Chairperson Schumann called the meeting to order at 7:01 p.m.

Minutes for Planning Commission Meeting ,Tune 27, 2002
Bailly made motion, Peltier seconded, to recommend approval of the minutes for June 27, 2002 as
amended.
All Ayes. Motion carried.
Thompson CUP
The Commission held a public hearing to consider the application of Dennis and Ann Thompson
for a conditional use permit to construct a 4,500 square foot pole building on their property at
13755 Elmcrest Avenue North. The maximum size of an accessory building is 3,600 on parcels
greater than 10 acres in size. Accessory buildings up to 125 percent of the size permitted are
allowed by a conditional use permit.
The property is 15 acres in size and the proposed pole building would be located to the rear of the
parcel and would meet all setbacks. Staff found that the building would be consistent with the
character the area, and there were other parcels in this general area with large accessory buildings.
Because the building would be 70 feet from the nearest property line, staff found that no screening or
buffering would be necessary.
Schumann opened the public hearing. There were no comments, so Schumann closed the public
hearing.
Dennis Thompson said a portion of the building would be used for an office and gym for his
children and, should the ordinance be modified, a home-based business.

Rosenquist cautioned that the building be constructed to meet commercial standards should a
home-based business be allowed there.
Kleissler asked Thompson if he understood that the conditional use permit was only for the
construction of the pole building. Thompson said he understood that he would need to apply for a
conditional use permit for the business should the ordinance be changed to allow it.
Malaski made motion, Peltier seconded, to recommend approval of the conditional use permit to
allow a 4,500 square foot pole building at 13755 Elmcrest Avenue North.
All Ayes. Motion carried.
North Suburban Development - Oneka Lake View South Plat
The Planning Commission held a public hearing to consider the application of North Suburban
Development, 1630 NE Highway 10, Spring Lake Park for a conditional use permit and
preliminary plat approval for six twinhome lots on 20.09 acres located south of Oneka Lake
Boulevard between Geneva Avenue and Goodview Avenue.
Staff recommended denial of the conditional use permit and preliminary plat. Staff found that,
because of the wetlands, it would be difficult for the twinhomes to meet the minimum floor area
requirement for single family homes, which is 960 feet for single level homes and 1,200 square
feet for two level homes, and the lots would have very limited yard space. Staff also found that
the development would not have adequate access, and the common driveway would encroach
upon the drainage and utility easement. Staff felt the applicant could enjoy a reasonable use of the
property by constructing a single-family home on the lot.
Schumann opened the public hearing.
Leroy Miller, 6129 150th St. N., asked if it was the same developer who did the Oneka Lake View
townhomes he lived in.
Engineer Ken Gust said the property would be sold to Seth Marshall, 14641 Krypton St., Ramsey,
if the plat is approved.
Miller said he there was already a lot of traffic on Oneka Lake Boulevard, and the land they were
proposing to build the townhomes on was a swamp.
Diane LaRock, 6117 1501h St. N., was not in favor of the development because of the access to
Oneka Lake Boulevard. LaRock said the Oneka Lake Townhomes had been denied access to
Oneka Lake Boulevard because it was determined to be hazardous.
A resident at 6137 150`h St. N., said he was not in favor of the development because it would
impact the wetland easements and he felt the wetlands should be preserved.

