PRESENT: Kellison, Kleissler, Malaski, Peterson, Puleo Peltier and Schumann arrived after roll call was taken. City Administrator, Robert Museus Deputy Clerk, Michele Lindau Minutes of April 28, 1999 Kleissler made motion, Malaski seconded, to approve the Planning Commission minutes for the meeting of April 28, 1999, as amended. AYES: Kellison, Kleissler, Peltier, Peterson, Schumann, Puleo ABSTAIN: Malaski Motion carried. Site Plan Approval (Sotello Body & Paint) Site Plan approval for Sotello Body & Paint, 5100 130th St., was first considered by the Planning Commission at their regular meeting of February 24, 1999, at which time the application was tabled in order to allow the applicant time to provide additional information. Mr. McGoldrick had since provided the City a new parking plan prepared by Humphrey Engineering of Woodville, WI, which had been approved by the City Engineer. Locations of two signs were identified on the plan, though no sign descriptions had been provided. McGoldrick had previously stated his intent to landscape the front with low growing bushes; however, no plan had been provide. Mr. McGoldrick was not present at the meeting. In a memo dated May 24, 1999, Sotello Body and Paint withdrew their application for site plan approval for a body shop on the site, but Mr. McGoldrick wished to continue for approval of the construction of the parking lot. Kellison made motion, Malaski seconded, to recommend denial of the site plan approval for Mr. McGoldrick due to lack of information provided.. Ayes: Kleissler, Malaski, Kellison Nays: Peltier, Peterson, Puleo Abstained: Schumann Motion failed. Schumann made motion, Peltier seconded, to recommend approval of the site plan provided Mr. McGoldrick addressed drainage issues and provided a parking and landscape plan to the City Council at their next scheduled meeting. Ayes: Puleo, Peterson, Peltier, Schumann Nays: Malaski, Kellison Abstain: Kleissler Motion carried. Eagle View Meadows Senior Housing PUD This matter was considered at the Planning Commission meeting of April 24, 1999, at which time it was tabled to allow the developer to provide more detailed utility plans and resolve an issue regarding storm water runoff from the site. Paul Kelliher, Project Manager, was present to answer questions from the Planning Commission. One issue of concern was the drainage from the site. Kelliher stated the runoff would be equal to or less than the present runoff, and much of the site would be sloped to the roadway with catchbasins draining into the ponds. Puleo was concerned about the runoff from behind the townhomes, which would be draining onto the sod fields. Minutes for the Planning Commission May 26, 1999 - Page 2 Another issue was the lift station, which Kelliher state would be accessible by roadway, and the property to the north and south would be stubbed for future development. It was noted that the City Engineer had not had a chance to review the plan and provide his comments on the lift station issue. Kleissler asked their reasons for constructing a private drive verses a City street, and was told by Kelliher that the smaller road would have less impervious service and would be maintained privately by a homeowners association. Kellison felt there was inadequate parking, and the density of 7.6 units per acre was too high. The City Administrator stated the utility and storm water plans had been submitted too late for the engineers to have adequate time to review them. Kellison made motion, Peltier seconded, to table the Planned Unit Development to be known as Eagle View Meadows until the next Planning Commission meeting on June 23, 1999. All Ayes. Motion carried. SUP Renewal (Thommes & Thomas Land Clearing) The Planning Commission held a public hearing to consider the request of Thommes and Thomas Land Clearing, located on 50.31 acres of vacant land adjoining 5728 165th St., for renewal of their special use permit to continue using the property specified above to process, store, and recycle tree waste. The property is generally located west of T.H. 61 and south of 165th St. The Planning Commission had reviewed a letter from the MN Department of Natural Resources directing the City not to issue large scale burning permits in the community. The letter stated that the public had become less tolerant of smelling and breathing smoke from large scale or frequent burning of tree debris. Dave Newberg, Attorney for Thommes & Thomas Land Clearing, was present and stated he had spoke to the DNR and was told the rules and regulations regarding burning had not been finalized. He asked that the special use permit be approved with modification to burn only as is allowed by the DNR. Kellison asked if the inability to burn wood would cause problems to the business. Thomas stated it would, and one way to ensure operation would be to bring in a tub grinder. He stated the tub grinder is very loud, and would be brought in as needed so the hours of operation would vary to whatever is economically feasible. It was determined that Thomas and Thommes would need a special use permit to run this grinder. Puleo open the meeting for public comment, but there was none It was stated the DNR had received complaints regarding large scale open burning, and the City had received a legal order not to allow it due to concerns regarding the air quality in the Metropolitan area. It was also felt that large amount of tree waste could create a hazard. Kellison made motion to deny the renewal of the special use permit for Thommes and Thomas Land Clearing. Motion failed due to the lack of a second. Schumann made motion, Peterson seconded, to extend the special use permit for 90 days, allowing them time to derive a way to dispose of wood, with a provision for no