OCTOBER 27, 1999
The meeting was called to order by Planning Commission Chairperson Puleo at 7:00 p.m.
PRESENT: Kleissler, Peterson, Puleo.
Kellison arrived after the minutes of September 22,1999, were approved.

Minutes of September 22, 1999
Kleissler made motion, Puleo seconded, to approve the Planning Commission minutes for the meeting of September 22, 1999,
as submitted.
All Ayes. Motion carried.
Conditional Use Permit (Neamy)
Scott and Lea Ann Neamy, 17220 Keystone Ave. N., applied for a Conditional Use Permit to operate a children's day camp
and petting zoo at their property at the above address. The purpose of the permit was to establish the extent of the lawful non-
conforming use of the property. The Planning Commission previously tabled consideration of the application on two
occasions at the request of the property owner.
Attorney Fredrick Knaak, representing the Neamy's, addressed concerns they had regarding the draft Conditional Use Permit
as prepared by staff. He stated they felt the hours of operation and the numbers on maximum attendance were too restrictive,
the sunset clause was unnecessary and would prevent them passing the business on to their children, and the traffic growth on
Keystone Avenue was not due to their business activities.
The Planning Commission had concerns regarding the wording on some of the conditions of the draft Special Use Permit.
They felt there should be clarification on adequate sanitary facilities, the hours of operation and number of people using the
mini -golf facility should be specified, and parking and dust control issues should be addressed. The Planning Commission also
recommended amending the condition regarding the expiration of the permit to allow the Neamy's to transfer the ownership of
the Special Use Permit to their immediate descendants.
Robyn Bachmeier, 17191 Keystone Avenue, stated she was bothered by the increased traffic, littering, and wandering of
Neamy's guests onto her property.
Kellison felt the permit should be reworded in a way to ensure they would not be able to expand or enlarge their present
operation.
The Neamy's requested the Planning Commission table the issue to allow the permit to be amended.
Puleo made motion, Kellison seconded, to table consideration of the Neamy's request until the November meeting to allow
staff to amend the Special Use Permit and the Planning Commission to review to it.
All Ayes. Motion carried.
Rezone (Neeser and Peltier)
Jerry and Dorothy Neeser, 15815 Elmcrest Ave. N., requested to rezone approximately 124 acres of property they own from
Agricultural to Urban Residential. The property is part of the NE 1/4 of the SE 1/4 of Sec. 18. Mrs. Martha Peltier, 15367
Everton Ave. N., also applied to rezone approximately 100 acres of property she owns from Agricultural to Urban Residential.
The property is located in the NE 1/4 of the SE 1/4 of Sec. 18. The Planning Commission conducted a public hearing on both
requests at their regular meeting of July 28, 1999, and had tabled action pending a public planning workshop for the area,
which was conducted on September 9 and continued on September 23, 1999.

Puleo opened the meeting for public comment.
Dennis Todd, 5205 165th St. N., stated he was not in favor of the feeder road that was proposed to be constructed through his
back yard. He felt road issues should be considered prior to subdividing.
Diane Pooler, 16275 Elmcrest Ave. N., asked the Planning Commission to consider the impact new development in the area
would have on Elmcrest Avenue.
Arnie Triemert, 15220 Everton Ave. N., was concerned about the potential increase in traffic on Everton and opposed to
paying for road improvements.
John Udstuen, 15190 Everton Ave. N., felt Everton Ave. would generate too many cars and should not be allowed to run
through a residential area.
Jim Leroux, 4360 165th St. N., stated the properties had been sited for MUSA expansion since the 1970's, and felt the
rezoning was logical and development forthcoming.
Leroy Peltier, 15257 Everton Ave. N., was opposed to the current residents of Everton Avenue paying hefty assessments for
road improvements due to development.
Jerry Neezer, 15815 Elmcrest Ave. N., stated he lived there and farmed the land for 33 years, and he should be allowed to
retire and benefit from his investment in his property.
It was stated that the roads should not be an issue at this time, since the applications were for rezoning and not for the
subdivision of land.
Kellison made motion, Kleissler seconded, to recommend approval of rezoning the Neeser property, 15815 Elmcrest Ave. N.,
from Agricultural to Urban Residential.

from Agricultural to Urban Residential.

