February 23, 2000
The meeting was called to order by Planning Commission Vice chairperson Schumann at 7:03 p.m.

Malaski made motion, Kleissler seconded, to approve the minutes of January 26, 2000, as amended.

Rezoning (Bernston)
The Planning Commission held a public hearing to consider the request of Brudette Bernston, 12686 Ethan
Ave., and Gabriel Bernston, 672 West Berwood Ave., Vadnais Heights, to rezone their property at 13845
Forest Blvd. N. from Residential to Residential Service to allow the present structure to be used as a small
office building. The property is generally located on the east side of Hwy 61, south of CSAH 8. The
Planning Commission considered a report by the City Planner on the proposed rezoning, recommending
denial of the zoning amendment because the parcel does not meet the minimum lot parcel size requirements
for the Residential Service Zoning District, nor would it meet the minimum lot width at the front setback
line.
Schumann asked if proper public notice was given, and the Deputy Clerk stated it was. Schumann opened
the public hearing, but there was no comment.
Brudette Bernston stated he felt his intended use of the property would not be intrusive to surrounding
zoning, and because of the adjacent commercial use, the property is not a desirable location for a residence.
Malaski felt the Bemstons' intended use of the property would be o.k. but was concerned with what future
property owners would be permitted to do should the property be zoned Residential Service.
Schumann agreed that the property was unsuitable for residential use, and cautioned Bernston that a service
road may be constructed in front of his property along Hwy 61 sometime in the future.
The City Planner stated the current building did meet the setback requirements but not the lot width
requirement, and Bernston stated he was pursuing the possible purchase of the adjacent property to the
south, which would put him in compliance with the ordinance.

Malaski made motion, Kleissler seconded, to recommend approval of rezoning 13845 Forest Boulevard
from Residential to Residential Service.
All AYES. Motion carried.
Plat Review (Jackson & Marier)
The Planning Commission held a public hearing to consider the request of Thomas E. Jackson & Judy Ann
Marier, 21262 Floral Bay North, Forest Lake, MN, to subdivide outlot A, Woods of Bald Eagle, into four
lots. The property is zoned Industrial and consists of 35.9 acres and is generally located on the west side of
TH61 and 1300' St. N. The Planning Commission had considered a report prepared by the City Planner
recommending approval of the preliminary plat for Bald Eagle Industrial Park, 4r' Addition, as it complies
with Hugo City Code Chapter 320, Section 7.17.
Schumann asked if proper public notice was given, and the Deputy Clerk stated it was. Schumann opened
the public hearing, but there was no comment.
Malaski made motion, Kleissler seconded, to recommend the approval of the preliminary plat for Bald
Eagle Industrial Park, 4h Addition.
All AYES. Motion carried.
Minor Subdivision (Mogren)
The Planning Commission held a public hearing to consider the request of Chris Mogren, 6006 25`h Circle
N., Oakdale, to subdivide a 25 acre parcel located at 7310 132"a St. N., into two equal parcels. Mogren also
requested a 30' wide driveway easement for access between the northern parcel and 132" St. The
Planning Commission considered a report prepared by the City Planner recommending denial of the
subdivision as Parcel A has no road frontage other than the proposed driveway easement. A 300' of public
road frontage is required in the Rural Residential Zoning District.
Schumann asked if proper public notice was given and the Deputy Clerk stated it was. Schumann opened
the public hearing.
Dean Stedt, owner of adjacent property, stated he had no problem with Mogren subdividing his property,
and that he may, in the future, apply to the City to subdivide his own.
Renee Glidden, 7215 137' St., property owner to the north of Mogren's, stated she was not in favor of the
land subdivision and felt the driveway easement would be setting the precedence for future subdivisions
with easements.
Schumann closed the public hearing.
Schumann made motion, Malaski second, to table the subdivision request to allow staff to explore the
possibility of a 66' wide driveway easement, which would provide for a city standard street in the future.

Site Plan Approval (Amcon Construction)
The Planning Commission considered the request of Amcon Construction Co., LLC, 200 West Highway
13, Burnsville, MN, for site plan approval to construct a 90,000 square foot industrial building on property
owned by the Jackson family in the Bald Eagle Industrial Park. The property is referred to as Lot 2, Block
1, Bald Eagle Park 4' Addition on the subdivision requested by the Jacksons. The Planning Commission
reviewed a report prepared by the City Planner recommending approval of the site plan.
The Planning Commission requested staff consider the following two items:
In the City Planner's report he stated that the four proposed manufactured models were not allowed because
they do not meet the minimal requirements for accessory buildings; and he also noted that the proposed
fences in the front yard portion of the site should maintain a front yard setback of 30' and not exceed 4' in
height.
Malaski made motion, Schumann seconded, to request the City Council address the above issues with the
developer and staff, and recommend approval of the site plan with the following conditions:
1. Colors of the building exterior material are to be neutral or earth tone.
2. As determined necessary, parapet walls will be placed to screen rooftop equipment from ground and
street views.
3. All trash handling materials and loading areas shall be fenced with materials consistent with exterior
facing materials of the principal building.
4. Ground level mechanical units must be low in profile and located to side or rear of the building.
5. All utilities must be constructed underground. Utility meters must be screened and/or integrated
into the building structure.
6. The applicant provides the recommended changes and/or additions to the site's landscaping plan
recommended by the City's landscape architect.
7. The applicant shall provide the recommended changes and/or additions made by the City Engineer
outlined in the SHE memorandum.
8. All signs proposed for the site must be in accordance with Hugo City Code, Chapter 320, Section
6.61.
9. Exterior lighting must be directed away from adjacent properties and roadways.
10. Grading and utility plans are to be reviewed and approved by the Rice Creek Watershed District.

Comprehensive Plan Amendment
The Planning Commission reviewed the proposed Comprehensive Plan Amendment to adjust the City's
2020 Urban Development Area around Oneka Lake.
Kleissler made motion, Malaski seconded, to hold a public hearing on March 22, 2000, on the adjustment
of the City's 2020 Urban Development Area.
All AYES. Motion carried.

Land Use Regulations Conflict
The Planning Commission had previously received a report from the City Attorney regarding conflicts in
the City's Land Use Regulations concerning the development of lots on septic systems within the City's
Urban Development Area.
After reviewing the proposed amendment, Kleissler made motion, Malaski seconded, to recommend the
following:
Eliminate Section 5.13C.
Change the wording on Section 5.13A to read "No Commercial, Industrial, or Urban Development Area
shall be subdivided or platted in such manner as to create a new parcel or lot of record unless it is served by
municipal sanitary sewer service. Each rural density lot or parcel created shall be evaluated and found
capable of holding an individual septic system constructed in accordance with City standards."
All AYES. Motion carried.
Ordinance Recommending Accessory Building Size
The Planning Commission reviewed a proposed ordinance amending the size of permitted accessory
buildings in the Urban Residential Zoning District.
The Planning Commission recommended approval of the ordinance as written. A public hearing will be
held by the City Council on March 6, 2000, for public comment on the proposed amendment.
Housing Policy
The City Council requested, at their meeting on February 22, 2000, the Planning Commission table
consideration of the proposed housing policy until the Planning Commission meeting on March 22, 2000,
when the City Council will be in attendance.
Schumann made motion, Kleissler seconded, to table discussion of the housing policy until March 22,
2000.

Malaski made motion, Kleissler seconded, to adjourn at 9:07 p.m.
