PRESENT: Agness, Waller, Schumann, Rubenzer, Kellison, Peltier ABSENT: Malaski Motion made by Kellison, seconded by Peltier to approve the Minutes of April 10, 1996, as amended. All aye, motion passed. Motion made by Schumann, seconded by Kellison, to approve the Minutes of April 24, 1996, as amended. All aye, motion passed. Motion made by Kellison, seconded by Agness to move the City's request for rezoning and subdivision from Item 12 to Item 6 on the agenda. All aye, motion passed. Dean and Ruby Atkinson are requesting renewal of a Mining Permit for mining, processing and recycling of material on the 40 acre site formerly known as the Goiffon Pit. Mr. Anthony Gleekel stated that the applicant is requesting the same permit approved in 1992, which allowed crushing and no limit on the amount of recyclable material. Mr. Gleekl informed the Commission that Bruce Malkerson was the attorney when this issue began in 1994. The applicants are requesting to process more than 50% of recyclable material if the market demands with an approximate amount of 301000 cubic yards of material. Mr. Gleekel pointed out that the adjacent mining operation was allowed a rock crusher. Mr. Gleekel questioned why there was no response to his letter of April 8, 1996, stating his clients concerns regarding the more restrictive permit. Motion made by Kellison, seconded by Peltier to recommend approval of a Mining Permit for Dean and Ruby Atkinson under the terms and conditions of the mining permit approved for the site in 1994. AYE: Schumann, Rubenzer, Kellison, Peltier NAY: Agness, Waller Motion passed. Jim Kellison excused himself from the Planning Commission and reviewing this issue. Robert McElmury is requesting to rezone the 0.6 acre property housing Bobber's Boats & Bait from Conservancy to Retail Business. The request is to facilitate the business plans to include ice house rental and storage and additional retail sales. P.C. Minutes - 5-22-96 Page 2 Surrounding residents opposed the rezoning and any increase in the commercial use of the property. It was also noted that the property is being purchased on contract for deed and the fee owner has not signed the application. One resident felt the rezoning was inappropriate but the SUP should be more lenient so as to allow winter use. Commissioners concurred that this would be considered a spot zoning and access to the lake is difficult. The number of variances required to bring the site into conformance with the CB district is excessive. Motion made by Schumann, seconded by Agness to recommend denial of the Rezoning request for 4444 129th St. North as it constitutes a spot zoning and is not in the health, safety, and welfare interests of the community to rezone this property to commercial use. All aye, motion passed. The City of Hugo is requesting to rezone one acre of a 42.43 acre parcel from SFU to CB adjacent to Highway 61, at the north end of Flay Ave. to allow for the construction of a post office. Administrator Museus stated that there is potential for Flay Avenue to become a through street, but at this time it is proposed to remain a cul-de-sac with no through traffic. Also, there could be ponding or a large wetland on the property. It was noted that the catholic church has expressed an interest in expanding their cemetery in this area, or the property would be used for public purpose. Bernie Brunotte stated that he felt this it would be inappropriate for the post office to be located in a residential area. Commissioner Agness questioned why there was such urgency in moving forward with this request, in 30 to 60 days, considering it has been an ongoing issue for two years. Motion made by Kellison, seconded by Rubenzer to recommend approval of the City's request to subdivide one acre from a 42.43 acre parcel subject to it being served by a cul-de-sac. AYE: Kellison, Rubenzer, Schumann, Peltier NAY: Agness, Waller Motion passed. Motion made by Kellison, seconded by Rubenzer to recommend approval of the rezoning of one acre from SFU to Concentrated Business as described in the survey dated 5-16-96. Minutes - 5-22-96 Page 3 SPECIAL USE PERMIT - WILLIAM LOWELL Mr. William Lowell has requested a Special Use Permit to allow exterior storage on his property at 5444 140th St. The city attorney and staff have reached an understanding with the applicant and his legal counsel that an SUP should include a building permit, certificate of occupancy, an approved parking plan, a detailed site plan with appropriate provisions for the screening of exterior storage, and either a combined or separate SUP for commercial use of the property. No additional information was provided to, nor contact with, the City by Mr. Lowell or his attorney prior to the meeting. Motion made by Kellison, seconded by Peltier to table this request until June 26, 1996. IAL USE PERMIT - FRANK PULED/GARY MARKOVICH Mr. Markovich is requesting a special use permit to enlarge a 1795 sq. ft. accessory building by 3800 sq. ft. The property is zoned SFE and currently has a Special Use Permit for manufacturing. The property also has an SUP for keeping up to three horses in the rear area of the lot. The property currently contains a rental mobile home, two sheds, (24 X 24 and 10 X 24) and a 1792 square foot building rented by Mr. Markovich for his handicap grab bar manufacturing business. Inspections of the property also identified four small recreational vehicles (4 wheelers) stored outside and a large truck trailer permanently parked next to the 32 X 56 foot building. The two sheds are in poor repair. Mr. Markovich stated that two storage buildings on site will be removed. He is requesting the additional building size for storage of materials purchased for his manufacturing