MINUTES HUGO PLANNING COMMISSION April 24, 2014 Call to Order Chairman Gwynn called the meeting to order at 7:00 pm. PRESENT: Arcand, Gwynn, Kleissler, McRoberts, & Lessard ABSENT: Rosenquist & Knauss ALSO PRESENT: Rachel Juba, Planner Connor Schaefer, Community Development Intern Approval of Minutes Arcand made motion, McRoberts seconded, to approve the Planning Commission minutes of March 13, 2014. All Ayes, motion carried. Hugo Senior Housing Community — Site Plan Planner Rachel Juba, presented on the site plan for Hugo Senior Housing Community facility developed by National Senor Housing Services, LLC. The applicant is requesting approval of a site plan for a 100 unit, three story, and 99,200 square foot senior housing facility on a 5 acre parcel. The proposed site plan is located on a proposed lot within the plat for LaValle Fields. The property is located west of Lions Parks with access off of Finale Avenue across from 146'x' Street. The applicant is showing future phases on the site plan. Each addition will be required to formally apply for site plan approval for consideration by the Planning Commission and City Council. The proposed site is zoned Planned Unit Development (PUD). Juba presented on topics regarding building setbacks, height, coverage, parking, landscaping, lighting, fencing and screening, streets and access, trails, building architecture, signage, draining and grading, utilities, wetlands, and park dedication. Juba mentioned the City Code only has requirements for nursing homes and does not provide guidance for parking requirements for a senior housing facility that has various levels of care. The applicant is proposing to satisfy the parking requirements with a combination of above ground and below ground parking. Staff was comfortable with the way the applicant calculated the parking. The proposed monument and wall sign details were not provided in the site plan. The City will ensure that they comply with the sign ordinance. Conditional Use Permit for a 6,600 square foot indoor horse riding arena for the property located at 13961 Elmcrest Avenue North. DATE: June 19, 2014 for the Planning Commission Meeting Thursday, June 261i.. 2014 ZONING: Single Family Detached Residential (R-3) REVIEW DEADLINE: July 151i, 2014 1. DESCRIPTION OF REQUEST: The applicant is requesting approval of a conditional use permit to allow an indoor horse riding arena to be located on the property. The property is approximately 12.11 acres in size. The proposed facility will be 6,600 square feet and meet all required setbacks. 2. BACKGROUND: The applicant's property was previously zoned Agricultural (AG). The use of the property has remained agricultural since then. The neighboring properties have also remained agricultural in nature. The applicant purchased the property in 2010 and has been in compliance with having a small hobby farm. She would like to utilize her property for horse riding all year round. An indoor horse riding arena is a reasonable use for this property. Vint CUP Page 2 3. LEVEL OF CITY DISCRETION IN DECISION-MAKING: The City's discretion in approving or denying a conditional use permit is limited to whether or not the proposed application meets the standards outlined in the Zoning Ordinance. If it meets these standards, the City must approve the conditional use permit. 4. CONTEXT: A. Surrounding Land Use and Zoning The property is currently zoned Single Family Detached Residential (R-3). The property is guided for Low Density Residential (LD) in the 2030 Land Use Plan. To the north, west, and south, the properties are also zoned Single Family Detached Residential (R-3). The property to the east is zoned R-1 and is the City's Creekview Preserve Park. The applicant's property and the neighboring properties are occupied by a residential homes on large lots. S. Natural Characteristics of Site There is a slight slope located on the eastern portion of the property that slopes east. There is a wetland located near the northwestern edge of the property. The proposed location of the building site is centrally located and on the northern edge of the property. S. ANALYSIS OF CONDITIONAL USE PERMIT: A. Conditional Use Permit The Planning Commission must review the application for a conditional use permit with the standards provided in Section 90-37 of Comprehensive Land Use Regulations. Staff used these standards to review the application and found that the request meets all applicable standards as follows: 1. The proposed use is permissible by law. The proposed use is permissible by law. 2. The proposed use is keeping with the spirit and intent of the ordinance. The spirit and intent of the ordinance is to allow property owners to conduct indoor horse riding arenas, as long as they comply with the regulations. The applicant lives on 12.11 acres and can meet all other the regulations in the indoor riding arena ordinance. It's in staff's opinion that the use meets the spirit and intent of the ordinance. 3. The proposed use is compatible with the City's Comprehensive Plan and the character of the surrounding area. Vint CUP Page 3 The use is appropriate for the property. The applicant's property and the neighboring properties are on large lots. Neighboring properties are similar in size to the applicant's property include accessory structures and are agricultural in nature. The character of the surrounding area is agricultural and it is in staff opinion that the use would not alter that the character of the area. 4. The proposed use has adequate drainage, water supply, electrical, gas, and sewage treatment facilities. Staff does not foresee any problems with utilities or drainage. 5. The proposed use has adequate road access. The property has adequate access from Elmcrest Avenue North to the property. 6. Technical Evaluation of Floodplain. The applicant is not proposing to impact any floodplain. 7. The proposed use should not increase the potential for flood damage. The proposed use would not obstruct the floodplain or increase the potential for flooding. 8. The proposed use will not damage or reduce the benefits the public receives from public waters. The proposed use would not damage or reduce the benefits from any public waters. 9. The use of watercraft on public waters. The proposed use would not involve the use of watercraft on public waters. 