additional material accumulation on the site or unauthorized burning. Ayes: Kleissler, Peterson, Schumann, Puleo Nays: Kellison, Malaski, Peltier Motion carried. Special Use Permit Renewal (John Olsen) The Planning Commission held a public hearing to consider the request of John Olsen, 14728 Irish Ave., for renewal of his special use permit to use 20% of the 7.75 acres specified above to process and store wood. The Planning Commission considered a memo from the Hugo Fire Chief stating the DNR's authorization to the issuance of a limited scope burning permit to the Olsens for one more year. Also considered was a petition signed by neighbors supporting John Olsen's operation. Minutes for the Planning Commission May 26, 1999 - Page 3 John Olsen was present at the meeting and stated that he burned once a year for approximately two days. Puleo opened the meeting for public comment. Norman Danner, 8478 142nd St., stated he has never had a problem with the Olsen's operation, and Olsen had been a good neighbor, notifying the property owners in the area prior to burns. There were no other comments, and Puleo closed the public hearing. Schumann made motion, Malaski seconded to recommend approval of the Special Use Permit for one year in accordance with existing standards and conditions. All Ayes. Motion carried. Request to Construct 9100 Sp. Ft. Building (Chris Mogren) The Planning Commission held a public hearing to consider the request of Chris and Elisha Mogren, 7310 132nd St., N., to construct a 152' X 60' (9120 sq. ft.) pole building at the above address to house landscaping equipment and farming supplies. Schumann asked if the accessory building would be constructed prior to the principle residence. Chris Mogren stated he had pulled permits already; however, he will not build the home if he is unable to build the pole building as requested. Malaski asked why the pole barn materials had already been delivered to the site, and Mogren stated he was under the impression, when they were delivered, that he did not need approval from the City since he was in the Agricultural District. Hugo City Code, Chapter 320-4, Subd. C(3) allows the operation of nurseries and greenhouses under a special use permit in the Agricultural Zoning District but is silent regarding the operation of a landscaping business from the site. The storage of equipment and machinery and operation of a contracting business is an industrial use. Construction of a building of the size desired is a permitted accessory use in the Agricultural District, and the building may be used to store farming supplies. The use of the building for commercial and industrial purposes is prohibited. Malaski felt the building was extremely large, and asked what Mogren would be storing in it. Mogren replied it would be used for storage of his landscaping equipment, with a portion to be used for the production of bare root stock. Mogren stated his intention was to build it large enough initially, so he would never have to add on. Malaski, who had been out to the property, asked how the snow plow blades tied into his nursery business. Mogren said he did some snow plowing and the blades would also be stored in the building. Puleo opened the meeting for public comment. Joel Sivula, 7194 132nd St., stated he had no problem with the oversized building; however, he opposed the truck traffic that would be involved with the running of a commercial business from the site. Kevin Aufderhar, 7325 132nd St., asked Mogren if he planned on irrigating the property, since he was concerned about the effect it may have on the water table. Mogren stated the only watering he would be doing would be of seedlings. Puleo closed the public hearing. Some of the Planning Commission members felt the size of the building was not an issue, while some were concerned the large size of the building would enable it to be turned into a commercial business. Planning Commission members advised Mogren to work with the City Administrator on applying for a special use permit to accommodate what he would like to do on the property. Kellison made motion, Malaski seconded, to deny the request of the site plan due to the intended use of the building as stated in his application. All Ayes. Motion carried. Minutes for the Planning Commission May 26, 1999 - Page 4 Sparrow Crest - Minor Subdivision The Planning Commission held a public hearing to consider the request of Dan Sparrow, 14600 Geneva Ave., to subdivide 2.23 acres into three lots for single family homes to be known as Sparrow Crest. The property is generally located on the northeast corner of Egg Lake. Dan Sparrow was present at the meeting to answer questions from the Planning Commission. Of concern was where the 100 year water line was located, as it was not shown on the survey. Kellison questioned the plans for a bike path/sidewalk along Geneva Avenue, and the City Administrator stated the City would like to see a five foot (5') concrete sidewalk, and Sparrow felt it was reasonable. Puleo open the meeting for public comment but there was none. Kellison noted it was not in the present MUSA, and the Administrator stated Preliminary Plat approval would approve it as an addition to the MUSA. Kellison made motion, Peltier seconded, to approve the minor subdivision to be known as Sparrow Crest with the conditions as stated in the Findings of Fact and Recommendation. All Ayes. Motion carried. Sweet Grass 2nd Addition Subdivision The Planning Commission held a public hearing to consider the request of Joseph and Constance Marier, 5566 145th St. N., Quentin and Joan Marier, 6395 Oneka Lake Blvd., and K -G Development, Inc., 474 Apollo Drive, Lino Lakes, to subdivide approximately 47 acres into 95 lots for single family homes to be known as Sweet