosenquist made motion, Kleissler seconded, to recommend the ordinance remain unchanged. All Ayes. Motion carried. McRoberts commented that the Commission was opposed to granting variances to permit construction of new homes less than 40 feet from the property line because of potential conflicts with agricultural uses. Site Plans for White Bear Electric, Grant Barrette Company, and J. Olson Tool, Inc. Faulkner Construction, Inc., 2350 County Road J, White Bear Lake, requested site plan approval Planning Commission Meeting June 26, 2003 - page 3 for three properties in the Bald Eagle Industrial Park. White Bear Electric requested site plan approval for a 8,100 square foot office and warehouse facility and future 4,000 square foot expansion on Lot 2, Block 1, Bald Eagle Industrial Park 5th Addition. Grant Barrette Company requested site plan approval for a 3,000 square foot office and warehouse facility on Lot 6, Block 1, Bald Eagle Industrial Park 5th Addition. J.Olson Tool requested site plan approval for a 6,400 square foot office and manufacturing facility and a 4,000 square foot expansion area on Lot 5, Block 1, Bald Eagle Industrial Park 5th Addition. Jim Faulkner was present at the meeting as well as Grant Barrette, Grant Barrette Company; Rick Suess, White Bear Electric; and Jeff Olson, J. Olson Tool. McRoberts made motion, Rosenquist seconded, to recommend approval of the site plan for White Bear Electric. All Ayes. Motion carried. Mc Roberts made motion, Kleissler seconded, to recommend approval of the site plan for Grant Barrette Company. All Ayes. Motion carried. McRoberts made motion, Bailly seconded, to recommend approval of the site plan for J. Olson Tool. Al Ayes. Motion carried. Concept Plan for Seever Property Oneka Lake Development Company, LLC appeared before the Planning Commission to solicit informal comments on a sketch plan for a proposed development on the Joyce and Merald Seever property. The property is located on the north and south side of Oneka Lake Boulevard east of Greene Avenue. Terry Miller from Oneka Lake Development Company presented the plat to the Commission. The CD Director explained that the subject property was located east of the 2020 MUSA, and in order for the development to proceed the property would need to be included in the MUSA. Miller said he would be holding neighborhood meetings, and Schumann suggested the Commission be informed of these meetings.
