HomeMy WebLinkAbout2001.03.28 PC MinutesMINUTES HUGO PLANNING COMMISSION MARCH 28, 2001 Call to Order Chairperson Schumann called the meeting of the Hugo Planning Commission of March 28, 2001 to order at 7:05 p.m. PRESENT: Kleissler, McRoberts (arrived at 7:15), Peltier, Rooney, Rosenquist, Schumann ALSO PRESENT: Community Development Director, John Rask Community Development Assistant, Michele Lindau ABSENT: Malaski Minutes for March 13, 2001 Rooney made motion, Peltier seconded, to approve the minutes for March 13, 2001 as submitted. All Ayes. Motion carried. Minutes for March 20, 2001 Peltier made motion, Rooney seconded, to approve the minutes for March 20, 2001 as amended. Ayes: Peltier, Rooney, Rosenquist, Schumann. Abstained: Kleissler Motion carried. Minutes for March 22, 2001 Rosenquist made motion, Peltier seconded, to approve the minutes for March 22, 2001 as amended. All Ayes. Motion carried. Special Use Permit (Colonna) The Planning Commission held a public hearing to consider the request of Emanuel Colonna, 4720 1701h St. N. for a Conditional Use Permit for an accessory apartment to be located on his property at 4720 17& Street North, which is a 37 -acre parcel in the Agricultural zoning district. The accessory apartment would consist of a modular home, and would be served by a separate well and septic system. Colona stated in his application that the home would be occupied by his daughter who desires to establish a temporary residence due to an illness. MCROBERTS ARRIVED AT 7:15 PM. rhe Community Development Director reviewed his staff report with the Planning Commission, recommending Planning Commission Meeting March 28, 2000- page 2 approval of the Conditional Use Permit. He also stated in his staff report that Chapter 40-12 of the City Code allows mobile homes or modular homes as a temporary residence in hardship situations, provide approval is granted by the City Council and the permit is renewed every 90 days. Because the family member intended to occupy the home for an extended period of time, the applicant requested a conditional use permit so the home could remain on the property without having to renew the permit every 90 days, as well as pay $25.00. Schumann opened the public hearing. Colonna explained his daughter had kidney disease and they were uncertain at this time what the outcome would be. He said he considered subdividing the property to allow a principle dwelling on each parcel but it would be tough to do so because the wetlands would cause the property behind the home to become landlocked. There were no other comments. Schumann closed the public hearing. The Planning Commission discussed whether is should be handled as a hardship under City Code 40-12 and issued a temporary mobile home permit, or if a conditional use permit should be issued under Section 6.2 of the City Comprehensive Land Use Regulations. Schumann made motion, Peltier seconded, to recommend a temporary mobile home permit be issued per City Code Chapter 40-12, modifying the renewal requirement to have the permit renewed every year instead of every 90 days, and waving the $25.00 renewal fee. Ayes: Kleissler, Peltier, Rooney, Rosenquist, Schumann Nay: McRoberts Motion carried. THIS APPLICATION WAS DISSCUSSED AGAIN LATER THIS EVENING. Site Plan (Sixty-one Stop) The Planning Commission considered the application of Mark Granger for site plan approval for Sixty -One Stop Inc. for a 1, 120 square foot bank building and a 600 square foot addition to the convenience store building on the property located at 14815 Forest Boulevard North. Lake Area Bank would operate a branch office on the site consisting of several tellers and a drive up window. The Community Development Director reviewed his staff report with the Planning Commission, recommending denial of the site plan because the proposed site plan fails to comply with ordinance standards. The Planning Commission was in agreement that the site does not contain adequate parking, circulation, or stacking area for the proposed uses. Rosenquist made motion to table the request to allow them time to create another site plan. Other members of the Planning Commission said they wanted to hear from the applicant so they could give him feedback on the request. Rosenquist withdrew his motion. Planning Commission Meeting March 28, 2004 page 3 After discussion, the Planning Commission was in agreement that the following issues should be addressed: Parking Circulation of traffic -install signs Property line adjustment Fire Hydrants Traffic and pedestrian control Rosenquist made motion, McRoberts seconded, to table the request for site plan approval for the additions to the Sixty-one Stop building to allow the applicant to address the issues mentioned above and apply for the necessary variance and Conditional Use Permit. All Ayes. Motion carried. Special Use Permit (American Tower) At its February 28, 2001 meeting, the Planning tabled the request of American Tower, 11600 96h Avenue North, Maple Grove, for a Conditional Use Permit to construct and operate a 199' self-supporting lattice tower for the purpose of wireless communication. The Planning Commission tabled the request because the applicant had not demonstrated compliance with the applicable provisions by failing to show the tower is needed to meet the provider's frequency reuse and spacing requirements. In a letter to the Community Development Director dated March 27, 2001, Jason Hall, Senior Zoning Representative for American Tower informed the City that he was withdrawing his application and was investigating the possibility of co -locating on a nearby site. McRoberts made motion, Rosenquist seconded, to bring the application off the table. All Ayes. Motion carried. Kleissler made motion, Peltier seconded, to accept the withdrawal of the application of American Tower. All Ayes. Motion carried. Site Plan Approval (Woody's Bar) At it's February 28, 2001 meeting, the Planning Commission considered an application from Brad Smith, owner and operator of Woody's Bar, for site plan approval to construct a 2, 060 square foot addition to Woody's Bar located at 12010 Keystone Avenue North. The same evening, the Board of Adjustments and Appeals considered a variance for a side -yard set back for the addition, and recommended denial. The Commission tabled action on the application to allow Smith to address concerns of the Commission pertaining to the size of the structure, parking and traffic, building codes, landscaping, and the adequacy of the existing foundation. The Community Development Director updated the Planning Commission on Smith's progress on the revisions to his site plan and told the Commission they could expect to have it before them at the Planning Commission meeting on April 25, 2001. Planning Commission Meeting March 28, 2000- page 4 :.and Use Regulations Revisions After a short break, the Planning Commission began discussion on the draft revisions to the City's Land Use Regulations. Special Use Permit (Colonna) REVISITED Emanuel Colonna returned to the meeting and Schumann opened the floor to him. Colonna expressed displeasure over the Planning Commission's decision to recommend a temporary mobile home permit instead of the requested conditional use permit. The Planning Commission explained to Colonna their reasons for their decision, and told him it was only a recommendation to the City Council and the Council may, or may not support it. Land Use Regulations Revisions CONTINUED The Planning Commission continued discussion of the draft revisions to the City's Land Use Regulations. Specifically discussioned were revisions to Home Occupations, Site Plan Reviews, and the Planned Unit Development (PUD) Zoning District. City Council member Mike Granger was at the meeting as the City Council liaison and was involved in some of the discussion. April Meetings Schumann made motion, Peltier seconded, to hold special meetings of the Planning Commission on April 17, 2001 and April 18, 2001 to continue work on the Land Use Regulations revisions. All AYES. Motion carried. Recess At 9:20 pm, Schumann made motion, Peltier seconded, to recess until the Everton Avenue meeting on March 29, 2001. All AYES.
