HomeMy WebLinkAbout1998.01.28 PC MinutesMINUTES FOR THE PLANNING COMMISSION MEETING OF 01/28/98 The meeting was called to order by Chair Peltier at 7:05PM. PRESENT: Peltier, Rubenzer, Schumann, Kellison, Malaski, Harrison, Puleo City Administrator, Robert A. Museus Schumann made motion, Malaski seconded, to approve the minutes for the Planning Commission meeting of December 17, 1997. VOTING AYE: Schumann, Kellison, Malaski, Harrison, Puleo ABSTAINED: Peltier and Rubenzer Motion Carried. SPECIAL USE PERMIT (LOWELL) Peltier opened the public hearing regarding the request of William and Charles Lowell, 5444 140th Street North, for a Special Use Permit to operate a body shop and maintain exterior storage on his property at the above address. The two acre property is zoned industrial, and both uses are allowed upon issuance of a SUP. Mr. Chuck Lowell addressed the Planning Commission and informed them of his intention to store miscellaneous construction materials on the property, and to lease the building to a number of tenants, one of which in an automobile repair shop that does minor body work, and thus the need for the SUP. An adjacent resident stated that he was concerned with the safety of the fence surround the property, and the appearance of the facility. The property owner of Lot 2, Block 3, Oneka Estates expressed concern regarding the noise and appearance of the property, and that he has had to call the Sheriffs Department regarding the noise from the property late at night. Mr. Galen Carlson, owner of North Country Auto, 5451 140th Street, expressed concerns regarding the operation of repair shop at the location without a paint booth, and questioned how hazardous materials from this site were to be handled. Kellison made motion, Peltier seconded, to recommend approval of the SUP to William and Charles Lowell, 5444 140th Street, for the operation of a body shop and maintenance of limited exterior storage outside the building, subject to the following conditions: 1. No torch or open flame will be allowed within the building. 2. Additional open fencing and landscaping will be constructed on the north and west property boundaries no later than July 1, 1998, in order to screen the exterior storage, and other activities on the site, from view of adjacent residential properties. Said screening and landscaping shall be reviewed and approved by the Planning Commission. 3. The address of the property be changed to reflect its location off Finale Avenue North. 4. Exterior storage at the site will be confined to building materials only. 5. Any exterior storage of motor vehicles, operable or inoperable, on the site will rescind the SUP. 6. Hours of operation for businesses on the site shall be limited as follows: Monday through Friday, 7:OOAM to 9:OOPM; Saturdays, 7:OOAM to 5:OOPM; Sundays, 9:OOAM to 3:OOPM. 7. This permit shall be issued for one year, at which time it may be considered for renewal upon application by the property owners. VOTING AYE: Peltier, Rubenzer, Kellison, Harrison, Puleo VOTING NAY: Malaski ABSTAINED: Schumann Motion Carried. REZONING REQUEST (INDYKIEWICZ) Mr. George A. Indykiewicz, 1920 W. Highway 96, Arden Hills, has requested to rezone existing agricultural property he owns to SFU for a future residential project. The property is located along the west side of Forest Boulevard, north of 155th Street, in the NE 1/4 of Section 17. The City's land -use plan guides the property for urban residential development. The City's sanitary sewer trunk system staging plan predicts development of the area during the period 2000-2010. Sanitary sewer service is available from the Forest Lake trunk interceptor along the west edge of the property, and municipal water service is available at 150th Street and Forest Boulevard. Chairman Peltier open the public hearing on this request. Mr. Jeff Shopek of Loucks and Associates, engineers for the project, represented Mr. Indykiewicz, and provided a brief description of the proposed project to construct single family residential homes on the site. He also discussed some of the constraints regarding the large amount of wetlands present. John Thommes, Thommes and Thomas Tree Service, supported the rezoning, but was concerned with the impact of additional residential properties adjacent to his business, and constraints it could place on the use of his property. Mr. LaMetti expressed concerns regarding the potential impact of residential property on use of his industrially -zoned property immediately to the north of the proposed development site. LaMetti operates a contracting business, and does preparation work on the site. He expressed concern that the noise of his equipment, and hours of operation, may disturb future residential property owners. There was some discussion regarding the large wetland barrier on the north side of the proposed residential development site, buffering Mr. LaMetti from the development. Peltier closed the hearing, and the following motion was made: Harrison made motion, Rubenzer seconded, to recommend approval of the request of George Indykiewicz to rezone approximately 165 acres from agriculture to SFU. VOTING AYE: Peltier, Rubenzer, Schumann, Kellison, Malaski, Harrison ABSTAINED: Puleo Motion Carried. The City Administrator then provided the Planning Commission a report briefing on the results of planning workshops conducted on the south Oneka Lake area highlighting the goals established by the work group at the meeting of October 29, 1997, found in the minutes of that meeting. Rubenzer made motion, Harrison seconded, to adjourn at 8:55PM. All aye. Motion Carried. Robert A. Museus City Administrator