business. Mr. Markovich added that he is not expanding his business and there will not be any additional employees. Mr. Markovich agreed to keep the square footage of the building and addition to 3600 sq. ft. Commissioner Kellison stated that to allow 1795 additional square feet of storage space far exceeds the limits allowed in the SFE zone. Other members felt this was an appropriate use for the property. Motion made by Rubenzer, seconded by Schumann to recommend approval of the request of Frank Puleo and Gary Markovich for a Special Use Permit for the addition of accessory storage up to a total 3600 square feet subject to the removal of two existing storage buildings on site within 60 days of completion of the addition. The City expressed concern over circulation at. 1.4Bth St. and T.H. 61 and potential site distance obstructions due to :location of the proposed two feel Fumes. Discussion with tiNDOT traffic.- engineers verified their need to review any construction adjacent to Mn DCT right-of-way. Because of a death in the family, no one was `'resent and no Site [Man has been received by the City. No., White Rear Lake, is requesting to subdivide =0 acres west of Homestead Avenue and north of 147th Street North into two parcels. Parcel A, 20 acres has 330 ft. of frontage on Homestead Avenue North and meets the community standards for a. legal. lot. Parcel B, 10 landlocked acres, is to be combined with Don and Peggy Kuty'-, ten acre parcel at 14800 Homestead Avenue North. Following_ a brief discussion, the following motion was made by Kell.is.on, seconded by Agness to recommend approval � �f the request of William Wittman to subdivide TO acres into two parcels, one being 10 acres and one 20 acre parcel subject to the followings 1. The legal description and =survey be corrected as necessary. 2. Park dedication of $500.00 per lot paid to the City. 3. E::: v, Jim Bever is requesting a special use permit to establish a wholesale and retail landscape business at his residence at 7151 152nd St. North. The 40 acre parcel is presently zoned agricultural. The property is being planned for rural residential use in the draft comprehensive plan. The sketch diagram of the 10 acre business- site, included a 20 ft. wide class 5 loop driveway, a 40 .X 80 ft, proposed pole barn, future septic and well locations., a 110 k 182 Toot parking area, a 250 foot gravel access. P.C. Minutes - 5-22-96 Page 5 area, and a 104 x 86 foot hard goods area for rock, chips, brick, modular block, boulders, edging and fountains. The proposed site is adjacent to ten acres currently used by Jim Bever and Sons Landscaping. The applicant presently has large metal gates on 132nd St. for security, as there appears to be an ongoing landscape sales business operating from the existing pole barn without a permit. Mr. Bever stated he would like to capitalize on the traffic from "The Garden". He stated he does not intend to construct a building at this time, he is keeping it a smaller retail business. He stated he does not need a sign, just a small marker for his address to identify the property. Mr. Bever stated he is trying to be truthful and "up front" with his business. Adjacent property owners questioned the sale and use of brick and rock as as an incidental use to nursery or agricultural uses and noise from machinery used in the process. Mr. Bever stated that the bobcat used in loading is not loud and they wouldn't operate late at night. He also stated he "could probably just do it anyway without a permit". Several Commissioners agreed it was an appropriate use of the property, stating it would keep the density down. Motion made by Kellison, seconded by Agness to table the application for a special use permit for Jim Bever to extend the application deadline to establish conditions for the special use permit. Minutes - 5-22-96 Page 6 Dan Nadeau is requesting to build a grocery market with gas pumps on the southeast corner of County Rd. 8A and Highway 61. The 1.68 acre subject property is zoned retail business and guided commercial. The proposed site plan includes a request for a Special Use Permit, Section 320-7, and three variances. These are: A reduction of the front yard setback from 40 ft. to 15 ft. for a gas station canopy; a reduction of the front yard parking setback from 10 ft. to 0 ft.; a reduction of the minimum parking space size from 10' X 20' to 9' X 18'. Mr. Ankenny, the architect for the project presented the plan for the building and landscaping. This includes one way access from Highway 61 and two way access on Co. Rd. 8A. The building would be approximately 9,000 sq. ft., with an isolated area for receiving animals, three gas pumps, and 52 parking spaces. A variance for the canopy over the pumps would be required and possibly for the size of parking spaces. The architect is working with Washington County and MNDOT on the accesses. There is a "76" sign proposed on the southwest corner of the property. Most commissioners felt it would be an asset to the community. Tim Agness would like to see additional screening in the rear of the property. Motion made by Rubenzer, seconded by Agness to recommend approval of the Site Plan, Special Use Permit and Variance for the canopy setback subject to three special conditions: 1. Approval from Rice Creek Watershed District. 2. Approval from MnDOT and Washington County Transportation in regards to access and proposed variance criteria. 3. Approval of variances for front yard parking setback; front yard setback for gas station canopy and for required parking. All aye, motion passed. Motion made by Agness, seconded by Kellison to direct staff to resubmit the RFP for park planning with an adjusted amount to be paid for service. All aye, motion passed.
