HomeMy WebLinkAbout2000.03.22 PC MinutesMINUTES FOR THE HUGO PLANNING COMMISSION MEETING March 22, 2000 The meeting was called to order by Planning Commission Chairperson Puleo 7:05 p.m. PRESENT: Kellison, McRoberts, Peltier, Schumann, Puleo City Administrator, Bob Museus Deputy Clerk, Michele Lindau City Planer, Jeff Lutz ABSENT: Kleissler, Malaski Minutes of February 23, 2000 Schumann made motion, Kellison seconded, to approve the minutes of February 22, 2000, as submitted. AYES: Kellison, Schumann, McRoberts ABSTAIN: Peltier, Puleo Motion carried. Minor Subdivision (Mogren) The Planning Commission considered the request of Chris Mogren, 6006 25th Circle N., Oakdale, to subdivide a 25 acre parcel located at 7310 132nd St. N. into two equal parcels. The Planning Commission held a public hearing on this request at their regular meeting of February 23, 2000, and tabled action on the subdivision to allow staff to explore the possibility of a 66' wide road right-of-way on the property rather than a driveway easement. Staff had no objection to establishing a 66' wide road right-of-way across the property as long as the roadway was improved to the City's rural minor street standard as part of the development, i.e. 24' wide paved 10 -ton road. Mr. Mogren asked the Planning Commission to table consideration of his request to allow him time to work out details with his surveyor. Schumann made motion, Peltier seconded, to table the request for the minor subdivision until the Planning Commission meeting of April 26, 2000. All AYES. Motion carried. 2020 Urban Development Boundary Adiustment The Planning Commission held a public hearing to consider an amendment to the Comprehensive Plan for an adjustment of the 2020 Urban Development Boundary and a revision to the City's Comprehensive Plan to reflect the City's use of the Centerville Interceptor along 145th Street. Specifically considered was removing 54.3 acres of agriculturally zoned property owned by Bernin and Riopel along the west edge of Oneka Lake from the City's 2020 Urban Development Area, and replace it with 74.8 acres owned by Puleo and Aplikowski along Forest Boulevard. One of the properties affected by the 2020 Urban Boundary change belonged to Planning Commission Member Frank Puleo, so he excused himself from the Commission and turned the chair over to vice - chairperson Schumann. Schumann asked if proper notice was published, and the Deputy Clerk stated it was. He then opened the public hearing. Minutes for the Planning Commission March 22, 2000 - Page 2 Julie Jeffery -Schwartz, appraiser for Lakestate Realty, stated the property proposed to be removed from the 2020 Urban Development Area would greatly reduce the value of the property because it would no longer be in the MUSA. She stated lake front parcels are a valuable tax base and would be a greater benefit to the City should it be developed. Also of concern was the City's Right of First Refusal to purchase the Bernin property since removing it from the service area would decrease its value, making it more attainable by the City. Ms. Jeffrey -Schwartz warned of possible legal ramifications should value be taken away from the property owners. Puleo, 6375 165th St. N., stated he had participated in an extensive Southwest Oneka Lake Stomwater Management Study with the understanding that Bernin and Riopel had no intention of developing the property and cleaning out the ditch, which would remove a large portion of the property from the flood plain. Bev Aplikowski stated she had requested her property be brought into the MUSA and was asked to participate in the ditch study which she did, feeling she would then be allowed to develop her property once the ditch was cleaned. Mike Riopel, 6421 165th St. N., stated he had no intention of developing now but wanted to continue to farm his property without possible complaints from future homeowners should the neighboring property be developed. Council Member Barnes felt the Metropolitan Council may recognize the stomwater plan and ditch project as being necessary for the orderly progression of land development, and may consider including all properties in separate phases. Schumann closed the public hearing. Kellison made motion, Peltier seconded, to table consideration of the 2020 Urban Development Area change to allow staff time to consider legal ramifications and speak to the Metropolitan Council. All AYES. Motion carried. Kellison made motion, McRoberts seconded, to recommend approval of amending the City's Comprehensive Sanitary Sewer Plan to reflect the City's intent to use the Metropolitan Council Environmental Services' trunk sewer main, which is to be constructed along Elmcrest Avenue and 145, St. All AYES. Motion carried. Zoning