Grass Meadows Second Addition. The property is generally located at Oneka Lake Blvd. and Greene Ave. The Planning Commission reviewed a report by the City Engineer recommending that approval of the subdivision be delayed as adequate fire flows cannot be provided the development without extension of a watermain from T.H.61 along 152nd St., or until construction of an additional well and tower in the community Rocky Goertz, K -G Development, stating he was aware the 20 acres on the west end would not have sewer and water available to them until it was brought into the Peloquin Industrial Park. Goertz had water test done on the area and felt they showed there was significant water pressure. He was opposed to the tabling of the request because of the pending moratorium, and asked if he could be exempt from it. The City Administrator felt it would be the opinion of the City Attorney that the moratorium would put a halt on everything not already having preliminary plat approval. The Administrator stated the City was looking into building a new water tower, and possibly a water treatment plant would be constructed in the future. He also said there was no time line given yet for the Peloquin Industrial Park improvements, and felt the water tests Goertz had done were submitted too late to be reviewed by the City. Council Member Haas, who was present at the meeting, stated the moratorium issue would be discussed at their first meeting in June. Puleo opened the meeting for public comment Tom Raster, 15227 Greene Ave., felt the density was too high, approximately 20 times the density of the property on the east side of Greene Ave. He requested a condition of the development be to save the remaining treeline. He also stated he would like to see berms separating low and high density housing, and wanted to know what the Greene Avenue improvements will be costing the homeowners. Raster also requested to review the EAW that had been done. The City Administrator stated the petition for the improvements would be going to the City Council to determine if a feasibility report needed to be done by the City Engineer to determine the costs. Joe SanCartier, 15125 Greene Ave, felt the ditches along Greene Ave. may not be appropriate and would like to see bids on the curb and gutter work. Puleo made motion, Peterson seconded, to recommend approval of Sweet Grass Meadows 2nd Addition providing the water pressure issue is dealt with, the developers work with residents along Green Avenue to resolve the street issue, and additional trees are planted to provide extra screening. Ayes: Kellison, Kleissler, Malaski, Peterson, Schumann, Puleo Nay: Peltier Motion carried. Creekview Preserve 2nd Addition Subdivision Though a public hearing had been scheduled for consideration of preliminary plat for Creekview Preserve 2nd Addition, City Council had authorized the developer to proceed with final plat based on the previously approved preliminary plat for the development. No action by the Planning Commission was required on this issue. Wenzel Farm Planned Unit Development The Planning Commission conducted a public hearing to consider the request of Pratt -Amt -Oakwood Land Development, LLC, 1611 Highway 10, Spring Lake Park, to subdivide by PUD 212 acres to create commercial, townhome, and single family lots, to be known as Wenzel Farm. The property is generally located east of Elmcrest Ave., and north and south of CR8. The Planning Commission had available for their review the minutes of a meeting held between the developer, representatives of the City, and area agencies regarding the development, as well as a list of work that needed to be performed prior to granting PUD and plat approval. John Uban, Len Pratt, and John Peterson presented the Planned Unit Development to the Planning Commission, as well as detailed plans of their first phase, which would include single family homes. They stated their plan was created to accommodate the sense of progression throughout the development. Clustering of lots, averaging between 700 -- 1,900 square feet, would be done to create interior open space and trail corridors. Uban stated the water would be extended from Lino Lakes with a joint powers agreement. Their plans showed a reorientation of the road system, which would require vacating the southern portion of Elmcrest Avenue. Puleo opened the meeting for public comment. Ron McRoberts, 15111 Elmcrest, expressed concerns regarding the drainage to the north and the amount of traffic on Elmcrest Avenue, saying the intersection of Elmcrest and County Road 8 is already hazardous. He also felt the townhomes to the north are separated from the homes and trails to the south of Elmcrest Ave. There were no other comments, and Puleo closed the public hearing. Kellison made motion, Puleo seconded, to table the Planned Unit Development to be known as Wenzel Farm, in order to allow additional information to be generate. All Ayes. Motion carried. Schumann made motion, Kellison seconded, to request the City Council generate a joint meeting of the City Council, Planning Commission, and the Parks Commission. All Ayes. Motion carried. Site Plan Approval (Inter -State Lumber) Interstate Lumber Company, 5517 145th St., MN, had applied for site plan approval to replace storm damaged sheds on their property at the above address. Marvin LaValle asked if they were building in the same location, stating it was a non -conforming use, and if there was damage of more than 50%, it must be reconstructed to meet all existing setbacks. Minutes for the Planning Commission May 26, 1999 - Page 6 Kellison made motion, Schumann seconded, to table site plan approval until the meeting of June 23, 1999, to determine if there has been more than 50% damage done to the sheds.
