PRESENT: WALLER, AGNESS, SCHUMANN, RUBENZER, MALASKI, KELLISON, PELTIER ADMINISTRATOR MUSEUS, CAROLE LABELLE Motion made by Schumann° seconded by Kellison to approve the minutes of December 20, 1995, as amended. All aye, motion passed. Mr. Tomnitz will be unavailable for this meeting and has requested his application be tabled until February 28, 1996. Lauren McCullough Well Drilling, Inc., 15597 Forest Blvd., Hugo, has requested to rezone 2.8 acres of their property from retail business to industrial to allow the expansion of their business on the site. At issue is the firms desire to increase the amount of storage on site beyond the limits established for the retail business district. There is a small parcel of industrial zoned property immediately adjacent to the south. In addition there is industrial zoned property to the north and south that is not immediately adjacent. Granting this rezoning would essentially extend an industrial district from Peloquin Industrial Park north along Highway 61 to approximately 157th St. extended. There were no comments from the general public. Commissioner Waller felt the rezoning would be conducive to the area. Other Commissioners preferred to allow Mr. McCullough to expand his storage without rezoning the property. Motion made by Peltier to recommend approval of the rezoning from Retail Business to Industrial. Motion failed for lack of a second. Motion made by Kellison, seconded by Peltier to table the McCullough rezoning request until February 28, 1996, to allow the City attorney to review the application to see if there is a method for allowing additional storage on site without rezoning. A public hearing has been scheduled to consider the request of Mr. Richard Schreier, 95 South Owasso, St. Paul, to subdivide approximately 97 acres of agriculturally zoned property into 9 lots. All lots meet or exceed the ten acre minimum of this district. Percolation tests have been performed on all lots proposed, though the City has not yet received permits for them from Washington County. Wetland delineations have been performed on the property and are shown on the proposed plat but no permit has been P.C. Minutes - January 24, 1996 Page 2 (Schreier) received from the Rice Creek Watershed District. A portion of the proposed plat lies within the lakeshore district of Lake Plaisted. Street access to lots would be off existing roads, 140th St. and County Rd. 57. Driveway access permits will be required from Washington County for those lots abutting Co. Rd. 57. In addition, 140th St. is currently blocked by flood waters from Lake Plaisted. The City is currently working with May Township on the flooding problems being experienced in this area which will likely generate new floodplain elevations for Lake Plaisted. A Special Use Permit would be required for Lot 12 of the proposed subdivision for access to the site for a 1500' driveway. One resident raised the question of changes to taxes and land valuation to surrounding properties. Commissioner Kellison would prefer to see the property developed as clustered subdivision. Motion made by Kellison, seconded by Agness to recommend denial of the request for subdivision by Richard Schreier as submitted because of the 50' wide, 1500' long driveway access to Lot 9. Members voting AYE: Agness, Waller, Malaski, Kellison, Peltier Members voting NAY: Schumann, Rubenzer Motion passed. Applicant% %totod they will submit an application for subdivision for eight lots on this property. Robert and Ernestine Juran, 9988 122nd St. North have requested to subdivide 36.9 acres of agricultural property into three parcels. The Property is located in the northwest quadrant of the intersection of 122nd St. North and Keller Ave. North. All parcels as proposed would exceed the ten acre minimum lot size set for the agricultural district. Street access for all parcels come from the existing roads: 122nd St. and Co. Rd. 57. The City has not received permits for the septic systems to be located on parcels a and b, nor approval of the subdivision from the Rice Creek Watershed District. Parcels a and b will require driveway permits from Washington County. LaVayne Dupsloff, surveyor for Juran's request stated that an additional 25' easement would be provided on County Roads 57 and 7 as requested by the County. Patrick Rooney questioned the setbacks on proposed lots. Commissioner Waller felt the proposed lots were too narrow. Motion made by Agness, seconded by Rubenzer to recommend approval of the request of Robert and Ernestine Juran to subdivide 36.9 acres into three parcels subject to the following conditions: 1. Approval of the subdivision by Rice Creek Watershed District. 2. Septic System permits for parcels a and b. 3. Driveway permits from Washington County for parcels a and b. All aye, motion passed. Minutes - 1-24-96 Page 3 Mr. Rooney requested that if the meetings are going to be televised the public would appreciate each member using their microphones when speaking, as it is extremely, disconcerting when the sound and picture are unintelligible. Mr. John Bergman did not appear before the Commission with his concept plan for subdivision. Administrator Museus informed the Planning Commission that the Comprehensive Plan would be brought the Council on February 5th for final review and forwarded to other communities and the Met Council. Comments from other governmental agencies should be received by May or June. Jim Kellison noted that Wilson Tool has constructed a somewhat offensive crane and awning structure which is visible from Highway 61 and should have been included in a recent building permit. Mr. Kellison also stated that the public is now accessing Bald Eagle Lake, on snowmobiles, through Bobber's Boats and Bait which is in violation of his special use permit and there are no signs posted prohibiting access. Motion made by Rubenzer, seconded by Agness to adjourn at 9:12PM. All aye, motion passed.