Code Amendment (Wagner Greenhouses) The Planning Commission held a public hearing to consider the request of Wagner Greenhouses, 6024 Penn Avenue South, for a Zoning Code Amendment to allow wholesale plant nurseries in the General Business District. This would allow for the continued use and possible expansion of their business located at 4860 Frenchman Road. Staff recommended that the amendment be denied, as it is not in conformance with the City's Comprehensive Plan. Puleo read the public notice and opened the meeting for comment but there was none. Planning Commission Member Puleo stated he would participate in the disucssion but abstain from voting, since he operated a similar business. Minutes for the Planning Commission March 22, 2000 - Page 3 Kellison felt the property along Frenchman road was prime land, and changing the zoning code could keep it from potential uses that would generate a higher tax base. Kellison made motion, Schumann seconded, to recommend denial of the amendment to the Zoning Code. AYES: Kellison, Schumann NAY: Peltier, McRoberts ABSTAIN: Puleo Motion failed. McRoberts made motion, Peltier seconded, to request staff explore other options that would allow Wagner Greenhouses to expand their business. AYE: McRoberts, Peltier, Schumann NAY: Kellison ABSTAIN: Puleo Motion carried. Conditional Use Permit (Ramberg) The Planning Commission held a public hearing to consider the request of Dan & Elaine Ramberg, 5676 1701h St. N., for two conditional use permits for adjoining properties at the above address. The applicant is requesting to use the property for commercial outdoor recreational purposes including rodeos, a retail tack shop, a commercial boarding facility, and other related activities. The City Planner read the notice as published in the White Bear Press, and Puleo opened the public hearing for discussion of the Conditional Use Permit request relating to commercial boarding, retail tack shop and the conduct of other horse related activities. Alan Olson, 5215 170th St. N., said the High School Rodeo last year was very loud and it continued late into the evening. He stated he was not opposed to the events held at Rambergs', but felt there should be conditions in the Conditional Use Permit addressing the hours of operation, lighting, traffic, noise, and number of events held annually. Ryan Miner, 6599 1701h St. N., felt many members of the community participated in the events and wanted to see them continue. He agreed there was noise, but it was not very often. Bob Lindell, 17115 Farnham Ave., stated he has no problems with the rodeo and related events. There were no other comments, and Puleo closed the public hearing. Kellison made motion, McRoberts seconded, to table consideration of the Conditional Use Permit for a commercial boarding and retail tack shop to allow the City Planner and Mr. Ramberg to establish the conditions of the permit. All AYES. Motion carried. Puleo opened the public hearing for discussion of the Conditional Use Permit request for rodeos and other horse related events. Minutes for the Planning Commission March 22, 2000 - Page 4 Alan Olson felt hours should be specified for each event, and activities should be in compliance with the noise ordinance. Bob LaCasse felt the speakers were unnecessarily loud. There were no other comments, and Puleo closed the public hearing. Kellison made motion, Peltier seconded, to table consideration of the Conditional Use Permit for Rodeos and other horse related events to allow the City Planner and Mr. Ramberg to establish the conditions of the permit. All AYES. Motion carried. Concept Review (Brandon Preserve) The Planning Commission discussed with Warren Olson, representing Cedarwood Homes, Inc., 2002 5th Street, White Bear Lake, MN, a concept for development of approximately 70 acres of property located in the northwest '/ of Sec. 33 into 12 homesites. Olson wanted to know if the City would allow for the increase in the lot density in recognition of certain currently platted lots being vacated and left as open space in part of the development, which the Planning Commission was not in favor of. The Planning Commission was also opposed to the length of the Cul-de-sac, which was longer than the allowed 1,320 feet in a cluster development. Mr. Olson stated he would revise the plan and requested to be on the Planning Commission agenda in April. HousinE Policy The Planning Commission had reviewed a draft policy for housing development in the community, as required by the Metropolitan Land Planning Act. City Council members Barnes and Leroux were present to discuss the policy with the Planning Commission. Minor changes are to be made, and the Policy to go to the City Council for review and approval.