Rosemary Gorence, 6125 150`h St. N., presented the Planning Commission a petition signed by 29
property owners that stated they disapproved of the proposed development.
Ken Gust, Engineer, said that when the infrastructure was put in for the Oneka Lake View
Townhomes, it was constructed to accommodate the subject property.
Residents of the Oneka Lake View Townhomes stated their displeasure with the builder of their
homes.
There were no other comments and Schumann closed the public hearing.
Rosenquist said the Commission should follow staff's recommendation to deny the application.
Peltier said she felt it was no place to build a home.
Malaski was concerned with traffic issues and whether the common drive would accommodate
fire and emergency vehicles.
Kleissler agreed that they should follow staff's recommendation. She said that, should Oneka
Lake Boulevard be widened, the homes would be too close to the road.
Schumann said there would be too much impervious surface, and development should be
consistent with the single family housing on the south side of Oneka Lake Boulevard.
Schumann made motion, Peltier seconded, to recommend denial of the conditional use permit and
preliminary plat for Oneka Lake View South.
All Ayes. Motion carried.
Lakeview Hugo LLP — Legacy Plat
The Commission held a public hearing to consider the application of Lakeview Hugo, LLP, 3500
Willow Lake Boulevard, Vadnais Heights, to rezone to PUD, approval of a PUD general plan and
approval of a preliminary plat to be known as "Legacy" for property located east of Elmcrest
Avenue, west of Fenway Boulevard, north of 130`h Street and south of 1401h Street.
The development team consists of Len Pratt, John Peterson, and Derek Passe, who were in
attendance at the meeting to answer questions from the Commission.
Approval of the preliminary plat would allow the creation of 52 single-family detached home lots
and three outlots on the 102 -acre site. The development would provide two outlots proposed for a
City park and common open space, and an outlot for a future phase of development. The existing
home on the site would be incorporated into the first phase of construction.
The applicant requested approval of a rezoning from R -3/R-1 to PUD in order to provide smaller
lots east of Clearwater Creek. Staff found it would be consistent with the Comprehensive Plan

and met the intent of the PUD zoning district by providing integrated lifestyles and life cycle
housing, and preserving the natural features of the property.
The developer would provide new public streets to serve the proposed homes. The developer
would extend the public street from the Centex development on the east and would wind the
public street through the development. City staff (including the City Engineer and Fire Chief) had
reviewed the proposed one-way streets and were recommending some minor revisions. Staff
found the development also exceeded the minimum parking requirements.
The developer requested 6 -foot garage side yard setbacks where 10 feet is normally required. The
10 -foot side yard setback would be retained on the living area side of the homes. The reduced
setback would allow the developer provide smaller yard areas in the two blocks adjacent to the
Centex development. The homes on these lots would be part of a homeowners association that
would maintain the yard areas. The homes would provide a transition from the adjacent
townhomes on the east and south to the larger single family detached home lots in the western
portion of this development.
The City had identified the need for a trail along the main street through this project. The
developer proposed to construct an 8 -foot trail to provide access through this site to the proposed
City park. Staff recommended the developer provide a trail on the north side of the entry drive
between the Centex development and the first north/south cul de sac.
The City -owned Clearwater Creek Park is adjacent to this property --directly northeast of this
initial phase. This park would provide most of the recreational need of the residents in this area,
but the developer has also proposed to provide Outlot A as an active City park. The Park
Commission reviewed the plat at their July 10, 2002 and requested a trail and road extend into the
City Park.
Schumann opened the public hearing.
Dennis Thompson, 13755 Elmcrest Avenue North, was concerned about the shared driveway.
Thompson said it was a quiet road and was concerned it would turn into a short cut to the west.
John Peterson said they could put a chain across it that would allow emergency vehicles to drive
through it.
There were no other comments so Schumann closed the public hearing.
Malaski made motion, Kleissler seconded, to recommend approval of the ordinance approving the
rezoning to PUD, and approving the resolutions approving the findings of fact for rezoning, PUD
general plan, and preliminary plat, adding that conditions be added requiring an extension of the
cul-de-sac and trail to the City park, an easement for a future trail along Clearwater Creek, and the
shared driveway have adequate Class 5 rock and a breakaway gate approved by the Fire
Department.

Adequate Public Facilities Ordinance (Premature Subdivisions)
The Commission held a public hearing to consider an Adequate Public Facilities ordinance for
inclusion in the City's Comprehensive Land Use Regulations.
The ordinance would help prevent the premature subdivision of land by preventing subdivisions
that do not provide adequate infrastructure and in instances where the CIP does not provide the
needed improvements within the necessary timeframe. The ordinance would only apply to
subdivision applications and not to existing lots of record.
Schumann opened the public hearing. There were no comments and Schumann closed the public
hearing.
Schumann made motion, Peltier seconded to recommend approval of the Adequate Public
Facilities ordinance.
All Ayes. Motion carried.
Transfer of Development Rights
The Community Development Director updated the Planning Commission on the Transfer of
Development Rights Committee. He said the Council would be talking about the formation and
goals of the Committee at the City Council meeting on July 15 and would be inquiring about
Commission members interested in serving on the Committee. Rosenquist, Schumann, and
Malaski stated their interest and the Community Development Director said he would forward it
to the Council.