Rezone (McElmury)
The Planning Commission held a public hearing to consider the request of Robert T. McElmury, 1923 Stillwater St., White
Bear Lake, to rezone approximately 0.65 acres of property, located at 4444 129th Street N., from Urban Residential to
Residential Service. Mr. McElmury is owner and operator of Bobber's Boats and Bait at this location, which is on the
northwest side of Bald Eagle Lake and is subject to a Conditional Use Permit issued on May 3, 1993, allowing the operation of
a commercial marina and bait store on the property. Mr. McElmury last applied to rezone the property in 1996 and was
denied.
Being a neighbor of Bobbers's Boats and Bait, Kellison excused himself from the Planning Commission.
Puleo opened the public hearing.
Mr. McElmury stated he had been in business for several years, operating under a Conditional Use Permit, which he would
like to amend to allow him to expand his summer operation by adding more pontoons, and to operate in the winter for fish
house rental. He felt it was a recreational area and that his business serves many Hugo residents.

Brian Olson, 13037 Elmcrest Ave. N., stated he was on the Planning Commission on 1993 when McEhnury purchased the land
and the Conditional Use Permit was issued, at which time McElmury stated it would remain a small business. Olson said he
felt winter access to the lake would be very unsafe in that area.
Dave Pepin, 4510 129th St., was concerned that McElmury was not currently abiding by his Conditional Use Permit in regard
to hours of operation. He also felt he intentionally allowed winter access from his property by not putting up proper,
enforceable singage.
Tom Bleacky, 13015 Elmcrest Avenue, said guests of Bobber's Boats and Bait were loud, rude, and messy.
Jim Kellison, 4394 129th St. N., felt this would be a classic case of spot zoning, as there are no other businesses in the area,
and there would be no control over what would be permitted there in the future if it was rezoned to Residential Service.
Kellison also felt it would not be safe for winter lake access.
Puleo closed the public.
Puleo stated that rezoning the property would not eliminate the need for a Conditional Use Permit, and this would be spot
zoning, which he does not support.
Kleissler and Peterson were concerned that the current conditions of the permit were not being met, and allowing winter lake
access would be unsafe.
Puleo made motion, Kleissler seconded, to deny the special use permit to rezone McElmury's property from Urban
Residential to Residential Service.
All Ayes. Motion carried.
Letter in Response to letter from Council Person
Chairperson Puleo had drafted a letter for Planning Commission review in response to a letter received by Council Person Haas
regarding the job of the Planning Commission.
Kleissler made motion, Kellison seconded, to forward the letter to the City Council as written.
All Ayes. Motion carried.
Proposals for Professional Planning Services
The Hugo City Council has adopted a moratorium on new urban residential development in the community to allow the City to
expand the municipal water system, consider staffing requirements, and to review certain community development standards.
The Council authorized engaging a consulting planner to assist the Planning Commission in reviewing those planning issues
identified as part of the moratorium, including residential street design standards, planned unit density standards, residential lot
sizes, and open space requirements. The Planning Commission considered proposals from two firms to provide assistance to
the Planning Commission.
Kellison made motion, Puleo seconded, to accept the proposal from Sanders, Wacker, Bergly, Inc., to address the four issues
stated above.
All Ayes. Motion carried.
Housing Policy
The Planning Commission reviewed the draft proposed housing policy for the City of Hugo, with the amendments previously
requested by the Planning Commission.
The Planning Commission felt a public hearing should be held before discussing any additional changes to the policy.
Kellison made motion, Kleissler seconded, to schedule a public hearing on the City Housing Policy at the November meeting.

ChanEe of Meeting Date
The Planning Commission considered changing the November meeting date to November 17, 1999, to avoid the Thanksgiving
Holiday.
Kellison made motion, Kleissler seconded, to reschedule the November 24, 1999, meeting to November 17, 1999.
All Ayes. Motion carried.
Urban Sprawl Video
As requested by the Planning Commission at the September 22, 1999, meeting, they reviewed the short video "The Future is
Now, Putting a Stop to the High Cost of Urban Sprawl".
Kellison made motion, Kleissler seconded, to adjourn at 9:43 p.m.