10. All structures shall be screened from view of public waters. The proposed use would not be visible from public waters. 11. Wetland impacts. The use would not impact any wetlands. 12. Allstate and local permits shall be acquired for the conditional use. The applicant would be responsible for obtaining all state and local permits. 13. Adequate screening and buffering from non -compatible uses and public rights-of-way. The driveway is off of Elmcrest Avenue North, in the western portion of the property. The proposed location for the indoor horse riding arena is behind the principle building structure and in the center portion of the property. There are trees and wetlands in the western portion of the Vint CUP Page 4 property that provides screening from Elmcrest Avenue North. The use would not be easily seen from Elmcrest Avenue North and is compatible with the surrounding properties. 5. CONCLUSION The applicant would like to obtain a conditional use permit for an indoor riding arena. The applicant's property and the neighboring properties were previously zoned Agricultural. The agricultural use of the area is still present. Because of this, an indoor riding arena would not be out of character with the surrounding area. The applicant is asking to use her land in a reasonable manner. 6. RECOMMENDATION: It's in staffs opinion that the applicant meets all requirements necessary to approve a conditional use permit. Staff recommends approval of the conditional use permit for a 6,600 square foot indoor horse riding arena for the property located at 13961 Elmcrest Avenue North. ATTACHMENTS: 1. Resolution 2. The size if the arena will be between 60 x 110 and it will be built on the northern edge of said property running east/west as indicated on site map. Currently the building site is a paddock area primarily sand and grass with a small loafing shed. This area is not near any waterways, drainage or wetlands that would restrict building on this site. The structure will adhere to all building codes and all permits will be pulled accordingly. The structure will have soft footing and no concrete slabs will be poured. I plan on landscaping with pines and shrubbery. The color of the building will match home or existing buildings on property. I purchased this home in 2010 and I have continued to make improvements to the property and home. My current neighbors farm their property and I feel that I am in compliance with having a small hobby farm and I would like to utilize my property for its said use all year round. Site Plan and Conditional Use Permit Amendment for a 4,560 square foot building addition. DATE: June 19, 2014 for the Planning Commission Meeting of June 26, 2014 COMPREHENSIVE PLAN: Public/Quasi-Public (PQ) ZONING: Central Residential (CR -3) REVIEW DEADLINE: July 20, 2014 1. DESCRIPTION OF REQUEST: The applicant is requesting approval of a site plan and conditional use permit (CUP) amendment for a building addition on the property located at 6000 148t11 Street North. The site plan is for a 4,560 square foot building addition to the 5,965 square foot church on the 6.36 acre parcel. A CUP is required for a Place of Worship to be located in the Central Residential (CR -3) zoning district and the amendment is required for the building addition. The property has several CUP's for the church for the use, a preschool/daycare, a bell tower, and off-site directional signs. All of the uses, except the church, are being conducted on the property. It is the applicants desire to remove these uses allowed by prior CUP's. The CUP amendment will supersede all of the existing CUP approvals. 2. BACKGROUND: In addition to the City Code and Comprehensive Plan the City must comply with the federal law known as the Religious Land Use and Institutionalized Persons Act (RLUIPA). The law protects religious institutions from unduly burdensome and discriminatory land use regulations. A City cannot impede on the ability of churches or other religious institutions to carry out their mission of serving the religious needs of their members. A City would have to show a compelling reason for imposing a regulation that may impede on the ability of the church or other religious institution to carry out their religious mission. Page 2 3. LEVEL OF DISCRETION IN DECISION-MAKING The City's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If it meets these standards, the City must then approve the site plan. If it meets these standards, the City must approve the conditional use permit. 4. CONTEXT: A. Surrounding Land Use and Zoning The property to the north is zoned Low Density Multiple Family Residential (R-4) and is occupied by the Twin Pines development. The properties to the east, south, and west are zoned Central Residential (CR -3) are occupied by the Hugo Elementary School and single family homes. B. Natural Characteristics of Site The property is generally flat. There are no wetlands on the property. 5. ANALYSIS: A. Site Plan The site plan is for a 4,560 square foot addition to the existing 5,965 square foot church. Building Setbacks The CR -3 zoning district requires a 25 -foot front and rear yard setback and a 10 -foot side yard setback. The site plan complies with the setback requirements. Building Coverage and Lot Coverage The CR -3 zoning district limits maximum lot area to be covered by a building to 40% and maximum lot area to be covered by impervious surface to 70%. The site plan complies with the coverage requirements. Building Height The CR -3 zoning district has a maximum building height of 35 feet. They are proposing the height of the building addition to be 20 feet. Architecture and Building Materials The majority of the existing building is constructed of concrete block with portions containing cement siding and shakes. The applicant is proposing the majority of the addition to include cement siding to match the existing concrete block and siding. The applicant has provided staff with a material sample board. Staff is comfortable with the material and color selection and they will blend in well with the existing materials and colors. There is a canopy proposed over the entrance to the building addition. The end of the canopy will include the shake siding to match the shakes over the existing main entrance. The canopy will include the cement siding. The building addition meets the intent of the Commercial and Industrial Design Guidelines for building additions. Screening and Fencing The applicant is proposing to screen the ground mechanical equipment with a combination of a four foot wood privacy fence and landscaping. 