HomeMy WebLinkAbout1999.02.24 PC MinutesMINUTES FOR THE PLANNING COMMISSION MEETING OF 2-24-99 The meeting was called to order by Planning Commission member Schumann at 7:00 PM. PRESENT: Kellison, Kleissler, Malaski, Peltier, Schumann, Puleo City Administrator, Robert Museus Deputy Clerk, Michele Lindau Schumann made motion, Peltier seconded, to approve the minutes of January 27, 1998, as amended. Ayes: Kellison, Kleissler, Peltier, Schumann, Puleo Abstain: Malaski Motion carried. Beaver Ponds -Second Addition Oakwood Land Development Company, 1611 Highway 10, Spring Lake Park, MN, requested to develop the second phase of the Beaver Ponds Subdivision consisting of 32 townhomes along the south side of 130th St., east of Flay Avenue. Puleo read the public notice as published in the White Bear Press, and opened the meeting for public comment. Mr. John Peterson, owner of the Oakwood Land Development Company, presented the new plan showing the change in the number of townhomes. Previous preliminary plat approval for Phase 2 & 3 provided for four -unit townhomes in Phase 2. Mr. Peterson requested to change it to two unit townhomes. He also cited a change in the buildings along the wetlands in Phase 4. Tom Jackson, owner of a triangular section of land west of Phase 4, expressed his concern regarding sewer access, and requested the sewer be set at such an elevation to ensure it would be available to serve his property, and requested the charges to dump into the lift station be recalculated. Mr. Peterson responded by saying the sewer line would serve all of the Jackson property but only a portion of the Jesperson property. Jerry Hauble, 5460 125th St. N., would like the sewer elevations and gravity -feed system designed appropriately to accommodate his 80 acres to the south. Warren Arcand, 5510 130th St., was concerned about how his property to the north would be affected by the sewer line. Kevin Peltier, 13194 Goodview Ave. N, asked if the sewer hookups on the east end of their property line would change from the previously -approved Phase 2 plans. The City Administrator stated it should not affect his property and that the City Engineer was aware of Mr. Peltier's concerns. Puleo closed the public hearing. Kellison expressed approval of the reduction in density, but was concerned about how the roads will connect to future development in the area. Schumann stated Ferrara Avenue should be constructed all the way to the property line of the development. Schumann made motion, Malaski seconded, to recommend approval of Beaver Ponds Second Addition subject to the Findings of Fact and Recommendations. Ayes: Kellison, Kleissler, Malaski, Schumann, Puleo Nay: Peltier Motion carried. Special Use Permit -Wayne Scanlan Wayne Scanlan, 5379 Grand Ave., White Bear Lake, applied for a special use permit to construct a 44'X 70' horse barn, to replace an existing 40' X 120' horse barn, prior to construction of a house on the lot. The property is located in the Lakeshore Zoning District of Horseshoe Lake. Hugo City Code, Chapter 320-5, Subd. 8(1), states that no accessory building or use shall be constructed on a lot prior to the time of construction of the principal building to which it is accessory, except by special use permit. Mr. Scanlan explained that the existing horse barn is quickly rotting due to extensive water damage and expressed concerns about safely running his horse operation. Mr. Scanlan currently has 15 horses and is unable to keep all of them in the barn. Mr. Scanlan said he would be approaching the Planning Commission again in the near future to discuss issues involving the home he planned to construct such as driveway access and setbacks from the lake. Malaski questioned whether a special use permit should be permitted prior to addressing these issues. Mr. Scanlan assured the Planning Commission he would definitely be building the home, but the details would have to be worked out. Kellison felt a letter of credit would be necessary to ensure the house would be built. Kellison made motion, Peltier seconded, to recommend approval of the special use permit to construct a 44' x 70' accessory building prior to construction of residence with the following conditions: 1. The property owner is to combine Government Outlot 1 and 2, Section 4, T3 1N, R2 IW into one parcel of record. 2. Construction of a residence on the property is to commence within 18 months of the issuance of this SUP. 3. The existing 40' x 120' barn on the property shall be demolished and removed within twelve (12) months of the completion of the new barn. 4. The property owner is to provide the City with a letter of credit or cash deposit, in the amount of $10,000 to insure removal of the existing building and construction of the residence, as specified. 5. Use of the accessory building shall comply fully with the City's zoning ordinance. All Ayes. Motion carried. Site Plan Approval-Sotelo Body & Paint Mr. Brian McGoldrick, 14715 Square Lake Trail, Stillwater, MN, and Mr. Bruce A. Sotelo of Sotelo Body & Paint, 1556 5th St., White Bear Lake, MN, had requested site plan approval to use McGoldrick's building at 5100 130th St. N. (the old Dyna Glass building), for auto body repair and painting. The property is located in the City's Industrial Zoning District, which allows auto body repair shops as a permitted principal use. Bruce Sotelo and his fiancee, Nancy, were present at the meeting and stated that according to Mr. McGoldrick, an asphalt driveway was to be installed by September 1, 1999. They had also been working with the Fire Chief and Building Inspector regarding building code requirements. It was determined by the Planning Commission and staff that Mr. McGoldrick has not been in compliance with conditions of his previous site plan. Kellison made motion, Malaksi seconded, to table the site plan approval until the owner, Mr. McGoldrick, presented an adequate plan on how he will accommodate two tenants in the building. Ayes: Kellison, Kleissler, Malaski, Peltier, Puleo Abstain: Schumann Motion carried. Kellison directed staff to contact Mr. McGoldrick and advise him to be at the next meeting. Street Design Standards The Rice Creek Watershed District had requested the City of Hugo consider reducing its required street widths for urban residential development. The Planning Commission agreed the street issue should be considered Minutes for the Planning Commission February 24, 1999 - Page 3 Schumann requested staff obtain copies of "Residential Streets" by The American Society of Engineers for the Planning Commission and City Council. He also felt a joint meeting with the Parks Commission and an outside expert would be appropriate. New Easel or Board for Visual Displays Kellison made motion, Schumann seconded, to request staff purchase a new easel for residents, developers, etc., to use when presenting their plans. All Ayes. Motion carried. Staff Reports and Recommendations Kellison asked to have the staff reports and recommendations presented at the meetings prior to discussion of the issue and public hearings. It is felt that this would ensure all Planning Commission members and residents attending meetings are taking into account the same issues. Job Description for Planning Commission Members Puleo asked that staff continue to work on a job description for Planning Commission members. Planning Commission Vacancy Schumann expressed concern over the vacancy on the Planning Commission. The City Administrator informed him it was on the agenda for the next City Council meeting.
