Newly appointed Commissioner Kelly Bailly read the Oath of Office.
Call to Order
Chairperson Schumann called the meeting to order at 7:05 p.m.

Minutes for Planning Commission Meeting May 9, 2002
Peltier made motion, Malaski seconded, to recommend approval of the Planning Commission
minutes for May 9, 2002.
All Ayes. Motion carried.
Jackson Campus Development
The Planning Commission considered the application of Tom Jackson and Judy Marier, 21262
Floral Bay North, Forest Lake, for a conditional use permit for a campus development on Lot 4,
Block 1, Bald Eagle Industrial Park 4th Addition and site plan approval for a 19,200 square foot
building on the site. The conditional use permit would be for a campus development to allow
multiple buildings on the property; however, the applicant was only seeking site plan approval for
the first building. The future buildings in the campus development would receive access from a
future road/driveway to the north on the City property for which the City Council had not formally
approved the construction. A condition in the draft resolution required this access to be
constructed prior to allowing additional development on the property.
The proposed building would be an office/warehouse condominium building divided into eight
2,400 square foot tenant spaces. Depending on future uses, one tenant could occupy more than
one space. Under the proposed condominium concept, each tenant would own their individual
space and pay monthly fees for the upkeep of the exterior improvements.
Staff found the proposed site plan complied with the City's regulations regarding building height,
building setbacks, parking, impervious surface, exterior lighting, and building materials. Staff also

found it did not comply with the City's landscaping ordinance and included a condition in the draft
resolution that required the applicant to submit a revised landscaping plan, prior to issuance of a
building permit, demonstrating compliance.
Schumann asked Mr. Jackson if he understood that the remainder of his property may never have
access, and Jackson said he fully understood he might never be able to develop it.
The site plan also includes some limited outside storage to the east of the building. This storage area
would be fenced and screened from Fenway Boulevard. Malaski was concerned that the storage
would be visible from the any future road built between the Jackson property and the City owned
property. Jackson said he would comply with the City's ordinance regarding exterior storage.
Tim Stockness, 3065 Spruce Street, Little Canada, developer of the Jackson parcel, said he
anticipated selling condominium units to small contractors, such as carpenters, electricians,
plumbers, etc. Rosenquist said he was concerned this would include the storage of contractor
equipment and Planner Kendra Lindahl said a condition could be added to ensure proper
screening.
McRoberts asked if the road could go on the Jackson property. Jackson said it could not because
of the pipeline easement.
Marvin DeJear from the Koch Pipeline Company answered questions from the Commission about
what is permissible in a pipeline easement. DeJear said no above ground obstructions were
allowed in the easement; trees planted along easement could not obstruct an aerial view of the
easement. DeJear also stated that any driveways crossing easements must be perpendicular to the
pipeline. Jackson stated that they were working with Koch to obtain the necessary permits.
DeJear said he was concerned about the portion of the fenced in storage area on the easement and
Jackson said he would revise the plan to eliminate it.
Jackson said there would be excess dirt when the building was constructed and Bailly suggested it
be used for berming along Fenway. Lindahl said she didn't recommend a berm because it would
decrease visibility of motorists.
Malaski made motion, Schumann seconded to recommend approval of the resolution, adding a
condition that storage be in the fenced in area only.

Concept Plan — Miller Property
The Commission provided Edina Development Corporation an opportunity to appear before the
Planning Commission to present a concept plan for a housing development on approximately 119
acres. The development would be located north of CSAH 8 and east of Everton Avenue and
would consist of approximately 600 attached single-family homes (townhomes and twinhomes).
Pulte Homes would be the exclusive builder for the project.

The Planning Commission reviewed the plat and provided their comments. The Commission
suggested they decrease the amount of units and increase the park/open space, increase berming
and screening, address wetland, transportation, infrastructure, and access issues, and talk to the
gas line company regarding their easement across the property.
Mike Brahm from John Oliver and Associates, said their access complies with the Everton
Avenue Study and that they wished to begin grading this fall. Schumann told him they were being
very optimistic.
The Commission suggested the proposed plat be brought before the Parks Commission for
comment.