4 Page 5 There is an existing four foot chain link fence on the east side of the building for a play area for the children that attend the church. This fence is proposed to remain. Parking According to the Section 90-253 PARKING of the City Code, based on the use and the size of the building the total number of parking spaces required is 98. There are 99 parking spaces, which exceeds the ordinance standards. The applicant also has an agreement with Hugo Elementary School for overflow parking, if needed. The vehicle circulation within the parking lot works well. The applicant meets the ordinance standards. Landscaping Section 90-181 LANDSCAPING of the City Code provides landscaping requirements for development. In order to meet the landscape requirements, 6 overstory deciduous trees, 6 coniferous trees, 6 ornamental trees, and 35 shrubs are required to be installed. The applicant currently has 50+ overstory deciduous trees, 6 coniferous trees, 1 ornamental trees, and 19 shrubs, and several annual and perennials installed on the property. The applicant has not submitted a formal landscape plan for approval. They have stated that they will be working with a church subcommittee to create with the landscape pian and to use a local nursery to help with the plan. Staff will continue to work with the applicant on the landscape plan that will meet the ordinance requirements, prior to the issuance of a building permit for the addition. The applicant is proposing the ground cover to be sod around the building and seeded in the remaining areas. An irrigation system is not proposed, but the applicant will be installing more rain barrels in addition to the existing barrels to water the plans. Sidewalks and Trails There is an existing sidewalk along the north side of 148' Street that extends to the western edge of the existing entrance to the site. The Comprehensive Plan does not anticipate the need for a side walk or trail to be extended further east. The applicant is not proposed to extend the sidewalk. There is an existing sidewalk to access the building from the parking lot. The applicant is proposing to install additional concrete for the sidewalk to extend to the entrance for the building addition. Lighting The ordinance requires lighting to consist of cut-off fixtures and for light cast on adjacent property and roads not to exceed '/2 foot candle measured at the property line or 1 foot candle measured at the street's centerline. GJ Page 6 There are four pole mounted lights that are existing in the parking lot. The applicant is not proposing additional pole mounted lights. The applicant will be installing wall mounted light fixtures on the addition. They have not decided on a style and type at this time. The wall mounted light fixtures shall be downcast cut-off fixtures will a recessed light bulb. Staff shall review and approve the fixtures prior to the issuance of a building permit. Signage There is an existing monument sign at the entrance of the site. The applicant is not proposing any additional signage at this time. A sign permit is required for all signs installed on the building or property. Streets and Access The property has and existing access into the site off of 1011 Street. Utilities The proposed addition will utilize the existing building's sanitary sewer and water services. Stormwater Management Based in the size and scope of the project, a stormwater permit is not required. The applicant has submitted an erosion control plan that has been reviewed by staff. Staff will continue to work with the applicant on a few minor revisions to the plans that shall be approved by staff prior to the issuance of a building permit. Wetlands There are no wetlands on the property. Parkland Dedication Park dedication is not required for non-residential developments. 6. CONCLUSION: It's in staff's opinion that the proposal meets all the necessary requirements to approve a conditional use permit amendment and site plan. Staff is comfortable with the site plan as it is proposed. 7. STAFF RECOMMENDATION: Staff recommend approval of the conditional use permit amendment and site plan subject to the findings and conditions in the attached resolutions. 10 Page 7 Staff recommends the Planning Commission make recommendations to the City Council on the applications and resolutions in following order: 1. WHEREAS, a special use permit was approved on September 16, 1985, and amended on June 7, 2004, for an off-site directional sign. WHEREAS, a special use permit was approved on May 1, 1995, for a bell tower to constructed on the property. WHEREAS, the above uses were not constructed and have been abandoned. WHEREAS, a special use permit was approved on May 6, 1976, for the church use to be allowed on the property. WHEREAS, it is the desire of the applicant to amend the special use permit approved on May 6, 1976, to allow the building addition and to supersede all other prior special use permit approvals. The additional space includes a social hall, additional classrooms, offices and support activities. The Church does not anticipate that the new social hall and the existing sanctuary space will be used during the same hours. The interior remodeling of their existing building will include defining the space of the sanctuary to a more limited size and making the leftover space available for small group meetings. Because the number of parking spaces currently on site exceeds the City requirement, no additional parking spaces are being considered. Note that the neighboring elementary school has parking spaces adjacent to the church parking lot and the church and school have agreed to a shared parking agreement which has been successfully in place for a number of years. The church also has considerable unused land available should parking ever become an issue. Description of Site Zoning Classification: CR -3 Central Residential Site Description: The site contains a single -story church building with a lawn area and bituminous paved parking area on the south side of the site. The north side of the site is generally undeveloped with light grass and plantings. A portion of land in the northwest corner of the site was wooded with mature trees.
